V toappealdenied(Tenn.1996).OnJune20,1997,Petitionerfiledapetitionforpost F convictionreliefwhichwassubsequentlydismissedwithoutanevidentiaryhearing.Petitionerfiledatimelynoticeofappeal. `     h   I.ExculpatoryEvidence f$  ` First,PetitionerassertsinhispetitionthattheStatefailedtodisclosefavorableevidencetohim.TheevidenceheclaimsisexculpatoryisaStatewitnesssallegedpriorcriminalrecordandthefactthattheStatedidnotdisclosetohimthatPetitionersdefensecounselhadpreviouslyrepresentedawitnessfortheState.PetitionerdidnotraisetheissueconcerningthepriorcriminalrecordofaStatewitnessondirectappeal. Weagreewiththetrialcourtsorderstatingthatthe 1()  dismissalofthisallegationiswarrantedbecausenofactsarestatedtosupportthebareallegationsofthe[P]etitioner.SeeTenn.Sup.Ct.R.28, 5,- 5(E)(4),5(F)(3),and6(B)(4)(c).Petitionerdoesnotstatewhosecriminalrecordwasnotdivulged,whatconvictionsitwouldhaverevealed,andevenwhether 9f01 theStatehadthiswitnessscriminalrecordinitspossession.ThePetitionerdidraisetheissueabouthiscounselspriorrepresentationofaStatewitness,RobertϜMcDowell.However,hecoucheditintermsofanineffectiveassistanceofcounselclaim,andthisCourtfoundthatalthoughPetitionersdefensecounsel hadrepresentedMcDowellinapreviouscase,therewasnoshowingofaconflictofinterestorthatthispreventedthe[Petitioner]fromreceivingafairtrial.Wefindthatalthoughthisissuewasraisedinadifferentcontext,Petitionershouldhavealsopresentedondirectappealthespecificissuehenowraises.Therefore,ithasbeenwaived.SeeTenn.CodeAnn.4030206(g)and210(f). P   II.DoubleJeopardy !`  ` Petitionerarguesthatthejuryheardevidenceofhispriorcriminalrecordandthatbecausehehadalreadybeenpunishedforthosecrimes,itconstituteddoublejeopardy.Theuseoftheevidenceinnowayconstituteddoublejeopardy,andtherefore,wedonotfindthisissueproperforpostconvictionconsiderationasitdoesnotstatethedeprivationofanyconstitutionalright.SeeTenn.CodeAnn.40 -$$ 30203.  III.UnconstitutionallySelectedJury 4** # `  ` Petitionerassertsinthisissuethat [m]anyjurorshadconflict(s)ofinterestagainstthedefendant.Specifically,hementionsthatonejurorwasafriendofthe  :00 districtattorney,somejurorswerevictimsofcrimesthemselves,andanotherjurorwasafriendandbusinessassociateofajudge.Petitionerdidnotraisethisondirectappeal,andthereforetheissueiswaived.SeeTenn.CodeAnn.4030206(g)and p  Є210(f).Also,wedonotfindthisissueproperforpostconvictionconsiderationbecausethefactsallegeddonotconstitutethedeprivationofanyconstitutionalright.SeeTenn.CodeAnn.4030203. (    IV.AssistanceofCounsel 8 f ` Petitionermakesnumerousclaimsinthisissuethathistrialcounselwasineffective.AlthoughPetitionerdidnotraisesomeofthespecificfactsnowraised,hedidmakethegeneralclaimofineffectiveassistanceofcounselondirectappealandthisCourtdeterminedittobewithoutmerit.Wenotethatwhileineffectiveassistanceofcounselclaimsmayberaisedondirectappealmerelyontherecord,suchapracticeis fraughtwithperil.See,e.g.,Thompsonv.State,958S.W.2d %p 156,161(Tenn.Crim.App.),perm.toappealdenied(Tenn.1997).Generally,the 'x practiceisdisfavoredbecausestepsarenottakentoprepareanadequaterecordontheissueinthetrialcourt.RaisingtheissueondirectappealisariskassumedbyPetitionerandhiscounsel,butitdoesnotmakethisCourtsactionanylessofarulingonthemeritsafterareviewoftherecordbeforeit.Petitionerwasallowedtheopportunitytopresenttheissueofineffectiveassistanceofcounselondirectappeal,andtherefore,thisclaimhasbeenpreviouslydeterminedandisnotcognizableinthispetition.SeeTenn.CodeAnn.4030206(h). 6,, М `   :00   V.IllegalEvidence `  # `  ` Petitionerassertsthatan [o]ldphotoI.D.card[ofhim]wasillegallyintroducedtothejury.Weagreewiththecourtsfindingthatthisisnotanissueforpostconvictionreliefsinceitisnotanabridgmentofanyconstitutionalright.SeeTenn.
