Inhisprosepetition,thepetitionerassertsthatheisbeingillegallyrestrainedofhislibertybecausethejudgmentordersforhisconvictionsstatethathewouldbeeligibleforreleasestatusuponservingthirtypercentofhissentences.Heclaimsthatheenteredtheguiltypleasbaseduponhisunderstandingthathewouldbereleasedaftertheserviceofthirtypercentofhissentences.Hecontendsthatheshouldbereleasedbecausehehasfullycompliedwiththecriteriaofhispleaagreement. Althoughthepleaagreementisnotincludedintherecord,weconcludethatthepetitionerisnotentitledtohabeascorpusrelief.Challengesregardingtheinvoluntarinessofaguiltypleadonotprovideabasisforhabeascorpusreliefbecausethejudgmentismerelyvoidable.HabeascorpusrelieffromacriminalcaseincarcerationisonlyavailableinTennesseewhenapetitionersconvictionisvoidorϜthesentencehasexpired.SeeArcherv.State,851S.W.2d157,164(Tenn.1993).Moreover,paroleisaprivilegeandnotaright.T.C.A.4028117(a);T.C.A.4035503(b).Theauthoritytograntparoleisvestedexclusivelyintheboardofpardonsandparole,andthegrantingofparoleisadiscretionarymatter.Doylev.Hampton,207Tenn.399,340S.W.2d891,893(1960).Aprisonerdoesnothaveanabsoluterighttobereleasedonparolewhenhehasservedtheminimumtermforhisconviction.Stateexrel.Wadev.Norvell,1Tenn.Crim.App.447,443S.W.2d839,84041(1969). Habeascorpusreliefisnotavailabletochallengethedenialofprisonprivilegesandrelatedinternalmattersofourcorrectionalinstitutionsthathavenobearingonthevalidityoftherestrainingconviction,theresultingsentence,ortheexpirationofthesentence.See,e.g.,Statev.Warren,740S.W.2d427,428(Tenn.Crim.App.1986).TheappropriatemethodtochallengetheDepartmentofCorrectionsfailuretocalculatesentencingcreditsandparoledatesistheAdministrativeProceduresAct.SeeT.C.A.45101325(1991andSupp.1996);Brighamv.Lack,755S.W.2d469,471(Tenn.Crim.App.1988).Whenitisclearfromthepetitionthatthepetitionerisnotentitledtorelief,thetrialcourtisnotrequiredtoconductanevidentiaryhearingorappointcounseltorepresentthepetitioner.SeePassarellav.State,891S.W.2d619,627(Tenn.Crim.App.1994). Inthiscase,thepetitionerclaimsthathehasservedhissentencesandisentitledtoimmediatereleasebecausehehasservedtherequisitepercentageoftimeforreleaseeligibility.However,releaseeligibilitydoesnotamounttoanentitlementtoimmediaterelease.
