àThis€case€is€here€by€appeal€as€of€right€pursuant€to€Rule€3€of€theÏTennessee€Rules€of€Appellate€Procedure.€€In€the€original€prosecution,€theÏpetitioner€was€convicted€by€jury€of€first€degree€murder.€€His€conviction€wasÏupheld€by€this€Court€on€direct€appeal.€€òòSeeóó€òòState€v.€Scottie€Dewayne€Light€andÏJohnny€Wardóó,€C.C.A.€No.€01C01„9110„CR„00297,€Davidson€County€(Tenn.ÏCrim.€App.,€Nashville,€filed€Jan.€21,€1993).€€The€petitioner€sought€post„convictionÏrelief,€alleging€that€he€was€denied€effective€assistance€of€counsel€at€trial.€€AfterÏconducting€an€evidentiary€hearing,€the€trial€court€denied€the€petition.€€In€thisÏappeal,€the€petitioner€contends€that€the€trial€court€erred€in€denying€the€petition.€ÏWe€find€no€merit€to€the€issue€raised,€and€therefore,€we€affirm€the€judgment€of€theÏtrial€court.ÌÌà àWe€begin€with€a€summary€of€the€facts€as€stated€in€this€Courtððs€opinionÏfrom€the€direct€appeal× ƒ+ ××  ×:ÌÓÓà8 àà àOn€June€23,€1990,€the€Godwin€family€was€having€aÏbirthday€party€at€Michael€Godwinððs€home€at€5000€DelawareÏAvenue€in€Nashville.€€Mr.€Light€was€œmad›€at€Al€Godwin€becauseÏhe€had€impregnated€Mr.€Lightððs€sister,€Toby€Ward,€and€had€thenÏended€his€relationship€with€her.€€For€several€days€the€GodwinsÍhad€been€receiving€threatening€telephone€calls€from€Mr.€Light.€€InÏaddition,€he€drove€his€pickup€truck€up€and€down€the€street€andÏscreeched€his€tires€in€front€of€their€house.€€ÌÌà8 àà àOn€that€night,€Mr.€Light€placed€thirteen€harassing,€threateningÏand€obscene€telephone€calls€to€the€Mitchell€Godwin€residenceÏbetween€8:26€and€8:44.€€Mr.€Light€threatened€family€members€andÏchallenged€them€to€meet€him€at€McCabe€Park€located€less€than€aÏmile€from€the€Godwin€home.ÌÌà8 àà àJames€A.€Chenowith,€who€was€married€to€one€of€theÏGodwin€daughters,€answered€the€last€call€and€agreed€to€meet€Mr.ÏLight€at€the€park,€although€he€had€no€intention€of€actually€going€toÏthe€park.ÌÌà8 àà àAt€approximately€9:00€p.m.,€Mr.€Light€drove€past€the€GodwinÏhouse€in€an€eastern€direction€in€his€pickup€truck.€€He€then€turnedÏaround,€came€back€down€the€street€and€stopped€in€front€of€theÏGodwin€home,€with€the€passenger€side€of€the€truck€facing€the€frontÏyard€of€the€house.€€Mitchell€Godwin€went€to€the€truck€and€spoke€toÏthe€passenger,€Mr.€Ward.€€He€leaned€into€the€truck€and€he€and€Mr.ÏWard€talked€face€to€face.€€Mr.€Light€got€out€of€the€truck,€leveled€aÏshotgun€across€the€bed€of€his€truck€and€shot€Al€Godwin€in€theÏabdomen.€€They€hurriedly€drove€away.€€The€police€andÏparamedics€were€called€and€Mr.€Godwin€was€taken€to€the€hospitalÏwhere€he€was€pronounced€dead.ÌÌà8 àà àApproximately€an€hour€later€the€appellant€was€arrested€atÏhis€home€and€taken€to€police€headquarters€where€he€confessed€toÏshooting€the€shotgun€into€the€crowd€of€people€in€the€Godwin€yard.€ÏHe€contended€that€they€came€out€into€the€road€and€blocked€theÏpath€of€his€truck.€€He€had€to€stop€to€avoid€hitting€the€people.€€HeÏdenied€that€he€intended€to€kill€the€victim,€contending€that€ð ðit€justÏhappened.ðð€€He€vigorously€denied€that€his€brother,€Mr.