Nashville,TN37201                   OPINIONFILED:____________________ AFFIRMED JOHNH.PEAY, Judge  @ OPINION     Thedefendantwasconvictedin1972oftwoarmedrobberiesandsentencedtoconsecutivetermsoftwelveandfifteenyears.In1973,heescapedfromprison.In1982,hewasarrestedinNebraska,andin1983hepledguiltyinTennesseetoescapeandwassentencedtoaoneyearterm.HewassubsequentlyreturnedtoNebraskaforserviceofthatstatessentence.In1990,hewasparoledfromhisNebraskasentenceandreturnedtoTennessee.InApril1990,hefiledaproϜse PetitionForPostConvictionorWritofHabeasCorpuswhichwasdenied.ThisdenialwasaffirmedbythisCourtondirectappeal.In1994,thepetitionerfiledtheinstantpetitionforwritofhabeascorpus,whichwasalsodenied.Thepetitionerhasagainappealed,settingforthhisissueas WhethertheappellantisentitledtoreliefunderaWritofHabeus[sic]Corpusor[the]PostConvictionReliefstatutebywithdrawinghisguiltypleaandaskingforatrialwhenthecontractforwhichthepleawasenteredhasbeendeniedorbrokenbytheState,becausethedefendantagreedtoonesentence,aconcurrentonewhichisillegal,butanothersentence,aconsecutiveone,wasimposed.Afterreviewingtherecord,weaffirmthejudgmentϜbelow.  Thepetitionerraisesinthisappealanissuewhichhedidnotraisebelow.Inhisamendedpetitionforwritofhabeascorpus,heallegedthat heisbeingillegallyrestrainedbecausethesentencesforarmedrobberyandescapeinTennesseewhichwereorderedonSeptember18,1983,torunconcurrentlywitheachotherandconcurrentlywiththesentenceforarmedrobberyinNebraskahaveexpired.Ignoringthemerits(orlackthereof)ofthisallegationforthemoment,hisϜamendedpetitioncontainsnotawordaboutapleabargainorrejectionthereof.Noristhereanyproofintherecordbeforeusofanypleabargainand/ortheallegedtermsthereof.Thecourtbelowwasgivennoopportunitytoconsider,first,whetherthepetitionerhadhadapleabargainand,ifso,itsterms;second,whethertheϜsentencingcourthadrefusedtoacceptthatpleabargain;andthird,whetherhehadthenbeengivenanopportunitytowithdrawhisguiltyplea. .   כAccordingly,thisissuehasbeenwaived.SeeStatev.Adkisson,899S.W.2d626,635(Tenn.Crim.App.1994)( asageneralrule,apartywillnotbepermittedtoassertanissueforthefirsttimeintheappellatecourt.)  Returningtothemeritsofthepetitionersallegationinhisamendedpetition,wefindnoerrorbythecourtbelow.Inacceptingthepetitionersguiltypleatotheescapecharge,thetrialcourtsentencedthepetitionertoatermofoneyear.Thedocumentreflectingthepleaandsentencecontainedintherecordbeforeusdoesnotincludeanyreferenceastowhetherthissentencewastobeservedconcurrentlyorconsecutivelytothearmedrobberysentences.However,thecourtbelowfoundthattheminuteentryfortheescapeoffensereflectedthatthesentencewastorunconsecutively.Moreover,thissentencewasstatutorilyrequiredtorunconsecutivelytotherobberysentences.T.C.A.393802(1973Supp).  Thepetitionerbasedhisallegationthathissentenceshadexpiredonthestatementcontainedinthedocumentreflectinghispleaandsentencethat thedateofhisimprisonment[fortheescapeconviction]commence[s]fromthe19thdayofSeptember,1983.Hearguedbelowthatthisstatementmeantnotonlythathisescapesentencewastobeservedconcurrentlywithhisarmedrobberysentences,butalsothathebeganservingallofthesesentencesatthatpoint.Thecourtbelowfoundnomerittothisargument.Nordowe.
