àOn€September€29,€1994,€the€defendant€resided€in€a€trailer€locatedÏupon€property€owned€by€his€sister,€Teresa€McCord,€who€is€listed€in€the€indictmentÏas€the€victim€of€the€alleged€offense.€€The€defendant,€now€32€years€of€age,€is€theÏcustodian€of€his€two€minor€children;€at€the€time€of€the€charges,€he€shared€hisÏresidence€with€his€mother.€€œThe›€defendant€had€been€employed€for€the€last€severalÏyears€in€security€at€the€Baptist€Hospital€in€Nashville.€€Although€not€a€high€schoolÏgraduate,€he€has€an€employment€history€that€includes€work€as€a€dispatcher€in€theÏFairview€Police€Department€and€work€in€traffic€control€in€Nashville.€€The€defendantÏis€licensed€to€carry€a€firearm.€€He€has€no€prior€criminal€record.ÌÌà àAn€altercation€occurred€after€the€victim,€who€lived€next€door,€swore€outÏan€unlawful€detainer€warrant€against€the€defendant.€€After€being€notified€of€theÏaction€by€local€authorities,€the€defendant€had€one€or€more€telephone€conversationsÏwith€the€victim€about€how€long€he€could€maintain€his€trailer€on€her€property.€€€€ÌÌà àà àLater,€the€defendant€and€the€victim€argued.€€While€the€facts€areÏcontested,€the€victim€claimed€that€the€defendant€attacked€her€in€her€own€front€yard,Ïstruck€her€in€the€face,€and€punched€his€finger€into€her€eyes€until€she€was€helpless.€ÏThe€victim,€who€suffered€serious€injuries€to€her€eyes,€was€hospitalized.€ÏPhotographs€in€the€record€substantiate€the€severity€of€her€injuries.€€The€defendantÍclaimed€that€the€victim€initiated€the€altercation.€€He€asserted€that€his€sister€grabbedÏhim€by€the€throat,€cutting€off€his€air€supply,€and€that€he€panicked,€swinging€wildly,Ïuntil€she€released€her€hold.€€ÌÌà àà àThe€district€attorney€general€denied€diversion€due€to€the€violentÏnature€of€the€assault.€€It€was€his€opinion€that€the€defendant€had€been€untruthful€andÏhad€not€offered€restitution€or€otherwise€accepted€responsibility€for€his€act.€€WhileÏacknowledging€that€the€defendant€had€a€positive€social€history€and€no€prior€record,Ïthe€district€attorney€general€denied€the€application€after€weighing€allÏconsiderations,€including€the€serious€injuries€to€the€victim€and€the€need€to€deter€theÏcommission€of€violent€offenses.€€ÌÌà àà àAs€indicated,€the€nature€and€circumstances€of€the€offense€may€be€anÏappropriate€basis€for€the€denial€of€pretrial€diversion.€€The€severity€of€the€injuries€to€aÏvictim€is€a€factor.€€That€the€defendant,€a€security€officer,€had€a€background€in€lawÏenforcement€and€had€been€licensed€to€carry€a€weapon€is€also€a€source€ofÏlegitimate€concern.€€Moreover,€any€failure€on€his€part€to€accept€responsibility€for€hisÏactions,€either€through€an€offer€to€pay€medical€expenses€or€otherwise,€reflects€uponÏhis€amenability€for€rehabilitation.€€Under€all€of€these€circumstances,€this€courtÏcannot€say€that€the€district€attorney€abused€his€discretion.€€While€judicial€diversionÍmay€be€a€consideration,€the€district€attorney€general€clearly€acted€within€hisÏdiscretionary€authority€by€denying€this€application.€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„35„313.€€ÌÌÓÓà
