Appellantsonlyissueonappealiswhetherhispostconvictionpetitionistimebarredbytheapplicablestatuteoflimitations.Therefore,abriefproceduralhistoryisnecessarytoevaluatehisclaim. Appellantwasconvictedoffirstdegreemurderandsentencedtolifeimprisonmentin1979.OndirectappealtothisCourt,hisconvictionandsentencewereaffirmed.SeeStatev.HoraceJones,No.117(Tenn.Crim.App.atJackson,December5,1980).PermissionwassoughtforappealtotheTennesseeSupremeCourt,butdeniedonFebruary2,1981.Appellantfiledhisfirstpostconvictionpetition,allegingineffectiveassistanceofcounsel,intheearly1980's.ThetrialcourtdeniedreliefandthatrulingwasupheldbythisCourt.SeeHoraceJonesv.State,No.12(Tenn.Crim.App.atJackson,December16,1982).In1992,appellantfiledapetitionforhabeascorpusreliefallegingthatimproperjuryinstructionsdeniedhimdueprocess.Thepetitionwastreatedasoneforpostconvictionreliefanddismissedforimpropervenue.ThatactionwasaffirmedbythisCourt.SeeHoraceJonesv.State,No.02C019402CC00021(Tenn.Crim.App.atJackson,June21,1995).Theappellanthasalsopursuedhabeascorpusreliefinthefederalcourts. ThismostrecentpostconvictionpetitionwasfiledbyappellantonMay16,1995.Itallegeserrorsinthetrialcourtsinstructionstothejuryandineffectiveassistanceofcounselinfailingtoobtainrelevantevidencepertainingtohistheoryofselfdefense.UponmotionoftheState,thetrialcourtdismissedthepetitionfindingthatitwasfiledafterthestatuteoflimitationshadexpired. UnderthemandateofthenowrepealedPostConvictionProcedureAct,thestatuteoflimitationapplicabletoappellantspostconvictionclaimswasthreeyears.Tenn.CodeAnn.4030102(repealed1995).ThatthreeyearperiodbeganrunningonJuly1,1986,theeffectivedateofthestatute,andthelastdateonwhichappellantcouldhavefiledsuchapetitionwasJuly1,1989.Seee.g.Statev.Mullins,767S.W.2d668,669(Tenn.Crim.App.1988);Smithv.State,757S.W.2d683,685(Tenn.Crim.App.1988);Statev.Masucci,754S.W.2d90,91(Tenn.Crim.App.1988);andAbstonv.State,749S.W.2d487,488(Tenn.Crim.App.1988).AppellantscurrentpetitionwasfiledinMayof1995,almostsixyearsafterthestatutehadexpired.Therefore,thetrialcourtproperlydismissedappellantspetition. Wearemindfulthatprosepetitionsshouldnotberoutinelydismissedwithouttheappointmentofcounselandanevidentiaryhearing.Moreover,iftheavailabilityofreliefcannotbeconclusivelydeterminedfromaprosepetitionandtheaccompanyingrecords,thepetitionermustbegiventheaidofcounsel.Allenv.State,854S.W.2d873,875(Tenn.1993)(citingSwansonv.State,749S.W.2d731(Tenn.1988)).Therecordbeforeusdemonstratesconclusivelythatappellanthasnotpresentedacolorableclaimandneithercounselnoranevidentiaryhearingwerenecessary. Appellantchallengesthejuryinstructiongivenbythetrialcourtdefiningpremeditationanddeliberation,statingthatsuchinstructionwassubsequentlyinvalidatedbythesupremecourtinStatev.Brown,836S.W.2d530,543(Tenn.1992).ItistruethatthesupremecourtinBrownadmonishedlowercourtsabouttheconfusionwhicharisesfrominstructionsstatingthatpremeditationcouldbeformedinaninstantandadvisedthatthepracticebeabandoned.Id.However,thisholdinghasneverbeeninterpretedtoapplyretroactively,norhasitbeenheldtocreateanewconstitutionalrule.Seee.g.Loftonv.State,898S.W.2d246,24950(Tenn.Crim.App.1994);LeoDrewv.State,No.02C019507CC00180,slipop.at3(Tenn.Crim.App.atJackson,January31,1996);JessieLafrantzJacksonv.State,No.01C019412CR00427,slipop.at15(Tenn.Crim.App.atNashville,December19,1995);TimothyWaynePetersv.State,No.03C019409CR00331,slipop.at4(Tenn.Crim.App.atKnoxville,October30,1995),perm.toappealdenied(Tenn.1996);RichardH.Austinv.State,No.02C019310CR00238,slipop.at6(Tenn.Crim.App.atJackson,May3,1995).Thus,thisgroundforreliefisbarredbythestatuteoflimitations.Sinceitdoesnotannounceanewconstitutionalrulewithretroactiveapplication,itisnotapropergroundforreliefunderBurfordv.State,845S.W.2d204(Tenn.1992).SeeSandsv.State,903S.W.2d297,30102(Tenn.1995). Appellantalsoallegestheineffectiveassistanceoftrialcounsel.Wecannotconsiderthisissuebecauseithasbeenpreviouslydetermined.Acourtisprecludedfromconsideringanygroundwhichhasbeenpreviouslydetermined.Tenn.CodeAnn.4030111(repealed1995).Agroundforreliefispreviouslydeterminedifacourtofcompetentjurisdictionhasruledonthemeritsafterafullandfairhearing.Tenn.CodeAnn.4030112(a)(repealed1995).Thisgroundwasraisedandadjudicatedinappellantsfirstpostconvictionpetitioninwhichhereceivedafullevidentiaryhearing.SeeHoraceJonesv.State,No.12,slipop.at3(Tenn.Crim.App.atJackson,December16,1982).Althoughappellantsfactualcontentionisdifferentinthispetition,appellantmaynotrelitigateapreviouslydeterminedissuebypresentingadditionalfactualallegations.Conev.State,927S.W.2d579,582(Tenn.Crim.App.1995),cert.denied,___U.S.___,117S.Ct.309,136L.Ed.2d226(1996). Appellantsclaimthatthejuryinstructionsonreasonabledoubtandmoralcertaintywereconstitutionallyinfirmiswaived.Thisissuecouldhavebeenraisedinanearlierproceeding,butwasnot.Appellanthasgivennoreasontojustifyhisdelayinraisingit.Thereisapresumptionofwaiverwhenagroundforreliefwasnotraisedinanypriorproceeding.Tenn.CodeAnn.4030112(b)(1)(repealed1995).Thesupremecourthasdirectedustoevaluatewaiverusinganobjectivestandardunderwhichapetitionerisboundbytheactionorinactionofhisattorney.Housev.State,911S.W.2d705,714(Tenn.1995),cert.denied,___U.S.___,116S.Ct.1685,134L.Ed.2d787(1996).Wemustconsidertheissuewaivedforfailureofappellantscounseltoraisethisissueinapriorproceeding.
