Thedefendantsoriginalconvictionbecamefinalafterhisdirectappeal.SeeStatev.Hicks,835S.W.2d32(Tenn.Crim.App.1992),app.󛀜denied(June8,1992).HefiledapetitionforwritofhabeascorpusonMay26,1995,thatwastreatedasoneforpostconvictionrelief.ThetrialcourtdismissedthepetitioninFebruary1996withoutahearing,ortheappointmentofcounselonthebasisthateachclaimforreliefhadbeenpreviouslydeterminedinthedirectappeal. )   ׀ OnApril2,1996,thepetitionerfiledtheinstantmotiontoreopeninwhichheallegedthatthejuryinstructionrelatingtoreasonabledoubtwasunconstitutional.However,hedoesnotexplainwhyhedidnotbringthissameclaiminhisformercase.Thisconstitutesawaiver.SeeT.C.A.4030202(e)(Supp.1996).Inanyevent,hissubstantivecomplaintiswithoutmerit.Hecomplainsthatthereasonabledoubtinstructioninhiscaseincludedtheterm moralcertaintyinsuchawayastoviolatedueprocess,aconclusionreachedbythefederaldistrictcourtinRickman.However,theinstructionusedinthepetitionerscaseisessentiallythesameoneheldtobeproperbyoursupremecourtandthiscourt.SeeStatev.Nichols,877S.W.2d722,734(Tenn.1994);Pettyjohnv.State,885S.W.2d364,36566(Tenn.Crim.App.1994).
