XO PROCEDURALHISTORY  `X  XPursuanttoapleaagreementonJuly2,1998,thedefendantenteredaguiltypleatotwocountsofaggravatedsexualbatteryandreceivedtwotenyearsentencestobeservedconcurrently.Inthedefendantspetitionforacceptanceofthisplea,thedefendantspecificallywaivedhisrighttoappealanynonjurisdictionaldefects.Thetrialcourtsentencedthedefendantonthedatethepleawasentered. XAnalysis  3,0 i Xu XUntimelyFilingofMotiontoWithdrawGuiltyPlea l5d.2  XThewithdrawalofaguiltypleaisspecificallycontrolledbyTenn.R.Crim.P.32(f),whichprovides: 926 Ї 41 X WithdrawalofPleaofGuilty.Amotiontowithdrawapleaofguiltymaybemadeuponashowingbythedefendantofanyfairandjustreasononlybeforesentenceisimposed;buttocorrectmanifestinjustice,thecourtaftersentence,butbeforethejudgmentbecomesfinal,maysetasidethejudgmentofconvictionandpermitthedefendanttowithdrawtheplea. X4  l d Thus,whiletheTennesseeruleprovidesforbothwithdrawalpriortosentencingandwithdrawalaftersentencingbutbeforefinaljudgment,itdoesnotauthorizewithdrawalafterfinaljudgment.SeeStatev.Hall,983S.W.2d710,   711(Tenn.Crim.App.1998). Inthiscase,whenthedefendantpledguiltyandwaivedhisrighttoappeal,thejudgmentbecamefinalthatsamedaywhenhissentencewasimposed.Seeid.at711;Passarellav.State,891S.W.2d619,624(Tenn.  Crim.App.1994);Warrenv.State,833S.W.2d101,102(Tenn.Crim.App.  1992);seealsoLakeithO.Lightfootv.State,No.02C019703CR00129(Tenn. d\ Crim.App.filedFebruary18,1998,atJackson).Further,wenotethatgenerallynorightofappealexistsfromaguiltypleaenteredpursuanttoapleaagreement,seeTenn.R.Crim.P.37(b),andthattheexceptionssetforthinTenn.R.Crim. #  P.37(b)(2)(I)(iv)areinapplicableinthiscase.Therefore,thepleaofguilty,waiverofappealandsentence,allenteredJuly2,1998,madejudgmentfinalthatday.SeeHall,983S.W.2dat711.Forthisreason,weconcludethatthe ,)$"& defendantsmotiontowithdrawhisguiltypleawasuntimely. ,%*  X  ManifestInjustice .', p XbReviewingthemeritsofthedefendantsmotiontowithdraw,welikewiseaffirmthetrialcourtsdenial.Thedecisiontograntamotiontowithdrawrestsinthesounddiscretionofthetrialcourtandisthereforenotsubjecttoreversalabsentaclearabuseofdiscretion.SeeStatev.Drake,720S.W.2d798,799 5.4 (Tenn.Crim.App.1986).Applyingthisstandard,wefindthatthedefendanthasfailedtomethisburdenofestablishingthatthepleaofguiltyshouldbe \9T28 withdrawntoprevent manifestinjustice,seeStatev.Turner,919S.W.2d346,  355(Tenn.Crim.App.1995),andthatthetrialcourtdidnotabuseitsdiscretion.
