TheappellantwasindictedwithtwocodefendantsformurderingandconspiringtomurderFrankMiles(victim).Thevictimwasstabbedsixtimes,cutonce,shotseventimes,andrunoverbyacar.Afterthevictim'sdeath,theappellantgaveastatementinwhichheacceptedresponsibilityforshootingthevictim.Attrial,however,theappellantprofessedinnocenceandclaimedthathisearlierstatementwasafabrication. Thevictim'swife,AndreaMiles,wasoneoftheappellant'scodefendants.Priortotrial,shewasorderedtoMemphisMentalHealthInstitute(MMHI)foranevaluationastohercompetencytostandtrial.Duringthiscompetencyevaluation,shemadeastatementabouttheincidenttoastaffpsychologist.Herstatementwasparaphrasedandplacedinherevaluationasfollows:8 OnAugust5,1992,[thevictim]kicked[her]inherbackandherhead,callinghernamesandtellingherthathewasgoingtoparalyzeherforgood.Hehadbeendrinkingand[she]believesthathewasalsousingcocaine.Shetookseveralknivesfromthekitchenandwentintotheirbedroom.Mr.Milesfollowedherandcontinuedtobeverballyabusive.Shehithiminthechestwithasteakknife,andhefellacrossthebedandreachedforhisgun.Shethenstabbedathisface.Hejumpedupandsaidtoher,"IfIdon'tdie,I'mgoingtokillyou."Shetookthegunawayfromhimandbeganfiringshotsathim.Heranoutthefrontdoorandfelldowninthedriveway. Attrial,Ms.Milesinvokedherfifthamendmentprivilege.Theappellantthensoughttointroduceherstatementviatestimonyofherpsychologist.Theappellantarguedthatthestatementwasadmissibleas:(1)astatementagainstpenalinterest,Tenn.R.Evid.,Rule804(b)(3),and(2)astatementforpurposesofmedicaldiagnosisandtreatment,Tenn.R.Evid.,Rule803(4). ThetrialjudgerefusedtoallowthepsychologisttotestifyastoMs.Miles'statement.Thetrialjudgeheldthatthestatementwashearsayanddidnotfallwithinarecognizedexception.Inaddressingthe804(b)(3)exception,thetrialjudgefoundthatwhentakenincontextwithallofMs.Miles'priorstatements,thestatementwasselfservingandsupportedaselfdefenseposture.He,therefore,concludedthatthestatementwasnotagainstherpenalinterest.Astothe803(4)exception,thetrialjudgefoundthattheexceptiondidnotextendtostatementsmadetopsychologists. Thedecisionastowhetherthestatementwascredibleandadmissiblewaswithinthetrialcourt'sdiscretion.The803(4)exceptiondoesnotapplytoastatementmadefordiagnosisortreatmentofmentalandemotionalmaladies.Statev.Barone,852S.W.2d216(Tenn.1993).WhethertheevidencecanbeaccuratelycategorizedasastatementagainstMs.Miles'penalinterestisdebatableatmost.Accordingly,thestatementdoesnotfallwithineitheroftheprofferedexceptions.Thejudgeruledwithinhissounddiscretion.
