àThe€appellant,€James€Robert€Littleton,€was€convicted€following€a€jury€trialÏof€retaliation€for€past€action.€€He€brings€this€appeal€claiming€that:€€(1)€theÏevidence€was€insufficient€to€support€the€verdict,€and€(2)€the€trial€court€erred€byÏallowing€into€evidence€information€provided€by€a€ð ðStar€69"€telephone€device.€ÏFollowing€our€review,€we€affirm€the€trial€courtððs€judgment.€ÌÌà àThe€proof€at€trial€indicated€that€the€appellant€had€worked€for€the€victim€onÏhis€dairy€farm€for€two€and€one„half€years.€€When€the€victimððs€milk€supply€wasÏcontaminated€by€antibiotics,€he€took€out€warrants€against€the€appellant.€€TheÏvictim€was€present€at€the€appellantððs€preliminary€hearing€in€the€late€fall€or€earlyÏwinter€season.€€ÌÌà àOn€December€19,€1993,€the€victim€received€a€telephone€call€from€theÍappellant€around€4:30€p.m.€€The€appellant€told€the€victim€that€he€knew€he€[theÏvictim]€was€the€person€who€had€caused€him€ð ðall€of€the€troubleðð€and€that€ð ð[he]Ïwas€going€to€pay.ðð€€The€appellant€also€said€that€he€knew€where€the€victimÏbought€cigarettes€in€Sulphur€Springs.€€He€told€the€victim€that€he€would€beÏwaiting€on€him€some€day€to€ð ðwhip€[his]€ass.ðð€€The€appellant€also€added€that€theÏvictim€would€not€want€to€cross€his€path€in€the€community€or€he€would€kill€himÏð ðgraveyard€dead.ðð€€The€victim€said€the€appellant€told€him€that€after€he€ð ðtook€careÏof€[him]ðð€he€was€going€to€ð ðtake€careðð€of€the€victimððs€brother.€€ÌÌà àDuring€the€conversation€the€appellant€told€the€victim€he€should€check€aÏparticular€gate€on€his€farm€which€kept€the€cattle€from€getting€into€the€road.€€TheÏvictimððs€subsequent€investigation€revealed€that€the€gate€had€been€opened.€€TheÏappellant€claimed€responsibility€for€the€open€gate.€€The€victim€grew€tired€of€theÏphone€conversation€and€hung€up€the€telephone.€€He€told€his€daughter€not€toÏanswer€the€phone€if€it€rang€again.€€About€five€minutes€later,€the€telephone€rangÏagain.€€The€victim€asked€his€daughter€to€punch€the€ð ðStar€69"€feature€toÏdetermine€the€origin€of€the€call.€€This€inquiry€revealed€that€the€call€was€beingÏmade€from€the€appellantððs€parentsðð€home.€€The€victim€knew€the€number€fromÏhaving€called€it€when€the€appellant€worked€for€him.€€ÌÌà àRoy€Whitaker,€the€appellantððs€friend,€worked€with€the€appellant€on€theÏday€in€question.€€Whitaker€indicated€that€he,€the€appellant,€and€the€appellantððsÏbrother€had€eaten€supper€together€and€later€purchased€beer€which€theyÍconsumed.€€The€three€stopped€near€a€gate€across€from€the€victimððs€farm€to€useÏthe€restroom.€€Although€Whitaker€did€not€see€the€appellant€open€the€gate,€heÏsaw€that€it€was€opened€when€he€turned€around.€€When€they€arrived€at€the€homeÏof€the€appellantððs€parents,€the€appellant€said€that€he€was€going€to€phone€theÏvictim€to€tell€him€he€opened€the€gate.€€Whitaker€heard€part€of€the€conversation€inÏwhich€the€appellant€called€the€victim€ð ða€bald€headed€son€of€a€b€_€_€_€_.ðð€€HeÏalso€heard€the€appellant€tell€the€party€to€meet€him€at€the€grocery€where€heÏwould€ð ðwhop€[sic]€his€ass.ðð€€Whitaker€said€that€when€the€conversation€was€over,Ïthe€appellant€got€into€a€physical€fight€with€his€father.€€The€fight€apparentlyÏstarted€because€appellantððs€father€told€him€not€to€be€calling€the€victim.€€ÌÌà àThe€appellantððs€father€testified.€€He€denied€that€the€appellant€phonedÏanyone€that€evening.€€He€further€denied€that€he€and€the€appellant€had€foughtÏthat€evening€or€that€they€had€purchased€beer.ÌÌà@ àI.€€"Star€69"€TestimonyÌà àThe€state€initially€argues€that€the€appellant€has€waived€his€right€toÏchallenge€the€ð ðStar€69"€testimony€by€failing€to€file€his€notice€of€appeal€until€46Ïdays€after€the€final€judgment€of€the€court€was€entered.