JOHNH.PEAY,  P7-1 Judge  09/3 X  @:M $XX OPINION#X X$~#Ԉ `     InNovember1997,thedefendantpledguiltytoaggravatedburglary,aClassCfelony.Asentencinghearingwasscheduledtodeterminethelengthandmannerofserviceofthesentence.Afterreceivingevidence,thetrialcourtappliedfourstatutoryenhancingfactorsandonemitigatingfactor,butdeclinedtoapplyseveralothermitigatingfactorssubmittedbythedefendant.Basedonitsfindings,thetrialcourtsentencedthedefendantasaRangeIstandardoffendertotheDepartmentofCorrectionforsixyears,themaximumsentence.SeeT.C.A.4035112(a)(3). &   Thedefendantnowappeals,challenginghissentence.Specifically,thedefendantchallengesthelengthofhissentence,arguingthatthetrialcourterroneouslyappliedenhancingfactorT.C.A.4035114(3),thattheoffenseinvolvedmorethanonevictim;thatthetrialcourterredinfailingtoapplythemitigatingfactorshesubmittedforconsideration;andthatthetrialcourtfailedtocomplywiththerequirementthatitarticulatehowthemitigatingandenhancingfactorswerebalancedindeterminingthesentence.Thedefendantalsoarguesthatthetrialcourterredinrefusingtosentencehimtocommunitycorrectionsandinadmittingevidenceofchargespendingagainsthim. Wenotethatinhisreplybrief,thedefendantarguedthatbecausetheStatefailedtoseparatelydesignateadditionalportionsoftherecorditbelievedtobenecessary /%* forfullreviewoftheissuespresentedonappeal,asprovidedforinT.R.A.P.24(a),theStateshouldbeprecludedfromarguingthatanincompleterecordbarsreviewofthedefendantssentence.Suchanargumentisdisingenuous.RegardlessofwhethertheStatearguesthatanincompleterecordbarsreviewofthedefendantssentenceorwhethertheStatehasmayhavesomehowwaivedthisargumentunderT.R.A.P.24(a)thisCourtwillnotspeculatewhatthemissingportionsoftherecordmayormaynotreveal.Instead,thepropercourseofactionisforthisCourttosuaspontepresumethatthetrial (  courtsdecisioniscorrectwhentherecordisinsufficienttodetermineotherwise.Inthiscase,theincompletenatureoftherecordrequiresustopresumethatasixyearsentencewasjustifiedinthiscase.  Nevertheless,despitetheincompleterecord,therecordonappealissufficienttodeterminethatthetrialcourtdidnoterrinsentencingthedefendanttoprisonratherthancommunitycorrections.Afelonsrehabilitationpotentialandtheriskofrepeatingcriminalconductarefundamentalindeterminingwhetherheorsheissuitedforalternativesentencing.SeeT.C.A.4035103(5).Here,thethirtyfiveyearold T$ defendanthasbeenpreviouslyconvictedofsevenfeloniesandseveralmisdemeanors.Twicehehasviolatedimposedtermsofprobation,andwhenhecommittedtheunderlyingoffenseinthiscase,hehadbeenreleasedfromjailonanunrelatedchargeforonlythreedays.Eventhoughthedefendantarguesotherwise,thesefactsshowapoorpotentialforrehabilitation,whichissufficientreasontojustifyatermofincarcerationratherthanalternativesentencing.SeeStatev.Zeolia,928S.W.2d457,463(Tenn.Crim.App. /%* 1996).  Thedefendantalsoarguesthetrialcourterredinadmittingevidencethatthedefendantcommittedsimilarcrimesthreemonthsafterhisarrestinthiscase.Atthetimeofthesentencinghearing,thedefendanthadbeenarrestedfortwootheraggravatedburglariesandanattemptedrape,butpreliminaryhearingshadnotyetbeenheld. 906 Nevertheless,thetrialcourtadmittedthetestimonyofthreeallegedvictims,whodescribedcircumstancessimilartothefactsunderlyingtheinstantcase,andthetestimonyofthepoliceofficerinvestigatingthosecases,whostatedthedefendanthadconfessed.Thetrialcourtreiteratedthatthisevidencewasadmittednotforconsiderationasanenhancingfactor,butrather,solelyforthelimitedpurposeofevaluatingthedefendantspotentialforrehabilitationintermsofwhetherplacementinthecommunitycorrectionsprogramwasappropriate.Giventhis,evenitwaserrortoadmitthisevidenceofsubsequentcrimes,anyerrormustbedeemedharmlesssince,aswehavedetermined,therecordcontainssufficientindependentevidencetojustifyimposingatermofincarcerationratherthancommunitycorrections.  Insum,weconcludetherecordisincompletetoconductaproperdenovoreviewofthedefendantssentence.Assuch,wepresumethattheimpositionofasixyearsentencewasproper.BasedontherecordthatwaspresentedtothisCourt,however,thetrialcourtdidnoterrindenyingthedefendantplacementinthecommunitycorrectionsprogram.Thetrialcourtsjudgmentis,inallrespects,affirmed.
