Nashville,TN372430493           TOMP.THOMPSON        DistrictAttorneyGeneral       111CherrySt.       Lebanon,TN37087                          OPINIONFILED:____________________ REVERSEDANDREMANDED JOHNH.PEAY, Judge  @ OPINION     Thepetitionerwasindicted,inasingleindictment,forsixseparatecountsofaggravatedsexualbattery.Heenteredaguiltypleatocountone,andaspartofthepleaagreementtheremainingcountswerenollied.Thepetitionerfiledapetitionrequestingexpungementofthepublicrecordsinconnectionwiththedismissedcounts.Thispetitionwasdeniedbythetrialcourtwithoutahearing.  Inthisappealasofright,thepetitionercontendsthatheisentitled,bystatute,tohavethepublicrecordsexpungedastothefivecountsoftheindictmentthatweredismissed.Fromourreviewoftherecord,theapplicablestatute,andcaselaw,weagreewiththepetitionerandreversethejudgmentofthetrialcourt.  Thetrialcourt,inrulingonthepetition,foundthatthepetitionerwasnotentitledtoexpungementofthepublicrecords.Thisrulingappearstobebasedonthefactthatthepetitionerhadpledguiltytocountoneofamulticountindictment.TheStatecontendsthatbecausethenolliedcountsare inextricablyintertwinedwiththecounttowhichthe[petitioner]pledguilty,destructionoftherecordsisimpossible.ToaccepttheStatesargumentistoallowthedistrictattorneygeneraltocontroladefendantsrighttoexpungementbyindictingonmultiplechargesbyseparatecountsinasingleindictment.  Ourstatuteprovidesthatuponpetitioninthecourtwhereanolleprosequiisentered,allpublicrecordsshallbeexpunged.T.C.A.4032101(a)(3).ThisCourthaspreviouslyheldthatadefendantisentitledtoexpungementandthetrialjudgeiswithoutdiscretionindenyingthispetition.SeeStatev.McCary,815S.W.2d220,222(Tenn.Crim.App.1991).Theexpungementstatutesimplyprovidesthatwhena chargehasbeendismissed...[it]shall,uponpetition...beremovedanddestroyed.T.C.A.4032101(a)(1).Wefindnoindicationthatthisappliesonlytoindictments.Itexpresslyappliesto charges.Here,five chargeswerenollied.