€€Technically,€this€issue€isÏwaived;€however€in€the€interest€of€justice€we€waive€the€timely€filing€requirementÏand€review€the€appellant's€claims.€€T.R.A.P.€4(a).€ÌÌà àThe€appellant€argues€that€the€ð ðStar€69"€testimony€should€not€have€beenÍpermitted€at€trial.€€The€victim€testified€that€after€the€initial€telephone€conversationÏwith€the€appellant,€he€told€his€daughter€not€to€answer€the€telephone.€€MomentsÏlater€the€telephone€rang€again.€€When€the€ringing€stopped,€the€victim€instructedÏhis€daughter€to€use€the€ð ðStar€69"€feature€to€determine€the€origin€of€the€call.€€TheÏvictim€testified€that€his€daughter€determined€that€the€call€originated€from€theÏappellantððs€parentsðð€telephone.€€However,€the€victimððs€daughter€did€not€testify.€€ÌÌà àThe€victimððs€recitation€of€what€his€daughter€determined€from€the€ð ðStar€69"Ïinquiry€constitutes€hearsay.€€The€appellant€did€not€object€to€this€testimony€atÏtrial.€€Failure€to€contemporaneously€object€to€hearsay€testimony€constitutesÏwaiver€of€the€issue.€€T.R.A.P.€36(a).€€Notwithstanding€waiver,€we€find€that€theÏ"Star€69"€testimony€did€not€significantly€add€to€the€victim's€damning€testimony.€ÏThus,€based€on€the€strength€of€the€remaining€evidence,€we€find€that€error,€if€any,Ïwas€harmless.€€T.R.A.P.€36(b);€Tenn.€R.€Crim.€P.€52(a).€€ÌÌà@ àII.€€Sufficiency€of€the€EvidenceÌà àIn€his€final€challenge,€the€appellant€contends€that€the€evidence€wasÏinsufficient€to€support€his€conviction.€€In€a€sufficiency€of€the€evidence€challenge,Ïthe€relevant€question€for€appellate€review€is€whether,€after€viewing€the€evidenceÏin€the€light€most€favorable€to€the€prosecution,€any€rational€trier€of€fact€could€haveÏfound€the€essential€elements€of€the€crime€or€crimes€beyond€a€reasonable€doubt.€ÏòòJackson€v.€Virginiaóó,€443€U.S.€307€(1979);€òòState€v.€Duncanóó,€698€S.W.2d€63Ï(Tenn.€1985);€T.R.A.P.€13(e).ÌÌà àIn€Tennessee,€great€weight€is€given€to€the€result€reached€by€the€jury€in€aÏcriminal€trial.€€A€jury€verdict€accredits€the€testimony€of€the€state's€witnesses€andÏresolves€all€conflicts€in€favor€of€the€state.€€òòState€v.€Williamsóó,€657€S.W.2d€405Ï(Tenn.€1983).€€Moreover,€a€guilty€verdict€replaces€the€presumption€of€innocenceÏenjoyed€at€trial€with€the€presumption€of€guilt€on€appeal.€€òòState€v.€Graceóó,€493ÏS.W.2d€474€(Tenn.€1973).€€The€appellant€has€the€burden€of€overcoming€theÏpresumption€of€guilt.€€òòIdóó.€€On€appeal,€the€state€is€entitled€to€the€strongestÏlegitimate€view€of€the€evidence€and€all€reasonable€inferences€which€may€beÏdrawn€therefrom.€€òòState€v.€Cabbageóó,€571€S.W.2d€832€(Tenn.€1978).Ì€€Ìà àReviewing€the€evidence€absent€the€ð ðStar€69"€testimony,€we€find€sufficientÏevidence€to€support€the€appellantððs€conviction.€€Tennessee€Code€AnnotatedÏsection€39„16„510€provides€that€"[a]€person€commits€the€offense€of€retaliation€forÏpast€action€who€harms€or€threatens€to€harm€a€witness€at€an€official€proceedingÏ...€by€any€unlawful€act€in€retaliation€for€anything€the€witness€...€did€in€an€officialÏcapacity€as€witness...."€€Tenn.€Code€Ann.€ðð€39„16„510(a)€(1991).€€We€find€thatÏthe€elements€of€the€offense€were€established€by€the€proof.€€ÌÌà àThe€appellant€concludes€that€because€the€testimony€of€the€witnessesÏconflicted,€the€"Star€69"€testimony€was€likely€the€deciding€factor€in€the€minds€ofÏthe€jurors.€€We€disagree.€€As€discussed€above,€we€found€that€any€error€in€theÏadmission€of€the€testimony€was€harmless.€€Therefore,€the€jury€was€left€with€aÍcredibility€determination€and€chose€to€believe€the€state's€witnesses.€€The€weightÏand€credibility€of€the€witnesses'€testimony€are€matters€entrusted€exclusively€toÏthe€jury.€€òòState€v.€Sheffieldóó,€676€S.W.2d€542€(Tenn.€1984).€€We€will€not€usurpÏthis€function.€€This€issue€is€without€merit.ÌÌà
