T9ô/1 ÐLane€on€June€13,€1997.€€On€July€1,€1997,€Mr.€Lane€asked€to€see€Ethan.€ÏAppellant€took€Ethan€to€Mr.€Laneððs€home€on€July€2,€1997,€with€the€understandingÏthat€Mr.€Lane€would€return€Ethan€on€July€4,€1997.€€ÌÌà ` àOn€July€4,€1997,€Mr.€Lane€called€Appellant€at€her€place€of€employment€atÏapproximately€11:30€a.m.€Appellant€then€called€the€police€station€and€left€aÏmessage€for€Detective€Chris€Chambers.€€Appellant€then€reported€to€herÏsupervisor€that€Mr.€Lane€was€not€going€to€return€Ethan€and€she€was€going€to€tryÏto€get€Ethan€back.€€The€supervisor€then€offered€to€drive€Appellant€to€Mr.€LaneððsÏhome,€but€Appellant€refused€and€told€her€supervisor€that€he€did€not€need€to€getÏinvolved€in€the€situation.€ÌÌà ` àShortly€thereafter,€Appellant€stopped€at€a€gas€station€to€fill€up€her€car.€ÏDetective€Chambers€then€paged€Appellant€and€when€Appellant€called€him€back,ÏChambers€told€Appellant€to€meet€him€and€some€other€officers€at€another€location.€ÏWhen€Appellant€told€Chambers€that€Mr.€Lane€would€not€give€Ethan€back,ÏChambers€told€Appellant€that€unless€there€was€a€court€order,€the€police€could€notÏtake€Ethan€from€Mr.€Lane.€€Appellant€did€not€tell€Chambers€that€Ethan€was€inÏdanger.€ÌÌà àAppellant€then€drove€for€approximately€forty„five€minutes€to€a€locationÏwhere€she€met€Officer€Porter€McKamey.€€McKamey€then€told€Appellant€thatÏbecause€she€and€Mr.€Lane€were€not€divorced,€the€police€could€not€take€EthanÏfrom€Mr.€Lane€if€he€did€not€want€to€give€up€custody.€€McKamey€then€toldÏAppellant€that€he€wanted€her€to€wait€until€another€officer€arrived.€€Appellant€thenÏresponded€that€she€would€go€and€get€Ethan€herself€because€ð àAppellant€then€left€that€location€and€traveled€to€Mr.€Laneððs€home.€€AppellantÏsubsequently€entered€the€home€and€pointed€a€.380€automatic€handgun€at€Mr.ÏLaneððs€head.€€Appellant€then€forced€Mr.€Lane€to€sit€down€and€she€beganÏscreaming€and€yelling.€€At€this€time,€Ethan€Lane€was€upstairs€with€Mr.€LaneððsÏtwelve„year„old€son€from€a€previous€marriage,€Eric€Lane.€ÌÌà ` àAfter€Officer€McKamey€met€Officer€Sharkie€Adams€at€the€gas€station,€theÏtwo€officers€traveled€to€Mr.€Laneððs€home.€€Upon€arriving€at€the€scene,€McKameyÏcould€see€that€Appellant€was€pointing€a€gun€at€Mr.€Laneððs€head.€€When€McKameyÏordered€Appellant€to€drop€the€gun,€Appellant€turned€around€and€said€ð ðnoðð€andÏthen€turned€and€pointed€the€gun€at€Mr.€Laneððs€head€again.€€McKamey€consideredÏshooting€Appellant,€but€decided€not€to€because€he€would€have€had€to€fire€throughÏa€glass€door€and€the€bullet€probably€would€have€been€deflected.€ÌÌà ` àShortly€thereafter,€Detective€Chambers€entered€Mr.€Laneððs€home€and€sawÏthat€Appellant€had€cocked€the€gun€and€was€pointing€it€at€Mr.€Laneððs€head.€ÏChambers€then€heard€Appellant€say€ð ðYouððre€going€to€sign€this€child€over€to€me.€ÏIððm€not€ððFðð€Lori€Lane.€€Youððre€not€going€to€mess€with€me.€€Iððm€[sic]€kill€you.ðð€ÏChambers€then€snuck€up€behind€Appellant€and€tackled€her€and€took€the€gunÏaway.€ÌÌà ` àAccording€to€Appellantððs€version€of€events,€she€had€suffered€through€aÏdifficult€pregnancy€and€subsequent€delivery€and€she€had€never€received€any€helpÐ Ð9p02 Ðfrom€Mr.€Lane.€€Further,€Mr.