App.P.13(e). Wehaveviewedtheevidenceintherecordinthelightmostfavorabletothestateandconcludethattheevidenceislegallysufficienttosustainthedefendantsconvictionsfortheftandburglary. ThiscasebeganwhenHectorJavrequifiledanaffidavitofcomplaintintheBradleyCountySessionsCourtaccusingthedefendantofstealingsomemechanictoolsandotherpropertyfromhistruck.$  #  3      ׀Thetruckhadbeenparkedon "  thedefendantspropertywithherpermission.Javrequihadknownthedefendantforseveralyearsandhadrecentlyworkedonherautomobile.AccordingtoJavrequi,whenheconfrontedthedefendantaboutthemissingitems,shetoldhimthatshehadbrokenthesmallwindowonthepassengersideandremovedthepropertybecauseDonnaCatlett,hisnewgirlfriend,owedhersomemoney.Laterthedefendanttoldhimthatshewouldnotreturnthepropertyuntilhefixedthe knockinhercarsengineandhadrepaidthe$150heowedher.Javrequitestifiedthatthestolenitemswereworth$4,983.Aweekpriortotrial,thedefendantreturnedtohimanumberofitems;however,hevaluedthepropertystillmissingat$3,083.DellaHensley,aformeremployeeandfriendofthedefendant, p504 corroboratedJavrequistestimony.Shetestifiedthatthedefendantadmittedtoherthatshehadthevictimspropertyandwouldnotreturnituntilhefixedhercar.ThedefendanttoldHensleythatshehadgottenridofsomeoftheitemsandthatshewouldsavethetoolboxesforHensleysson.Duringcrossexamination,Hensleyadmittedthatsheandthedefendantwereinvolvedinalegaldisputeoversomerealpropertywhichthedefendanthadleasedfromherson.Sheandthedefendanthadcometoblowsduringanespeciallyheatedconfrontation. Thedefendanttestifiedinherownbehalfanddeniedthatshehadremovedanythingfromthedefendantstruck.Thelargetoolboxeswerestoredinashedonherproperty,andshecontendedthattwoofheremployeestooktheitemsfromthetruck.JavrequihadattemptedtorebuildtheengineofherCadillac,andshewasnotsatisfiedwithhiswork.Sheadmittedthatsherefusedtoreturnthetoolsandtoolboxesuntiltheautomobilewascorrectlyrepairedandhepaidherthemoneythatheowedher.Sheimmediatelyreturnedthe.22riflethatheremployeeshadtakenfromthetruckandthen,theweekbeforethetrial,returnedeverythinginherpossessiontothevictim.Thereturneditemsincludedvariouspiecesoftestingequipmentthatweremissingfromthecabofthetruck.Javrequiacknowledgedthatshereturnedtherifleandsomeofthemissingitems.Healsoadmittedthatduetothedefendantsphysicallimitationsshecouldnothavepersonallyremovedtheitemsfromthetruckunassisted.  #  4      ׀ 0*%(  Thefirstcountoftheindictmentchargedthedefendantwiththeftofpropertyvaluedatmorethan$1,000.PursuanttoTennesseeCodeAnnotatedsection3914103,theoffenseoftheftiscommittedif withintenttodeprivetheownerofproperty,thepersonknowinglyobtainsorexercisescontroloverthe 3.2 propertywithouttheownerseffectiveconsent.&  #  5      ׀Ifthevalueoftheproperty  obtainedismorethan$1,000butlessthan$10,000,theftisaclassDfelony.Tenn.CodeAnn.3914105(3)(1997).Inthiscase,thedefendantadmittedthatsherefusedtoreturnthedefendantstoolsandtoolboxesbecauseheowedhermoneyandhadnotrepairedherautomobiletohersatisfaction.ShealsoadmittedthatshemovedthedefendantstoolsandtoolboxesfromthepropertybelongingtoHensleyssontoanotherlocation.Itisclearthatshebothobtainedandexercisedcontroloverthedefendantspropertywiththeintenttodeprivehimofitsuse.Thevalueofthepropertythatthedefendantreturnedtothevictimexceeded$1,000.Theevidenceintherecordissufficientforanyrationaltrieroffacttohavefoundtheessentialelementsoftheftbeyondareasonabledoubt. Thedefendantwasalsoconvictedofburglaryofanautomobile.Tosustainaconvictionforthisoffensethestatemustprovebeyondareasonabledoubtthatthedefendantenteredanautomobilewithouttheeffectiveconsentoftheownerandwiththeintenttocommitafelony,theftorassault.Tenn.CodeAnn.3914402(a)(4)(1997). Thedefendantcontendsthatitwasphysicallyimpossibleforhertoenterthevictimstruckandremovehisproperty.Evidenceintherecordmakesitunlikelythatthedefendantpersonallymoveditemsweighingtwoorthreehundredpoundsfromthebackofthetruck.However,thejuryhadbeforeittheincriminatorystatementsthedefendantmadetoJavreckiquiandDellaHensley.Inaddition,thejurorswerepresentinthecourtroom.Theycouldseethedefendantsphysicalcondition,andtheymaywellhaveconcludedthatalthoughsherequiredhelp,she 1-0 couldhavereachedintothepassengercompartmentandremovedsomeofthesmalleritems.Nothinginthestatutorydefinitionofburglaryrequiresthattheaccuseduseforceorbreakanythingtocommittheoffense.Itmerelyrequiresthatapersonwhointendstocommitafelonyenterthevehiclewithouttheeffective P  consentoftheowner.SeeTenn.CodeAnn.3914402(a)(4)(1997).Tocommit 0  aburglary,thedefendantsentirebodyneednotenter. Entrymeanstheintrusionofanypartofthebodyorintrusionofanyobjectinphysicalcontactwiththebodyorcontrolledbyremotecontrol.Tenn.Code.Ann.3914402(b).Ifanyportionofthedefendantsbodysuchasherhandintrudeditselfintothevictimstruck,theelementofentryissatisfied.
