Atthepostconvictionhearing,theappellant'strialcounseltestifiedthatshefiledmotionsfordiscovery,investigatedthechargesagainstherclient,andinterviewedpotentialwitnesses.Moreover,counseltestifiedthatshereviewedwiththeappellanttheimplicationsofwaivinghisrighttoajurytrial,includinghisrightthathecouldnotbecompelledtoincriminatehimself.Trialcounseldeniedmakinganypromisetotheappellantconcerningthelengthoftimehewouldserve.ThetranscriptoftheDecember17,1991,guiltypleahearingreflectsthattheappellantwasspecificallyadvisedbythetrialjudgeofhisrightagainstselfincrimination.TheStateconcedes,however,thatthetranscriptoftheJanuary10,1992,pleahearingdoesnotindicatethattheappellant,onthatoccasion,wasadvisedofhisrightagainstselfincriminationbythetrialjudge. Indenyingrelief,thepostconvictioncourtaccreditedthetestimonyoftheappellant'strialcounselandconcludedthat"atthetimethe[appellant]enteredhisguiltypleaheunderstoodhisrightagainstselfincriminationandheenteredhisguiltypleafreelyandvoluntarily."Thecourtfurtherfoundthattrialcounsel"appropriatelyinvestigatedthecase"anddidnotmisinformtheappellantastohisperiodofincarceration. Whenthiscourtundertakesreviewofalowercourt'sdecisiononapetitionforpostconvictionrelief,thelowercourt'sfindingsoffactaregiventheweightofajuryverdictandareconclusiveonappealabsentafindingthattheevidencepreponderatesagainstthejudgment.Clennyv.State,576S.W.2d12,14(Tenn.Crim.App.1978),cert.denied,441U.S.947,99S.Ct.2170(1979).AlthoughtherecordreflectsthattheappellantwasnotadvisedofhisrightagainstselfincriminationattheJanuary10,1992,guiltypleahearing,therecordisclearthattheappellantwasinformedofandhadacknowledgedthissamerighttwentyfourdaysearlier.Moreover,theproofestablishesthattrialcounselexplainedtotheappellanthisrightagainstselfincriminationinadditiontootherconstitutionalrightshewasrelinquishingbyenteringapleaofguilty.InJohnsonv.State,834S.W.2d922,924(Tenn.1992),oursupremecourtreiteratedtheprincipalthat"forapleatobeknowingandintelligenttheaccusedmusthavecertainknowledgeregarding...the[constitutional]protectionsaffordedtheaccused."Thecourtdistinguishedthefactthatadefendantmaybeawareofhisconstitutionalrightseventhoughnotadvisedthereon.Id.at925.Additionally,ifanallegationthatthedefendantwasnotadvisedofhisrightagainstselfincriminationissupportedbytheevidence,theburdenofprovingaknowingpleashiftstotheState.Id.However,"itdoesnot,ipsofacto,entitlethe[defendant]torelief."Id.TheStatemayrebuttheallegationwithproofthat"the[defendant]wasawareofhisconstitutionalrightsandthatthereforethetrialcourt'sfailuretogivethemandatedadvicewasharmlesserror."Id.If,asinthecaseatbar,therecordshowsbyclearandconvincingevidencethatthepleawasknowingandvoluntary,thentheappellantisnotentitledtorelief.Id.Therecordindicatesthattheappellantunderstoodhisrightagainstselfincriminationandthathisguiltypleaswereenteredknowinglyandvoluntarily.Afterreviewingtherecord,wecannotconcludethattheevidencepreponderatesagainstthepostconvictioncourt'sfindings.Accordingly,wefindnoerroroflawmandatingreversalofthecourt'sjudgment.Thepostconvictioncourt'sdenialoftheappellant'spetitionforpostconvictionreliefisaffirmed.     ____________________________________     DAVIDG.HAYES,JudgeCONCUR:________________________________JOSEPHM.TIPTON,Judge________________________________WILLIAMM.BARKER,Judge