€Lane€had€told€her€during€the€telephone€call€that€sheÏwould€not€get€Ethan€back€unless€she€made€a€deal€with€him€about€payment€ofÏchild€support.€€Mr.€Lane€then€stated€that€he€was€going€to€take€Ethan€on€a€ð ðroadÏtrip.ðð€€Appellant€testified€that€she€only€pointed€the€gun€at€Mr.€Lane€so€that€sheÏcould€get€Ethan€back€and€because€she€believed€that€Mr.€Lane€would€kill€EthanÏif€she€did€not€take€action.€€Appellant€also€testified€that€although€she€did€notÏremember€everything€she€said€during€the€incident,€she€did€not€say€that€she€wouldÏkill€Mr.€Lane.€€Appellant€further€testified€that€while€she€acknowledged€that€whatÏshe€had€done€was€criminally€wrong,€she€believed€that€what€she€had€done€wasÏmorally€right.€ÌÌà ` àAccording€to€Mr.€Laneððs€version€of€events,€he€and€Appellant€had€agreedÏduring€the€telephone€call€to€meet€at€his€home€to€discuss€Ethanððs€care.€€Mr.€LaneÏdenied€telling€Appellant€that€he€would€take€Ethan€away€so€that€she€would€neverÏsee€him€again.€€Mr.€Lane€stated€that€he€had€been€working€for€the€city€for€twentyÏyears€and€he€was€raising€two€boys,€thus,€he€would€not€go€anywhere€else.€ÌÌà ` àMr.€Lane€testified€that€when€he€let€Appellant€into€his€home,€she€cocked€theÏgun€and€held€it€to€the€back€of€his€head.€€Appellant€then€made€some€ð ðabusiveÏremarksðð€that€were€ð ðquite€vulgar.ðð€€Appellant€then€told€Mr.€Lane€that€she€wasÏgoing€to€kill€him€and€she€would€only€receive€an€eighteen€month€sentenceÏbecause€it€would€be€her€first€offense.€€At€that€time,€Appellant€heard€Eric€LaneÏmake€a€noise€and€she€stated€that€she€was€ð ðnot€going€to€leave€any€witnesses.ððÌÌà ` àMr.€Lane€also€testified€that€when€Officer€McKamey€told€Appellant€to€put€theÏgun€down,€she€told€Mr.€Lane,€ð ðGet€ready€to€meet€your€Fððing€maker.ðð€€Mr.€LaneÐ Ð9p02 Ðstated€that€as€a€result€of€Appellantððs€actions,€he€and€Eric€Lane€had€both€lost€a€lotÏof€weight€and€Eric€had€to€undergo€therapy.€ÌÌà ` àAccording€to€Eric€Lane,€he€was€at€Mr.€Laneððs€home€when€AppellantÏentered€the€home€with€a€gun.€€When€Appellant€heard€Eric€walking€up€the€stairs,Ïshe€made€some€ð ðvery€violentðð€remarks.€€Eric€stated€that€Appellant€alsoÏthreatened€to€kill€Mr.€Lane€and€said€that€she€would€only€receive€an€eighteenÏmonth€sentence€for€doing€so.€€Eric€also€stated€that€as€a€result€of€AppellantððsÏactions,€he€could€not€sleep€at€night,€he€had€been€unable€to€maintain€a€stableÏweight,€and€he€had€been€taking€medication.€ÌÌà ` àNumerous€individuals€either€testified€at€the€hearing€or€submittedÏstatements€with€the€petition€for€pretrial€diversion€indicating€that€they€believed€thatÏAppellant€was€a€good€person€and€that€her€actions€during€the€events€in€questionÏwere€inconsistent€with€her€previous€behavior.€ÌÌà ` àThe€district€attorney€general€denied€Appellantððs€petition€for€pretrialÏdiversion€based€on€the€following€reasons:Ìñ,ñÓÓñ,ñà0 ` àà ¸ à5.€€The€Defendantððs€ð à6.€€The€Defendant€married€on€her€twentieth€birthday€and€wasÏdivorced€less€than€two€years€later.€€She€married€the€victim€of€this€crimeÏthree€years€later,€and€bore€a€child€nine€months€afterward.€€She€committedÏthis€crime€a€few€weeks€after€the€birth.Ð ` T$` T$ Ðà0 ` àà ¸ à7.€€The€Defendant€claims€no€physical€or€psychological€impairment.€Ïâ âShe€has€continued€to€function€well€both€before€and€after€the€crime.