P    ` Althoughthetrialcourtdidnotexpresslylistthefactors;onwhich;;that;itbaseditsdecisiontodenyprobation<on<,itisapparentfromtherecordthatthecourtbaseditsdecisiononthenatureoftheoffenseandonaconclusionthatprobationwoulddepreciatetheseriousnessoftheoffense.Thenatureandcharacteristicsofthecriminalconductinvolved=isa=>are>factor?s?that@is@AarelogicallyArelatedBlogicallyBtotheissueofdepreciatingtheseriousnessoftheoffense.SeeHartley,818S.W.2dat374!75.  Whenthesefactorsserveastheonlybasisfordenyingprobation, thecircumstancesoftheoffenseascommittedmustbeespeciallyviolent,horrifying,shocking,reprehensible,offensive,orotherwiseofanexcessiveorexaggerateddegreeandthenatureoftheoffensemustoutweighallfactorsfavoringasentenceotherthanconfinement.Bingham,910S.W.2dat454(citation "0 omitted).Therecordindicatesthatafteraverbalconfrontation,AppellantintentionallypointedagunatFreelsheadandpulledthetrigger.Whenthegundidnotfirethefirsttime,AppellantintentionallypulledthetriggeragainandshotFreelsinthehead.Asaresult,Freelsisblindinhisrighteye,deafinhisrightear,paralyzedontherightsideofhisface,andhasbulletfragmentsinhisskullCthatCDwhichDcannotberemoved.Thus,wefindthecircumstancesofthisoffensetobesufficientlyreprehensibleandoffensivetojustifyadenialofprobation. ` Inaddition,weconcludethatAppellantspotentialforrehabilitationalsoweighsagainstasentenceofprobation.Indeed,Appellantspriorcriminalrecordconsistsoftwopublicintoxicationconvictions,tworecklessdrivingconvictions,andoneconvictionfordrivingundertheinfluenceofanintoxicant.This 9p02 continuingdisrespectforthelawindicatesthatAppellanthaspoorpotentialforrehabilitation.Further,therecordindicatesthatAppellantinitiallydeniedallresponsibilityfortheshootingbyclaimingthatFreelshadshothimself.AppellantthenadmittedthatshehadshotFreels,butdeniedresponsibilitybyclaimingthatthegunhadfiredaccidentally.EvenatthesentencinghearingwhensheadmittedtopullingthetriggertwotimesbeforesheshotFreels,AppellantcontinuedtomaintainthattheshootingwasanaccidentthatoccurredonlybecauseFreelsaskedhertoshoothim.ThisCourthaspreviouslystatedthatfailuretoacceptresponsibilityforonescriminalconductreflectspoorlyonrehabilitativepotential.Statev.Zeolia,928S.W.2d457,463(Tenn.Crim.App. p 1996). ` Basedonthecircumstancesofthisoffense,aconclusionthatprobationwoulddepreciatetheseriousnessoftheoffense,andAppellantspoorpotentialforrehabilitation,weholdthatthetrialcourtdidnotabuseitsdiscretionwhenitdeniedprobationinthiscase.Accordingly,thejudgmentofthetrialcourtisAFFIRMED.   `     h   ____________________________________ `     h   JERRYL.SMITH,JUDGECONCUR:___________________________________DAVIDG.HAYES,JUDGE___________________________________JAMESCURWOODWITT,JR.,JUDGE