€Ward€wasÏwith€him€in€the€truck,€contending€that€he€acted€alone€throughout.€ÏOther€witnesses€testified€that€they€saw€another€gun€sticking€out€theÏwindow€on€the€passenger€side€pointed€at€Mitchell€Godwin,Ïalthough€Mr.€Godwin€testified€that€he€saw€no€gun.ÌÌà8 àà àMr.€Light€presented€the€testimony€of€various€witnesses€whoÏwere€present€at€the€scene€to€show€that€Mr.€Light€was€provoked.€ÍSpecifically€there€was€testimony€that€Mr.€Chenowith€threw€a€rockÏat€the€truck,€but€there€was€no€allegation€that€Mr.€Light€shot€in€selfÏdefense.€€Mr.€Chenowith€admitted€that€he€was€so€provoked€thatÏhe€picked€up€a€rock€and€threw€it€at€the€truck.€€Mr.€Ward€presentedÏthe€testimony€of€a€police€officer,€who€found€a€fresh€dent€in€theÏmiddle€of€the€hood€of€the€truck,€further€establishing€that€there€wasÏsome€provocation€by€those€present.€€A€broken€baseball€bat€wasÏalso€found€in€the€yard.ÌÌÌÓÓà àBased€on€the€above€facts,€the€petitioner€was€convicted€of€first€degreeÏmurder.€€The€petitioner€now€contends€that€his€trial€counsel,€Justin€Johnson,€wasÏineffective€for€failing€to€strike€a€juror€who€allegedly€lived€down€the€street€fromÏrelatives€of€the€victim,€for€failing€to€call€certain€witnesses€at€trial,€and€for€failing€toÏinvestigate€his€mental€history€thoroughly.€€The€petitioner€argues€that€hadÏJohnson€effectively€pursued€these€courses€of€action,€he€would€have€beenÏconvicted€of€a€lesser€degree€of€homicide.ÌÌà àAt€the€hearing€on€the€post„conviction€petition,€the€petitioner€testified€that€heÏhad€asked€Johnson€to€strike€a€juror€œwhom›€he€knew€lived€down€the€street€fromÏrelatives€of€the€victim.€€According€to€the€petitioner,€Johnson€ignored€the€request.€ÏThe€petitioner€testified€further€that€he€had€informed€Johnson€that€multipleÏinstitutions€had€records€pertaining€to€his€mental€and€emotional€history,€butÏJohnson€never€procured€these€records.€€He€also€asked€Johnson€to€telephoneÏConnie€Gwin,€a€former€teacher€of€the€petitioner€who€knew€a€great€deal€aboutÏhis€mental€condition,€but€Johnson€did€not€do€so.ÌÌà àConnie€Gwin€testified€at€the€post„conviction€hearing€that€she€had€beenÏthe€petitionerððs€special€needs€teacher€during€fifth€and€sixth€grades.€€She€hasÏmaintained€contact€with€the€petitioner€since€that€time€and€received€a€call€from€himÏafter€his€arrest€for€the€offense€in€the€present€case€but€before€trial.€€Gwin€statedÏthat€the€petitioner€had€demonstrated€a€volatile€temper€as€a€student€whichÏcaused€him€to€go€into€a€ð ðstateðð€in€which€he€could€not€control€his€violent€actions.€ÏShe€also€stated€that€she€would€have€given€similar€testimony€at€trial.€€On€cross„examination,€Gwin€admitted€that€she€had€made€no€efforts€to€contact€theÏpetitionerððs€attorney.€€Gwin€also€admitted€that€the€petitionerððs€behavior€during€hisÏð ðstatesðð€was€sometimes€calculated€to€achieve€a€desired€result.ÌÌà àLoretta€Light,€the€petitionerððs€mother,€testified€at€the€post„conviction€hearingÏthat€she€had€asked€Johnson€to€investigate€records€concerning€the€petitionerððsÏmental€condition€located€at€Cumberland€Hall€and€the€Koala€Center,€twoÏinstitutions€devoted€to€treating€troubled€students.