Opinion   TheStateofTennesseeappealsasofrighttheDavidsonCountyCriminalCourtsdismissaloftheAppelleesindictmentsforpossessionofcocainewithintenttosellordeliver.ThetrialcourtfoundthattheAppelleesprotectionagainstformerjeopardyhadbeenviolatedinthattheAppelleeshadalreadybeenpunishedfortheircrimesbytheStatesseizureoftwovehiclesusedinthedrugsale.TheStatearguesonappealthatthecivilforfeitureoftheAppelleesvehiclesdoesnotamounttopunishmentpursuanttothedoublejeopardyclausesoftheUnitedStatesandtheTennesseeConstitutions.Weagreeandreversethetrialcourt. OnMay23,1994,undercoverofficersbought$9,000.00worthofcocainefromtheAppelleesandoneotherperson.ItisundisputedthattheAppelleesusedone1978CadillacbelongingtoAppelleeWatersandone1984FordProbebelongingtoAppelleeLeetofacilitatethedrugsale.ThefollowingdaytheStatefiledanoticeofseizureforthetwovehicleswiththeTennesseeDepartmentofSafety,pursuanttoTennesseeCodeAnnotated,section5311201.Tenn.CodeAnn.5311201(Supp.1996). OnMay16,1995,theAppelleeswereindictedforpossessionofcocainewithintenttosellordeliver.InJuneandJulytheAppelleesfiledmotionstodismisstheindictmentsondoublejeopardygroundsallegingthatcriminalprosecutionwouldamounttodoublejeopardysincetheyhadalreadybeenpunishedbythecivilforfeiture. 1   כAfterahearing,theDavidsonCountyCriminalCourtgrantedbothmotionsanddismissedtheindictments.TheStatenowappeals.   TheStatearguesthatcivilforfeiturefollowedbycriminalprosecutioninconnectionwiththesamecriminalactivitydoesnotplacetheAppelleesindoublejeopardy.TheStateiscorrect.
