àOPINIONóóÌThe€appellant,€Debra€L.€Laizure,€was€charged€œin€a€two€count€indictment€withÏ1)€the€unlawful€and€unauthorized€use€of€a€credit€card,€€and€2)€the€unlawful€andÏknowing€possession€and€control€of€a€credit€card.€€In€a€negotiated€plea,€the€appellantÏpled€guilty›€to€œcount€one€(1),€the€unlawful€and€unauthorized€use€of›€a€credit€œcard.€ÏCount€two€(2)€was€dismissed.€€She€was€sentenced›€to€one€(1)€year€as€a€standardÏRange€I€offender€to€be€served€on€supervised€œprobation.€€She›€was€ordered€to€payÏrestitution€in€the€amount€of€$868.65€to€be€paid€at€the€rate€of€€$75€a€month,€and€toÏserve€one€hundred€hours€of€community€service.€€On€appeal€she€contends€that€theÏtrial€court€abused€its€discretion€when€it€refused€to€grant€judicial€diversion.€€We€affirmÏthe€trial€court.ÌMr.€Charles€Howard,€the€victim€in€this€case,€made€a€purchase€with€his€BPÏcredit€card€at€a€convenience€store€where€the€appellant€was€a€cashier€and€then€forgotÏto€take€his€card€back.€€The€appellant€proceeded€to€use€Mr.€Howardððs€credit€card€overÏthe€next€month€to€purchase€goods€and€receive€cash€advances.€€The€total€chargesÏwere€$868.65.€€The€appellant€used€the€card€on€four€(4)€occasions€and€forged€her€co„employeesðð€signatures€on€the€credit€card€receipts.€ÌThe€appellant€is€a€thirty„six„year€old€mother€of€two€who€has€been€married€forÏeighteen€years.€€She€graduated€from€high€school€and€has€demonstrated€a€stableÏemployment€history.€€Prior€to€being€arrested€on€the€stolen€credit€card€charges,€theÏappellant€worked€at€the€BP€station€in€La€Vergne,€Tennessee,€for€three€years.€€TheÏappellant€testified€at€her€probation€hearing€that€she€knew€that€what€she€had€doneÏwas€ð ðstupidðð€and€wrong.€€She€explained€that€at€the€time€she€committed€the€crimes€herÏhusband€was€out€of€work€and€her€family€was€having€difficulty€meeting€its€basic€needsÏfor€housing€and€electricity.€Two€letters€were€introduced€into€evidence€on€theÏappellantððs€behalf.€€One€was€from€the€owner€of€a€Po€Folks€restaurant€where€theÏappellant€was€employed€after€being€fired€from€the€BP€station.€€The€owner€knew€aboutÏthe€appellantððs€conviction;€however,€he€had€full€faith€in€her€honesty€and€integrity€andÏfound€her€to€be€a€good€and€hard€worker.€€The€second€letter€was€from€the€OperationsÏManager€of€Ryanððs€Steak€House€where€the€appellant€was€employed€at€the€time€ofÏthe€probation€hearing.€€The€Operations€Manager€affirmed€the€view€that€the€appellantÍis€a€good€worker.€€The€appellant€has€no€prior€record€of€criminal€conduct.€€However,Ïshe€apparently€admitted€to€the€probation€department€that€she€occasionally€usedÏmarijuana€up€until€1994;€however,€she€reported€no€alcohol€problems.€€ÌThe€trial€court€denied€judicial€diversion€in€this€case€because€ð ðotherÏemployeesðð€signatures€were€forged€by€this€defendant€in€this€theft€schemeðð€andÏbecause€the€appellant€used€the€card€more€than€once.€Finding€that€there€was€no€priorÏcriminal€record€for€the€appellant,€the€trial€court€ordered€œthe›€appellant€to€serve€herÏentire€sentence€on€supervised€probation.€€ÌTennessee€Code€Annotated€section€40„35„313€allows€a€trial€court,€upon€aÏfinding€of€guilt€either€by€plea€or€trial,€to€place€a€defendant€on€probation€without€theÏimposition€of€a€judgment€of€conviction.€€This€is€commonly€referred€to€as€judicialÏdiversion.€€ð ðFollowing€successful€completion€of€probation,€the€underlying€criminalÏcharge€is€dismissed.€€The€granting€of€judicial€diversion€rests€within€the€discretion€ofÏthe€trial€court€.€.€œ.€.ð𛀀òòState€v.€Beverlyóó,€894€S.W.2d€292,€293€(Tenn.€Crim.€App.€1994).€ÏThe€trial€courtððs€discretion€is€ð ðsubject€only€to€the€same€constraints€applicable€toÏprosecutors€in€applying€pretrial€diversion€.€.€.€.ðð€€òòState€v.€Andersonóó,€857€S.W.2d€571,Ï572€(Tenn.