€€She€also€asked€Johnson€toÏhave€a€mental€evaluation€performed€on€the€petitioner.€€According€to€Light,€both€ofÏthese€requests€were€ignored.€€In€addition,€Johnson€told€Light€that€he€intended€toÏcall€her€as€a€witness€at€trial,€but€he€never€did€so.€€She€would€have€testifiedÏregarding€the€petitionerððs€mental€condition€prior€to€the€offense,€specifically€that€heÏwas€not€angry€with€the€victim.ÌÌà àJustin€Johnson,€the€petitionerððs€trial€attorney,€testified€that€he€did€not€recallÏany€insistence€by€the€petitioner€to€strike€a€juror€based€on€where€he€or€she€lived.€ÏJohnson€stated€that€he€had,€in€fact,€driven€out€to€the€victimððs€neighborhood€inÏorder€to€familiarize€himself€with€the€area€for€the€purposes€of€jury€selection.€€HeÏalso€asked€several€questions€of€the€potential€jurors€that€would€have€revealedÏany€prejudice.€€Johnson€testified€further€that€the€petitionerððs€parents€had€madeÏhim€aware€of€the€mental€and€emotional€history€of€the€petitioner€and€had€givenÏhim€some€records€regarding€that€history.€€As€a€result,€he€informed€the€DedeÏWallace€Center€of€the€petitionerððs€history€and€requested€an€evaluation€toÏdetermine€the€petitionerððs€competency€to€stand€trial€and€his€mental€condition€atÏthe€time€of€the€offense.€€According€to€Johnson,€the€petitioner€never€suggestedÏthat€he€contact€Connie€Gwin.€€Johnson€stated€that€the€defense€strategy€at€trialÏwas€to€avoid€a€first€degree€murder€conviction€by€challenging€the€Stateððs€proof€onÏthe€petitionerððs€mental€state.€€To€that€end,€Johnson€elicited€testimony€from€evenÏthe€Stateððs€witnesses€that€the€petitioner€was€a€ð ðhot€headðð€who€simply€losesÏcontrol€if€he€ð ðblows€up.ððÌÌà àAt€the€conclusion€of€the€hearing,€the€trial€court€ruled€that€JohnsonððsÏperformance€at€trial€was€not€constitutionally€deficient.€€With€regard€to€the€juryÏselection€issue,€the€trial€court€specifically€accredited€Johnsonððs€testimony€that€heÍwas€not€aware€of€the€presence€of€any€juror€prejudiced€against€the€petitioner.€€InÏaddition,€the€trial€court€found€that€Johnson€was€aware€of€the€petitionerððs€mentalÏhistory€ð ðand€had€him€evaluated€with€the€only€resources€that€really€wereÏavailable.ðð€€Furthermore,€the€trial€court€stated€that€the€testimony€of€Connie€GwinÏand€Loretta€Light€would€have€added€nothing€beyond€the€testimony€garneredÏfrom€the€Stateððs€witnesses.€€As€a€result,€the€trial€court€denied€the€petition,€statingÏthat€Johnson€ð ðdid€not€just€an€adequate€job,€but,€a€„„€a€very€good€job€ofÏrepresenting€a€defendant€in€a€case€where€it€was€quite€clear€that€he€was€œguilty.ðð›à àœÌÌà àIn›€determining€whether€counsel€provided€effective€assistance€at€trial,€theÏcourt€must€decide€whether€counselððs€performance€was€within€the€range€ofÏcompetence€demanded€of€attorneys€in€criminal€cases.€€òòBaxter€v.€Roseóó,€523ÏS.W.2d€930,€936€(Tenn.€1975).€€To€succeed€on€a€claim€that€his€counsel€wasÏineffective€at€trial,€a€petitioner€bears€the€burden€of€showing€that€his€counselÏmade€errors€so€serious€that€he€was€not€functioning€as€counsel€as€guaranteedÏunder€the€Sixth€Amendment€and€that€the€deficient€representation€prejudiced€theÏpetitioner€resulting€in€a€failure€to€produce€a€reliable€result.