Weaffirmthejudgmentofthetrialcourt.  OnAugust11,1977,thepetitionerwasconvictedofaggravatedrape,forwhichhereceivedalifesentence;robberybytheuseofadeadlyweapon,forwhichhereceivedaneightyearsentence;andcrimeagainstnature,forwhichhereceivedasentenceofnotlessthaneightyearsnormorethantwelveyears.Thiscourtaffirmedtheconvictionsondirectappeal.EdwardEarlJonesv.State,No.102(Tenn.Crim.App.,atJackson,Feb.29,1980).AnapplicationforpermissiontoappealtothesupremecourtwasdeniedJuly1,1980.  OnMay14,1996,thepetitionerfiledapostconvictionpetition,challengingthevalidityoftherapeconviction.Thepetitionercontendedthattherewerevariousirregularitiesregardingtheaffidavitofcomplaint,hisarrest,andhispreliminaryhearingintheGeneralSessionsCourt.Healsoarguedthatthereweredeficienciesinthearraignment,thetrial,theinstructionstothejury,andthesentencingprocedure.  ThetrialcourtruledthatthepetitionwasbarredbythethreeyearstatuteoflimitationswhichhadbeenineffectuntilrepealedonMay10,1995.SeeTenn.CodeAnn.4030102to124(repealed1995).  Inthisappeal,thepetitioneralsocomplainsthatheshouldhavebeenappointedcounselforassistanceinhispostconvictionclaim.Hecontendsthatthedistrictattorneygeneralfailedtorespondtohispetitionasrequiredbystatute:8 8 Thedistrictattorneygeneralshallrepresentthestateandrespondbyproperpleadingonbehalfofthestatewithinthirty(30)daysafterreceivingnoticeofthedocketingorwithinsuchtimeasthecourtorders.Tenn.CodeAnn.4030114(a)(repealed1995).  Initially,thedismissalofacolorablepostconvictionclaim,priortothe1995amendment,wasrarelyproperwithouttheappointmentofcounsel.Swansonv.State,749S.W.2d731(Tenn.1988).If,however,itcouldbeconclusivelydeterminedfromtheprosepetitionthatthepetitionerisnotentitledtorelief,asummarydismissalisnotprecluded.Atimebarredpetitionisaclassicexample.See,e.g.,Frederickv.State,906S.W.2d927,930(Tenn.Crim.App.1993)(petitiondismissedwithouttheappointmentofcounselwhenbarredbystatuteoflimitations).Also,thefailureofthedistrictattorneygeneraltoparticipatewouldnotwarrantareversalunlessthepetitionerwasprejudicedthereby.SeeBrownv.State,445S.W.2d669(Tenn.Crim.App.1969).Moreimportantly,theamendmentstothePostConvictionProcedureAct,effectiveMay10,1995,implementedsubstantialchanges.SeeTenn.Pub.Act207,1and3.Now,thetrialjudgesmustgivepreliminaryconsiderationtoeachpetition.Tenn.CodeAnn.4030206(1996Supp.).BecausethispetitionwasfiledMay14,1996,theamendedactwouldapplyand,unlesstheclaimsfallwithinoneofthestatutoryexceptions,asummarydismissalwithouttheappointmentofcounselwouldbeproper:8 8 Ifitplainlyappearsfromthefaceofthepetition,anyannexedexhibitsorthepriorproceedingsinthecasethatthepetitionwasnotfiledinthecourtofconvictionorwithinthetimesetforthinthestatuteoflimitations,orthatapriorpetitionwasfiledattackingtheconvictionandwasresolvedonthemerits,thejudgeshallenteranorderdismissingthepetition....Tenn.CodeAnn.4030206(b)(1996Supp.).
