CASEHISTORY       Ӏ TheappellantfiledhisfirstpetitionforpostconvictionreliefonMarch26,1992,allegingineffectiveassistanceofcounsel.Thetrialcourtfoundtheappellantreceivedeffectiveassistanceofcounselathistrial.ThisCourtupheldthetrialcourtsdenialoftheappellantspetitionforpostconvictionrelief.BillyErnestKilburnv.State,C.C.A.No.02C019403CC00033,ObionCounty(Tenn.Crim.App.filedAugust3,1994,atJackson)perm.toappealdenied(Tenn.1994). Appellantsubsequentlyfiledasecondprosepetitionforpostconvictionrelief,thesubjectoftheinstantappeal.Afterappointingcounsel,thetrialcourtdismissedthepetitionfindingthat1)thepetitionwasnottimelyfiled,2)theissueofineffectiveassistanceofcounselhadbeeneither waivedorpreviouslydetermined,and3)thejuryinstructionsgivenatappellantstrialwereconstitutionallyvalid.   I. StatuteofLimitations    TheappellantarguesthatheisentitledtoapostconvictionhearingbecausethenewPostConvictionProcedureActextendsthefilingperiodtoMay10,1996.UnderthenewPostConvictionProcedureAct,thestatuteoflimitationsforpostconvictionreliefisreducedtoone(1)year.Tenn.CodeAnn.4030202(Supp.1996).TheActalsoprovidesforaone(1)yeargraceperiodfromMay10,1995,tofileapetitionorreopenapetitionforpostconvictionrelief.However,thegraceperioddoesnotapplyinthisinstancebecausepostconvictionreliefwasalreadybarredbythestatuteoflimitationswhenthenewlegislationwasenacted.WhenthisCourtaffirmedpetitionersoriginalconvictiononAugust28,1991,petitionersconvictionbecamefinal.Therefore,hisclaimwasinexistencepriortoenactmentofthenewPostConvictionProcedureActandexpiredAugust28,1994.Tenn.CodeAnn.4030102(repealedby1995Tenn.Pub.Act207,1). ThenewPostConvictionProcedureActwasnotmeanttorevivepreviouslybarredclaims.SeeJimmyEarlLoftonv.State,C.C.A.No.02C019603CR00073,ShelbyCounty(Tenn.Crim.App.filedMarch7,1997,atJackson);EricC.Pendletonv.State,C.C.A.No.01C019604CR00158,DavidsonCounty(Tenn.Crim.App.filedFebruary12,1997,atNashville);JohnnyL.Butlerv.State,C.C.A.No.02C019509CR00289,ShelbyCounty(Tenn.Crim.App.filedDecember2,1996,atJackson).ThemajorityofthisCourtisnolongerfollowingArnoldCarterv.State,C.C.A.No.03C019509CC00270,MonroeCounty(Tenn.Crim.App.filedJuly11,1996,atKnoxville).Accordingly,thisissueiswithoutmerit.   II.IneffectiveAssistanceofCounsel    Theappellantraisedtheissueofineffectiveassistanceofcounselinhisfirstpostconvictionpetitionandwasgivenafullevidentiaryhearing.Hespecificallyallegedthattrialcounsel1)didnotproperlyadvisehimwhethertotestifyinhisownbehalf,2)unfairlyprejudicedhiscasethroughremarksmadeduringopeningstatement,3)wasineffectiveinexaminingwitnesses,4)prejudicedandalienatedthejurybyhisactionsduringthecourseofthetrial,and5)wasineffectiveinnotperfectinganappealtotheTennesseeSupremeCourt.Thetrialcourtdeniedrelief,andthisCourtaffirmed.  Petitionersubsequentlyfiledtheinstantpetitionallegingineffectiveassistanceofcounsel.Thetrialcourtdismissedthepetitionwithoutanevidentiaryhearingfindingtheissueshadbeeneither waivedorpreviouslydetermined.Therecorddoesnotpreponderateagainstthisfinding.Moreover,agroundforreliefispreviouslydeterminedifacourtofcompetentjurisdictionhasruledonthemeritsafterafullandfairhearing.Tenn.CodeAnn.4030206(h)(Supp.1996);Housev.State,911S.W.2d705,711(Tenn.1995).Accordingly,thisissuewaspreviouslydeterminedandiswithoutmerit.   III.JuryCharge    Theappellantarguesthejuryinstructiondefining reasonabledoubtviolatesdueprocessbyloweringtheburdenonthestatetoproveguilt. Ourcourtshaverepeatedlyheldthatusingthephrase moralcertaintyinconjunctionwithaninstructionthat reasonabledoubtisthatdoubtengenderedbyaninvestigationofalltheproofinthecaseandaninability,aftersuchinvestigation,toletthemindresteasilyastothecertaintyofguiltisavalidinstructiononreasonabledoubt.Nicholsv.State,877S.W.2d722,734(Tenn.1994);Statev.Sexton,917S.W.2d263,266(Tenn.CrimApp.1995);Pettyjohnv.State,885S.W.2d364,366(Tenn.Crim.App.1994);Statev.Hallock,875S.W.2d285,294(Tenn.Crim.App.1993).Therecordreflectsthejurychargewasgivenwiththeaboveinstructionpertainingtoreasonabledoubt. Furthermore,thisissuehasbeenwaived.Agroundforreliefiswaivedifthepetitionerpersonallyorthroughanattorneyfailstoraiseitfordeterminationinanyproceedingbeforeacourtofcompetentjurisdictioninwhichthegroundcouldhavebeenpresented.Tenn.CodeAnn.4030206(g)(Supp.1996).Thepetitionerhaswaivedthisissuebyfailingtoincludeitinhisfirstpostconvictionpetition.Accordingly,thisissueiswithoutmerit.