ÐØ8x/1` T$` T$ Ðà0 ` àà ¸ à8.€€Information€surrounding€the€circumstances€of€the€crime€comesÏâ âfrom€the€Defendantððs€version€as€well€as€the€reports€of€the€victim€and€lawÏenforcement€officers.€€These€witnesses€will€be€available€for€testimony€atÏthe€hearing€in€this€matter.€€The€undisputed€facts€are€that€the€DefendantÏand€the€victim€had€disagreements€and€had€separated.€€No€divorce€or€otherÏproceedings€had€begun.€€They€shared€child€care€duties.€€Following€aÏdispatch€to€the€victimððs€home,€Sheriffððs€deputies€found€the€DefendantÏholding€the€victim€at€the€point€of€a€loaded€pistol.€€The€infant€and€theÏvictimððs€child€from€a€previous€marriage€were€in€the€house.€€She€refused€toÏdrop€or€point€away€the€gun,€and€was€eventually€tackled€by€DetectiveÏChambers.Ð ` T$` T$ Ðà0 ` àà ¸ à9.€€The€Defendant€claims€that€she€was€telephoned€earlier€by€theÏvictim€and€that€he€told€her€that€he€would€not€relinquish€the€child.€€SheÏclaims€that€she€believed€that€the€victim€intended€to€harm€the€infant.€€SheÏtold€a€co„worker€about€this,€and€the€co„worker€offered€to€assist.€€TheÏDefendant€rejected€this€offer.€€She€then,€after€the€passage€of€time,€calledÏdeputies€and€met€them€at€a€market.€€She€was€told€that€the€officers€wouldÏdeal€with€the€situation.€€She€refused€this€help,€left,€and€went€to€the€victimððsÏhouse.Ð ` T$` T$ Ðà0 ` àà ¸ à10.€€The€victim,€a€senior€Firefighter,€denies€having€refused€to€turnÏover€the€child.€€He€says€that€he€expected€the€Defendant€to€remove€theÏchild,€and€that€the€childððs€traveling€bag€was€packed€and€waiting.Ð ` T$` T$ Ðà0 ` àà ¸ à11.€€Detective€Chambers€explains€that€there€had€been€a€previousÏcall€to€the€Lanesðð€house,€and€that€he€had€explained€to€the€Defendant€theÏhelp€available€to€her€in€case€of€violence€or€danger.€€Chambers€is€a€longÏtime€acquaintance€of€the€victim.€€Immediately€before€going€to€the€victimððsÏhouse,€Chambers€told€the€Defendant€to€wait€and€that€he€would€come€helpÏwith€the€problem.€€At€that€time,€the€Defendant€referred€to€the€gun€she€had.Ð ` T$` T$ Ðà0 ` àà ¸ à12.€€Witnesses€will€testify€that€they€believe€the€Defendant€intendedÏto€kill€the€victim,€and€that€only€Chambersðð€physical€intervention€preventedÏher.Ð ` T$` T$ Ðà0 ` àà ¸ à13.€€The€State€believes€that€the€Defendantððs€pre„offense€history€isÏnot€inconsistent€with€the€idea€of€rehabilitation.€€She€was€an€honest€citizenÏof€good€apparent€character.€€There€appears€at€this€time€nothing€to€indicateÏthat€she€will€re„offend.€€However,€there€was€nothing€in€that€history€toÏindicate€that€she€would€offend€the€first€time,€either.Ð ` T$` T$ Ðà0 ` àà ¸ à14.€€The€State€believes€that€the€Defendantððs€actions€even€as€sheÏexplains€them€indicate€that€she€is€a€poor€candidate€for€rehabilitation€andÏthat€she€must€be€specifically€deterred€and€punished.€€This€is€a€successful,Ïarticulate€person€who€is€used€to€solving€problems€every€day.€€TheÏDefendant,€already€experienced€with€the€process€of€divorce,€rejected€theÏlawful€path€to€deal€with€the€situation€she€claims€existed.€€Although€sheÏclaims€that€she€was€concerned€for€the€infantððs€safety,€she€did€notÏimmediately€call€for€help.€€The€Defendant€repeatedly,€over€a€period€ofÏhours,€actively€rejected€the€assistance€of€a€co„worker€and€the€police.