€€òòStrickland€v.ÏWashingtonóó,€466€U.S.€668,€687,€òòrehððgóó€òòdeniedóó,€467€U.S.€1267€(1984);€òòCooper€v.ÏStateóó,€849€S.W.2d€744,€747€(Tenn.€1993);€òòButler€v.€Stateóó,€789€S.W.2d€898,€899Ï(Tenn.€1990).€€To€satisfy€the€second€prong€the€petitioner€must€show€aÏreasonable€probability€that,€but€for€counselððs€unreasonable€error,€the€fact€finderÍwould€have€had€reasonable€doubt€regarding€petitionerððs€guilt.€€òòStricklandóó,€466ÏU.S.€at€695.€€This€reasonable€probability€must€be€ð ðsufficient€to€undermineÏconfidence€in€the€outcome.ðð€€òòHarris€v.€Stateóó,€875€S.W.2d€662,€665€(Tenn.€1994).ÌÌà àWhen€reviewing€trial€counselððs€actions,€this€court€should€not€use€theÏbenefit€of€hindsight€to€second„guess€trial€strategy€and€criticize€counselððs€tactics.€ÏòòHellard€v.€Stateóó,€629€S.W.2d€4,€9€(Tenn.€1982).€€Counselððs€alleged€errors€shouldÏbe€judged€at€the€time€they€were€made€in€light€of€all€facts€and€circumstances.€ÏòòStricklandóó,€466€U.S.€at€690;€òòseeóó€òòCooperóó€849€S.W.2d€at€746.ÌÌà àAfter€reviewing€the€record,€we€find€that€the€trial€court€did€not€err€in€denyingÏthe€petition.€€Although€the€petitioner€testified€that€he€had€asked€Johnson€to€strikeÏa€juror€who€allegedly€lived€down€the€street€from€relatives€of€the€victim,€the€trialÏcourt€did€not€find€this€testimony€to€be€persuasive.€€Instead,€the€trial€court€foundÏJohnsonððs€testimony€to€be€credible.€€There€is€evidence€in€the€record€to€supportÏthe€trial€courtððs€finding,€and€hence,€we€must€conclude€that€JohnsonððsÏrepresentation€was€not€constitutionally€deficient€with€regard€to€jury€selection.ÌÌà àLikewise,€we€must€also€conclude€that€Johnsonððs€representation€was€notÏconstitutionally€deficient€with€regard€to€the€investigation€and€presentation€of€theÏpetitionerððs€mental€condition.€€The€trial€court€found€that€Johnson€was€quite€awareÍof€the€petitionerððs€mental€history€and€took€the€appropriate€steps€to€evaluate€hisÏmental€condition€further.€€Johnson€testified€that€the€petitioner€had€not€asked€himÏto€contact€Connie€Gwin,€and€Gwin€stated€that€she€had€made€no€efforts€toÏspeak€with€the€petitionerððs€attorney.€€With€regard€to€Loretta€Light,€apparentlyÏJohnson€intended€to€call€her€as€a€witness€but€changed€his€strategy€when€heÏwas€able€to€elicit€testimony€regarding€the€petitionerððs€mental€condition€from€otherÏwitnesses.€€From€these€circumstances,€we€cannot€conclude€that€JohnsonððsÏrepresentation€was€deficient.€€Moreover,€the€petitioner€has€failed€to€demonstrateÏany€prejudice€stemming€from€these€alleged€deficiencies.€€We€agree€with€the€trialÏcourt€that€neither€Gwinððs€nor€Lightððs€testimony€would€have€revealed€anyÏsignificant€information€not€already€garnered€from€the€testimony€of€otherÏwitnesses.ÌÌà àThe€petitioner€has€failed€to€carry€his€burden€of€demonstrating€that€hisÏcounselððs€representation€was€deficient€and€that€the€deficient€representationÏprejudiced€him.€€The€judgment€of€the€trial€court€is€affirmed.ÌÌÌÓÓà
