GUX<% X XX<%  1      ׀Followingapostconvictionevidentiaryhearing, > thetrialcourtdeniedrelief,andDefendantappealed.Inthisappeal,Defendantraisesthreeassignmentsoferrorforreview:(1)thetrialcourtfailedtocomplywithTennesseeRuleofCriminalProcedure11(d),andasaresult,hispleawasnotenteredvoluntarily;(2)thetrialcourterredbyoverrulinghismotiontodismisshisattorneysofrecord;and(3)hesufferedtheineffectiveassistanceofcounselbecausecounselfailedtorequestachangeofvenue.@rr-I. ` InhishalfpageargumenttothisCourt,Defendantallegesthatthetrialcourt failedtoadvisehimofcertainofhisconstitutionalrightsandstatutoryrights,citingtoBoykinv.Alabama,395U.S.238(1969),andStatev.Mackey, 3** 553S.W.2d337(Tenn.1977).Athoroughreviewofthepleahearingtranscript 6,, revealsthatDefendantshearingcouldperhapsserveasamodelfortrialjudgestofollowwhenacceptingguiltypleas.Thetrialjudgeinthiscaseplacedtheutmostimportance6to67on7Defendantsunderstandingoftheproceedings,includingtheprotectionsaffordedbytheUnitedStatesandTennesseeConstitutions. ` Inhisbrief,Defendantspecifiesonlyonerightwhichhecontendswasnotbutshouldhavebeengiven.Hestates, TheCourtfailedtoadvisehimthathehadaspecificrighttoachangeofvenue....Defendanthasnotcited,norcanthisCourtlocate,anyauthoritytendingtoshowthatthetrialcourthasadutytoinformcriminaldefendantsofarighttochangevenue.Therefore,thisissueisbothwaivedandwithoutmerit.WeconcludethatthetrialcourtproperlyensuredtheknowingandvoluntarynatureofDefendantsplea.@TT-II. ` Inhissecondissue,Defendantallegesthatthetrialcourterredbydenyinghismotiontodismisshisattorneysofrecord.However,astheStatepointsout,DefendanthaswaivedthisissuebyfailingtoprovideanyargumentinhisbriefonappealtothisCourt.@66,III. ` Finally,Defendantarguesthathesufferedtheineffectiveassistanceofcounselpriortohisguiltyplea.Gleaninghisargumentfromthe8s88S8tatementof9f99F9acts:containedinhisbrief:,itappearsthatthisissuehastwoprongs:(1)hiscounselfailedtoadvisehimofhisconstitutionalrights,includingtherighttoplead<  8.. <notguiltyandproceedtotrial;and(2)hiscounselfailedtoinformhimthathiscasecouldhavebeenmovedtoalocationotherthanFranklinorGrundyCounty.;; ` ItismorethanapparentfromthetranscriptoftheguiltypleathatDefendantwasawareofhisconstitutionalrights,includingtherighttopleadnotguiltyandproceedtotrial.Therefore,evenifhiscounselhadbeendeficientinthisrespect,Defendantcouldnotfulfillhisburdentoshowhewasprejudicedbythedeficiency.Furthermore,hispretrialcounseltestifiedatthepostconvictionhearingthatthedecisionnottorequestachangeofvenuewas=adecisionoftacticwhichhadbeen=>madeaftertheissuewasfully>discussedwithDefendantpriortotheplea.Defendanttestifiedathispleahearingthathehadnodissatisfactionwithhispretrialcounsel. ` Thetrialjudgeenteredathoroughmemorandumopiniondenyingpostconvictionrelief.Theevidenceclearlysupportsthetrialjudgesfindings.Baseduponathoroughreadingoftherecord,thebriefsoftheparties,andthelawgoverningtheissuespresentedforreview,weaffirmthejudgmentofthetrialcourt.   `     h   ____________________________________ `     h   DAVIDH.WELLES,JUDGE   5++ CONCUR:___________________________________JOHNH.PEAY,JUDGE__________________________________JAMESCURWOODWITT,JR.
