М̛à ` àThe€victim€in€this€case€is€defendant's€stepdaughter,€H.K.ñ˜ñœ×ƒ×ñ˜ññ˜ñ׃×ñ˜ñÝ ƒ#ÃÝòòÚ  Ú1Ú  ÚóóÝ  Ý×  ×›€€She€testified€thatÐ &V!% Ðshe€initially€consented€to€have€sex€with€defendant€during€the€spring€of€1994€whenÏshe€was€fourteen€years€old.€€She€claimed€that€they€had€intercourse€œ"[p]robably›Ïanywhere€from€10€to€15"€times.€€She€did€not€specify€when€the€encounters€occurred.€ÏShe€testified€that€she€also€performed€oral€sex€on€defendant,€but€again€did€notÏspecify€when€these€incidents€occurred.€€H.K.€also€testified€that,€after€she€had€sexÏwith€defendant,€he€would€give€her€and€her€siblings€liquor€and€marijuana.€€HerÏdescription€on€direct€examination€about€the€last€time€she€and€defendant€had€sexÏwas€the€following:ÌÓÓà ` àœà ¸ àQ:à8  àDo›€you€remember€approximately€when€was€the€lastÐ 26‚17 Мtime€you›€and€Mr.€Keen€had€sex?Ð7h28Ð Ð  Мà ` àà ¸ àA:à8  àIt›€was€probably€a€month€and€a€half€before€I€told,€whichÐ ° Мwas›€April€œ23rd›€of€[1996].Ð Ð Ð  ÐÌœà ` àà ¸ àQ:à8  àSo›€sometime€during€March€of€that€year?Ðb²Ð Ð  ÐÌœà ` àà ¸ àA:à8  àYes.›€Ð. ~Ð Ð  ÐÌÓÓà ` àH.K.€initially€reported€her€allegations€to€her€mother,€Marilyn€Wood,€in€AprilÏ1996.€€Wood€took€her€children€out€of€the€house€and€when€she€returned,€defendantÏwas€gone.€€Wood€testified€that€defendant€called€her€the€next€day,€"crying,€telling€meÏhe€was€a€sick€man,€that€he€wanted€me€to€stick€by€him€and€help€him€get€help."€€SheÏfurther€testified€that€defendant€admitted€to€her€in€May€1996€that€he€"had€sex€withÏ[H.K.]€for€over€a€year."€€Ìà ` àOn€May€5,€1996,€defendant€was€admitted€into€a€hospital.€€œCalvily›€œEvonne›ÏœAllmon,›€the€psychiatric€social€worker€who€interviewed€him€upon€his€admission,Ïtestified€that,€œ"[a]ccording›€to€[her]€notes€[defendant]€admitted€to€sexual€abuse€withÏhis€stepdaughter."€€Dr.€Robert€A.€Jack,€the€psychiatrist€who€treated€defendant€at€theÏhospital,€testified€that€part€of€the€May€13,€1996,€discharge€plan€was€that€he€attendÏtreatment€at€a€sexual€perpetrators€program.Ìà ` àH.K.'s€allegations€were€not€reported€to€the€police€until€July€31,€1996,€whenÏshe€told€Detective€Susan€Morrow,€"that€her€stepfather€was€having€sexualÏintercourse€with€her€and€she€was€performing€oral€sex€on€him."€€Morrow€also€testifiedÏthat€H.K.€had€reported€defendant€giving€her€alcohol€and€marijuana€after€their€sexualÏencounters.Ìà ` àDefendant€testified€and€admitted€giving€H.K.€alcohol€and€marijuana.€€He€alsoÏadmitted€talking€with€H.K.€about€having€sexual€relations€with€her.€€He€denied,Ïhowever,€that€he€ever€had€sex€with€her.€€He€further€denied€having€told€Allmon€or€Dr.ÏJack€that€he€had€sexual€relations€with€her.€€He€testified€that€Wood€told€him€sheÏwanted€a€divorce€and€that€if€he€"messed€this€up€for€her€.€.€.€[she]€will€say€that€[he]Ïraped€[her]€daughter."€€ÌÌœÌÌÐ ²95; Ðstepdaughters,€ages€15€and€16,€and€their€son,€and€leftÏœ.›€.€.€.€€This€followed€the€oldest€daughter€telling€herÏmother€that€[he]€had€propositioned€her;"€Ð Ð Ð  ÐÌà ` àœà ¸ à2.›à8  àhe€"admitted€to€sexual€abuse€with€his€stepdaughter;"€Ðº' #'Ð Ð  ÐÌà ` àœà ¸ à3.›à8  àhe€informed€her€that€he€didn't€know€if€he€was€"evil€orÐ †)Ö$) Ðsick;"€andÐ Ð Ð  ÐÌà ` àœà ¸ à4.›à8 âtheir€having€sexual€relations,€and€in€light€of€the€remaining€proof€in€the€record,€weÐ ¶0,1 Ðhold€that€the€admission€of€this€testimony,€while€error,€does€not€rise€to€the€level€ofÏplain€error€requiring€reversal.€€This€issue€is€without€merit.Ìâ âà ` àIn€a€related€issue,€defendant€contends€that€the€trial€court€erred€in€allowingÏAllmon€to€testify€that€defendant€€told€her€he€sexually€abused€his€stepdaughter.€€HeÏargues€it€was€not€relevant€or,€alternatively,€any€relevance€was€substantiallyÏoutweighed€by€the€danger€of€unfair€prejudice,€confusion€of€the€issues,€or€misleadingÏthe€jury.€€òòSeeóó€Tenn.€R.€¢Evid£.€402,€403.€€Allmon€was€unable€to€clarify€œthe›€time€periodÐ Ðto€which€defendant€referred,€making€the€testimony€œñ”ñquestñ”ññ•ññ”ñoñ”ññ•ññ–ñionable€ñ–ññ—ñvirtually›€useless›€ñ—ñas›€proof€of€theÏparticular€crimes€with€which€he€was€charged.€€Moreover,€the€record€establishes€thatÏdefendant€had€two€stepdaughters.€€Allmon€did€not€identify€which€girl€defendantÏallegedly€abused.€€Finally,€Allmon€did€not€specify€what€conduct€was€meant€byÏ"sexual€abuse."€€Regardless,€we€find€that€its€admission€did€not€so€prejudiceÏdefendant€as€to€require€reversal.€€This€issue€is€without€merit.Ì̛̜à@F
