Thisistheappellant'sthirdpetitionforpostconvictionrelief.In1973,theappellantwasconvictedofonecountofrapeandonecountofacrimeagainstnature.Hereceivedasentenceofonehundredandtwentyyearsfortherapeconvictionandfifteenyearsforthecrimeagainstnatureconviction.Hisconvictionsandsentenceswereaffirmedondirectappeal.Statev.Lundy,521S.W.2d591(Tenn.Crim.App.Aug.30,1974),perm.toappealdenied,(Tenn.Mar.10,1975).OnMay12,1975,theappellantfiledhisfirstpetitionforpostconvictionrelief.SeeLundyv.State,752S.W.2d98,99(Tenn.Crim.App.),perm.toappealdenied,(Tenn.1987).Thetrialcourtdeniedthepetition.Theappellantdidnotappealthedismissal.OnFebruary15,1979,theappellantfiledapetitionforwritofhabeascorpusinthefederalDistrictCourtfortheMiddleDistrictofTennessee.Ultimately,thiswritwasdismissedbytheUnitedStatesSupremeCourt.Rosev.Lundy,455U.S.509,102S.Ct.1198(1982).Afterthefederalhabeaspetitionwasdismissed,theappellantfiledasecondpetitionforpostconvictionreliefonJuly6,1982.Thetrialcourtdismissedthesecondpetition.OnDecember1,1987,thiscourtaffirmedthedismissal,and,onMarch14,1988,thesupremecourtdeniedpermissiontoappeal.Lundyv.State,752S.W.2dat98.OnNovember28,1995,theappellantfiledthepresentpetitionforpostconvictionrelief.ThepostconvictioncourtdeniedreliefonNovember30,1995,asthepetitionwasbarredbythestatuteoflimitations. EffectiveJuly1,1986,Tenn.CodeAnn.4030102(1987Supp.)(repealed1995)limitedthefilingofpostconvictionpetitionsto"withinthreeyearsofthedateofthefinalactionofthehigheststateappellatecourttowhichanappealistaken."SeeBurfordv.State,845S.W.2d204(Tenn.1992)(holdingthatthreeyearstatuteoflimitationcomplieswithdueprocessrequirements).Thepetitionnowbeforethiscourtwasfiledovertwentyyearsafterthedateofhisconviction.However,asthenewstatutewastobeappliedprospectively,theappellanthaduntilJuly1,1989,tofileapetitionforpostconvictionrelief.SeeStatev.Masucci,754S.W.2d90,91(Tenn.Crim.App.1988).Moreover,weconcludethattheprovisionsofthenewPostConvictionProcedureAct,effectiveMay10,1995,havenoapplicationtothecasebeforeus.SeeTenn.CodeAnn.4030201etseq.(1996Supp.).Thus,thepetition,filedsixyearsafterthisdate,istimebarred.̀ Accordingly,wefindnoerroroflawmandatingreversal.Thetrialcourt'sdismissaloftheappellant'spetitionisaffirmedinaccordancewithTenn.Ct.Crim.R.App.20.     ____________________________________     DAVIDG.HAYES,JudgeCONCUR:________________________________DAVIDH.WELLES,Judge________________________________THOMAST.WOODALL,Judge
