×€€€€TheÏstateððs€proof€showed€that€the€defendant€and€the€victimððs€father€were€closeÏfriends,€and€the€defendant€often€visited€the€family.€€On€August€21,€the€motherÏand€C.I.ððs€brother€were€visiting€with€a€neighbor.€€C.I.,€who€was€twenty€months€ofÏage,€her€father,€and€the€defendant€were€together€in€the€living€room.€€At€someÏpoint,€C.I.ððs€father€left€the€room€to€use€the€bathroom.€After€he€had€been€in€theÍbathroom€for€about€five€minutes,€he€heard€his€daughter€scream€out€as€thoughÏshe€were€afraid€or€in€pain.ÌÌà àThe€bedroom€was€directly€across€from€the€bathroom,€and€when€heÏopened€the€bathroom€door,€he€saw€his€daughter€lying€on€the€bed€with€her€feetÏdangling€over€the€end€of€the€bed.€€Her€diaper€was€on€the€floor,€and€theÏœdefendantÌ›€was€leaning€over€her€with€his€weight€on€both€hands€which€were€placed€justÏabove€the€toddlerððs€head.€€The€defendantððs€pants€were€on,€but€his€genital€areaÏwas€so€close€to€that€of€the€victim€that€the€father€could€not€testify€for€certainÏwhether€the€defendant€actually€touched€her€genitalia.€€ÌÌà àThe€father€cried€out,€and€the€defendant€ran€out€the€bedroom€doorÏand€out€of€the€apartment.€€The€diaper€on€the€floor€was€dry€but€it€was€obvious€itÏhad€been€worn.€€One€of€the€tapes€had€been€ripped€off.€€The€father€sent€aÏneighbor€child€to€find€his€wife,€and€when€she€returned€she€examined€the€child.€ÏThe€mother€testified€that€she€saw€nothing€unusual€in€her€daughterððs€genitalÏarea.€€A€neighbor€woman€who€came€to€help€also€examined€the€child.€€SheÏtestified€that€the€genital€area€and€legs€were€reddened.€€The€neighbor€alsoÏtestified€that€a€few€moments€later,€when€the€defendant€reentered€the€apartment,Íthe€little€girl€became€hysterical,€sobbing€and€clinging€to€her€mother.€€BothÏparents€testified€that€materials€for€changing€C.I.ððs€diapers€were€in€the€livingÏroom,€not€the€bedroom.€€œ€The›€defense€put€on€no€proof.€€ÌÌà àThe€jury€returned€a€guilty€verdict€for€attempted€aggravated€sexualÏbattery.€€Tenn.€Code€Ann.€ðððð€39„12„101,€œ39„13„504›€(1991€Repl.)€€€TheÏdefendant€now€contends€that€the€proof€is€insufficient,€as€a€matter€of€law,€toÏsustain€the€juryððs€verdict.ÌÌà àOur€inquiry€must€begin€with€the€determination€of€whether€appellantÏis€entitled€to€the€statutory€presumption€that€Ô% € à€A€defendant€who€does€not€fall€within€the€œparameters›Ïof€subdivision€(5)€and€is€an€especially€mitigated€orÏstandard€offender€convicted€of€a€Class€C,€D,€or€EÏfelony€is€presumed€to€be€a€favorable€candidate€forÏalternative€sentencing€options€in€the€absence€ofÏevidence€to€the€contrary.€ÌÌÌÌÓÓà à€Here€appellant€was€convicted€of€a€class€C€felony€as€a€Range€IÏoffender,€and€unless€there€is€evidence€to€the€contrary,€he€is€presumably€aÏfavorable€candidate€for€alternative€sentencing.€€€However,€the€presumption€canÏbe€successfully€rebutted€by€facts€contained€in€the€presentence€report,€evidenceÏpresented€by€the€state,€the€testimony€of€the€accused€or€a€defense€witness,€orÏany€other€source€that€is€part€of€the€record.€€òòState€v.€Bonestelóó,€871€S.W.2d€163,Ï167€(Tenn.€Crim.€App.€1993).ÌÌà àIn€this€case,€the€state€has€successfully€rebutted€the€presumption.€ÏThe€principles€upon€which€our€sentencing€act€is€based€include€the€idea€thatÏconfinement€should€be€based€on€consideration€of€societal€protection.€€WhenÏmeasures€less€restrictive€than€confinement€have€frequently€or€recently€beenÏapplied€to€the€defendant,€incarceration€is€appropriate.€€Tenn.€Code€Ann.€ðð€40„35„103€(1)(C)(1990€Repl.).€€Moreover,€potential€or€lack€of€potential€forÏrehabilitation€must€be€considered.€€œTenn.€Code€Ann.€ðð›€40„35„103(5).€€In€thisÏinstance,€the€defendant€has€demonstrated€a€clear€disregard€for€the€law€and€aÏdisinclination€to€conform€his€actions€to€the€rules€of€society.€€Although€hisÏcriminal€history€is€not€as€extensive€as€some,€it€includes€one€felony€convictionÏand€misdemeanor€convictions€for€criminal€trespass,€public€intoxication,€assault,Ïand€driving€without€a€license€all€of€which€occurred€within€a€four€year€period.× ƒ, ××  ×€ÏHis€arrest€for€criminal€trespass€and€public€intoxication€occurred€while€he€wasÏawaiting€trial€in€this€offense.€€Moreover,€the€defendant€failed€to€completeÏsuccessfully€the€six€years€of€probation€ordered€by€a€Georgia€court€in€his€oneÏprior€felony€conviction.€€The€record€indicates€that€he€failed€to€report,€failed€toÍwork€or€look€for€serious€employment,€was€arrested€and€convicted€of€assaultÏduring€this€period,€had€two€positive€drug€screens,€and€absconded€fromÏsupervision.€€In€addition,€he€failed€to€appear€for€his€first€scheduled€arraignmentÏand€the€first€sentencing€hearing€in€this€conviction.€€ÌÌà àOnce€arrested€and€convicted€of€a€felony,€a€person€inclined€toÏbecome€a€law„abiding€citizen€would€learn€from€his€mistakes€and€would€œbeÌ›€inclined€to€remain€arrest„free.€€€The€appellant€did€not€œchoose›€this€path€butÏrather€went€on€to€accumulate€a€criminal€history.€The€appellant€is€a€convictedÏfelon€who€has€previously€shown€a€disregard€for€the€laws€of€this€state€and€for€theÏrehabilitative€opportunities€offered€him.€€As€such€he€is€not€a€favorable€candidateÏfor€rehabilitation.€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„35„102(5).€Any€presumption€thatÏhe€is€an€appropriate€candidate€for€alternative€sentencing€has€been€rebutted€byÏthe€facts€in€the€record.€ÌÌà
