Whileitislikelythatthetrialjudgewasawareofothersentencingalternatives,thisstatementleadsmetoconcludethattheseweretheonlytwoϜoptions consideredbythecourt.Obviously,this allornothingapproachtothemannerinwhichsentencesmaybeserveddisregardsawidearrayofsentencingoptions,includingsplitconfinement,whichareavailableforconsideration.Tenn.CodeAnn.4035104(c);seeStatev.BarbaraD.Frank,C.C.A.No.03C019209CR00303,BlountCounty(Tenn.Crim.App.,Knoxville,Dec.22,1993).Also,IdonotbelievethatthetrialjudgeproperlyconsideredtheenhancementfactorsandotherrelevantfactsandcircumstancesapplicabletotheDefendantssentence.Thejudgestatedthat beyondtheseincidentsinvolvingthesesmallchildren,theDefendantsrecordwas exemplary.TheDefendantsadmittedlengthyinvolvementwithmarijuanaandotherfactorsinhisbackgrounddonotdemonstratean exemplaryrecord.Inshort,fromthisrecord,Icannotaffordthissentencethepresumptionofcorrectnessandtherefore,Ibelieveitismydutytoreviewthissentencedenovo. BecausetheDefendantwasconvictedofaClassBfelony,hedoesnotenjoyapresumptionthatheisafavorablecandidateforalternativesentencingoptions.SeeTenn.CodeAnn.4035102(6).IbelievethattherecordsupportstheexistenceofthreeenhancementfactorsapplicabletotheDefendantssentence:(1)TheDefendanthasaprevioushistoryofcriminalconvictionsorcriminalbehaviorinadditiontothosenecessarytoestablishtheappropriaterange,(2)avictimoftheoffensewasparticularlyvulnerablebecauseofage,and(3)theDefendantabusedapositionofprivatetrust.Tenn.CodeAnn.4035114(1),(4)and(15).TherearesomepositivefactorsintheDefendantshistoryandbackgroundwhichmightbeconsideredinmitigation.Tenn.CodeAnn.4035113(13). Theinjuriesinflicteduponthetenmontholdvictimwereserious.Asthetrialjudgestated, Onethingiscrystalclearinthiscase,andthatisthatsomebodybeatthehelloutof[thevictim].AlthoughtheDefendantdeniedanyresponsibilityforthecrime,thejurydidnotbelievehimandresolvedtheissuebyϜfindinghimguilty.Asnotedbymycolleagues,thisrecordwouldeasilysupportadenialofprobation.Ibelievethiscasecallsforasentenceofincarceration.Therefore,Irespectfullydissent.     ___________________________________     DAVIDH.WELLES,JUDGE