€Crim.€App.€1992).€€ÌIn€order€for€this€Court€to€find€that€the€trial€court€abused€its€discretion€inÏrefusing€to€grant€judicial€diversion,€we€must€find€that€there€exists€no€substantialÍevidence€to€support€the€denial€of€judicial€diversion.€€òòCf.óó€òòState€v.€Hammersleyóó,€650ÏS.W.2d€352,€356€(Tenn.€1983)(citing€standard€of€review€for€pretrial€diversion).€€ÌWhen€reviewing€a€request€for€a€judicial€diversion,€the€trial€courts€of€this€stateÏshould€consider€the€same€factors€used€by€district€attorneys€general€whenÏconsidering€pretrial€diversion.€€òòState€v.Bonestelóó,€871€S.W.€2d€163,€168€(Tenn.€Crim.ÏApp.€1993).€€Those€are:ÌÓ` °„XZÀ–XÓÓÓà à1.à àThe€circumstances€of€the€offense;ÌÌà à2.à8 àThe€defendantððs€criminal€record;ÌÌà à3.à8 àThe€defendantððs€social€history;ÌÌà à4.à8 àThe€defendantððs€physical€and€mental€condition;ÌÌà à5.à8 àThe€likelihood€that€diversion€would€serve€the€endsÏof€justice€and€the€best€interest€of€both€the€publicÏand€the€defendant;€andÌÌà à6.à8 àAny€other€factors€tending€to€accurately€reflect€onÏwhether€the€defendant€would€become€a€repeatÏoffender.ÌÌÓÓà àà àòòId.óó;€òòseeóó€òòalsoóó€òòHammersleyóó,€at€355.€€€€ÌThis€Court€has€held€that€a€trial€court€may€not€simply€state€that€it€hasÏconsidered€the€appropriate€factors€for€diversion€but€must€state€the€specific€reasonsÏwhy€the€defendant€is€denied€diversion,€explaining€why€the€factors€applicable€to€theÏdenial€of€diversion€outweigh€the€other€factors€for€consideration.€€òòBonestelóó€at€168.€€ÌWhen€reaching€its€decision€to€deny€diversion€the€trial€court€did€not€place€onÏthe€record€how€it€balanced€the€appropriate€factors€in€this€case.€€œInstead,›€the€courtÏmerely€stated€itððs€reasons€for€denying€diversion.€€The€court€should€have€placed€onÏthe€record€how€it€balanced€the€factors€against€diversion€together€with€those€factorsÏfavoring€diversion.€€However,€our€òòdeóó€òònovoóó€review€of€the€record€leads€us€to€concludeÏthat€there€is€substantial€evidence€supporting€the€trial€courtððs€decision€to€denyÏdiversion€in€this€case.€œ€òòSeeóó›€òòState€v.€Patricia€Haltomóó,€No€01„C„01„9209„CC„00286Ï(Tenn.€Crim.€App.,€at€Nashville,€July€15,€1993)€òòperm.óó€òòtoóó€òòappealóó€òòdeniedóó€(Tenn.€1993).€ÏWhile€we€agree€that€the€appellantððs€lack€of€criminal€history,€stable€social€andÏemployment€history€as€well€as€her€remorse€for€the€offense€all€militate€in€favor€ofÏdiversion,€the€trial€courtððs€finding€that€the€circumstances€of€the€offense€were€such€thatÏdiversion€was€inappropriate€is€supported€by€the€record.€ÌThe€appellant€contends€that€the€trial€judge€denied€diversion€on€the€basis€ofÏthe€nature€of€the€offense€and€œargues›€that€this€is€inappropriate€because€the€legislatureÏhas€deemed€the€instant€offense€as€one€amenable€to€judicial€diversion.€€After€a€carefulÏreview€of€the€comments€of€the€trial€court,€we€are€satisfied€that€the€judge€did€not€denyÏjudicial€diversion€solely€on€the€basis€of€the€nature€of€the€offense.€€Rather,€weÏconclude€that€the€trial€judge€denied€judicial€diversion€in€this€case€because€of€theÏmanner€of€the€commission€of€the€theft.€€The€court€found€that€the€theft€took€place€overÏa€period€of€time€and€was€not€a€single€incident€but€that€the€stolen€card€was€used€onÍfour€different€occasions.€€As€in€òòHaltomóó,€this€fact€demonstrates€that€although€theÏappellant€had€the€ð ðopportunity€to€reflect€on€her€actions€.€.€.€[she]€elected€to€continueÏthe€course€of€action€she€had€chosen.ðð€€òòId.óó€€€The€trial€court€also€gave€significance€toÏthe€fact€that€the€appellant€forged€the€signatures€of€her€co„employees€in€an€attempt€toÏkeep€from€getting€caught.€€Because€there€was€substantial€evidence€upon€which€theÏtrial€court€denied€diversion,€the€judgment€of€the€trial€court€is€affirmed.€ÌÌÌÓÓÌ€à
