OnJuly14,1981,theDefendantwasconvictedonajuryverdictofburglary,aggravatedsexualbatteryandaggravatedrape.HereceivedaneffectivesentenceoftwentyyearsintheDepartmentofCorrection.Shortlythereafter,hewastransportedtoIndianawherehewassubsequentlyconvictedofseveraloffensesandreceivedasentenceoftwentyfiveyears. +   כAfterservingseveralyearsinIndiana,theDefendantwasapparentlyparoledorotherwisereleasedfromprisoninIndianaandwasreturnedtoTennesseewhereheenteredintothecustodyoftheDepartmentofCorrectiononMay26,1991.HehasbeendeniedparoleseveraltimesandremainsincarceratedintheDepartmentofCorrection. TheDefendantsprimaryargumentattheevidentiaryhearingwasthathisTennesseesentencewastobeservedconcurrentlywithhisIndianasentenceandtherefore,becausehehasbeendischargedfromhisIndianasentence,heshouldalsobedischargedfromhisTennesseesentence.Onappeal,theDefendantarguesthathissentenceisvoidbecauseTennesseeviolatedtheInterstateCompactonDetainersandlostjurisdictionovertheDefendantwhenhewastransportedtoIndiana.HealsoarguesthatbecauseϜhedidnotactuallystartservinghisTennesseesentenceuntil1991,hewasdeniedjailcreditsandtimeforgoodbehaviorinviolationofdueprocessoflaw.̜ MuchoftheDefendantsargumentcentersaroundhiscontentionthattheTennesseeauthoritiesarenotgivinghimcreditonhissentenceforthetimeheservedinIndiana.Fromthisrecord,wecannotdetermineforcertainwhethertheDefendantsTennesseesentencesweretorunconcurrentlywithorconsecutivelytotheIndianasentences.ItappearsfromthetestimonypresentedattheevidentiaryhearingthattheDefendantwaseithereligibleforparoleatthetimehereturnedtoTennesseein1991orthathebecameeligibleforparoleshortlythereafter.ThisfactsuggeststhattheDefendanthasreceivedcreditonhisTennesseesentencesforthetimeheservedinIndiana.Inanyevent,timecreditsandsentencereductioncreditsaregenerallyinappropriateconsiderationsinahabeascorpusproceedingandmustbeaddressedthroughtheUniformAdministrativeProceduresAct.Tenn.CodeAnn.45101to324;Carrollv.Raney,868S.W.2d721,723(Tenn.Crim.App.1993).ThesolereliefavailableunderTennesseeshabeascorpusstatuteisdischargefromcustody.Taylorv.Morgan,909S.W.2d17,20(Tenn.Crim.App.1995). HabeascorpusreliefisavailableunderTennesseelawonlywhenaconvictingcourtiswithoutjurisdictionorauthoritytosentenceadefendantorwhenthatdefendantstermofimprisonmentorrestrainthasexpired.Archerv.State,851S.W.2d157,164(Tenn.1993).ThereisnothinginthisrecordthatdemonstratesthattheconvictingcourtwaswithoutjurisdictionorauthoritytosentencetheDefendanttoservetwentyyearsinconfinementfortheconvictionswhichhereceivedonJuly14,1981.ThereisfurthernothingcontainedinthisrecordwhichdemonstratesthattheDefendantstermofimprisonmentorrestrainthasexpired.Therefore,wecannotconcludethatthetrialcourterredbydenyingtheDefendanthabeascorpusrelief.̛̜ Thejudgmentofthetrialcourtisaffirmed.          ____________________________________     DAVIDH.WELLES,JUDGECONCUR:___________________________________GARYR.WADE,JUDGE___________________________________J.CURWOODWITT,JR.,JUDGE