€€EvenÏafter€the€officers€arrived,€she€continued€to€menace€and€terrorize€the€victim.€ÏEven€if€the€Defendantððs€claims€are€true,€they€provide€neither€defense€norÏjustification.€€She€continues€to€blame€the€victim€for€her€conduct.Ð ` T$` T$ Ðà0 ` àà ¸ à15.€€There€is€no€reason€to€believe€that€the€Defendantððs€version€isÏaccurate.€€Her€actions€are€inconsistent€with€a€parent€fearing€for€her€infantððsÏsafety.€€They€are€more€consistent€with€a€woman€who€chose,€afterÐ Ð9p02 Ðdeliberation€and€premeditation,€to€take€a€gun€in€hand€to€settle€a€score.€ÏThe€victim€maintains€that€the€Defendantððs€story€is€a€fabrication.€€At€thisÏpoint,€the€State€agrees.Ð ` T$` T$ Ðà0 ` àà ¸ à16.€€The€Defendant€trivializes€and€depreciates€the€harm€she€didð"ðð ðÏ.€.€.€(she)€caused€no€harm€or€difficulty€to€Mr.€Lane€whatsoever.ðð€€Mr.€LaneÏand€his€son€have€suffered€harm€as€they€will€testify.Ð ` T$` T$ Ðà0 ` àà ¸ à17.€€In€addition€to€specific€deterrence,€the€Defendantððs€actions€callÏfor€general€deterrence€and€diversion€would€depreciate€the€seriousness€ofÏthe€crimes.€€The€Defendantððs€conduct€is€the€fruit€of€two€crimes,€the€assaultÏand€the€unlawful€carrying€of€the€pistol,€which€began€some€time€previously.Ð ` T$` T$ Ðà0 ` àà ¸ à18.€€The€Defendantððs€conduct€threatened€harm€to€7€[later€amendedÏto€nine]€peopleð"ðthe€Defendant,€the€victim,€the€three€[later€amended€toÏfive]€officers,€the€victimððs€son,€and€the€infant€child.€€Two€of€these€wereÏespecially€vulnerable€due€to€age.€€Detective€Chambers€and€the€otherÏDeputies€chose€not€to€shoot€the€Defendant,€but€increased€their€risk€byÏexposing€themselves€to€her€fire.€€The€State€commends€their€restraint.€€ThatÏrestraint€continued€in€the€Courts,€when€the€Defendant€was€charged€withÏthese€offenses€rather€than€additional€Felony€Reckless€Endangerments€orÏEspecially€Aggravated€Kidnapping,€a€class€A€felony.Ð ` T$` T$ Ðà0 ` àà ¸ à19.€€Homicide€is€the€most€serious€crime.€€This€is€a€case€in€which€theÏDefendant€may€well€have€killed€if€the€Deputies€had€not€intervened.Ð ` T$` T$ Ðà0 ` àà ¸ à20.€€This€is€a€ð ðdomesticðð€crime.€€In€recognition€of€the€harm€done€toÏour€community€by€this€sort€of€crime,€the€justice€system€and€legislature€haveÏacknowledged€our€responsibility€to€treat€these€cases€seriously€and€toÏprovide€assistance€to€prevent€them.€€These€efforts€are€under€way€in€thisÏCounty€and€are€succeeding,€in€part€due€to€a€public€perception€that€theseÏcrimes€will€be€taken€seriously.€€The€Defendant€should€not€be€rewarded€forÏrejecting€assistance.Ð Ðattorney€general€noted€that€during€the€incident€at€Mr.€Laneððs€home,€AppellantÏendangered€the€lives€of€Mr.€Lane,€two€minor€children,€and€several€police€officers.€ÏThe€district€attorney€general€also€relied€on€the€fact€that€Appellant€had€refused€toÏput€the€gun€down€even€when€ordered€to€do€so€by€police.€€The€district€attorneyÏgeneral€also€relied€on€evidence€which€indicated€that€Appellant€would€have€killedÏMr.€Lane€if€the€police€had€not€intervened.€€Indeed,€Jim€and€Eric€Lane€bothÏtestified€that€Appellant€stated€that€she€was€going€to€kill€Mr.€Lane€and€she€wouldÏonly€receive€an€eighteen€month€sentence€for€doing€so.€€Chambers€also€testifiedÏthat€he€heard€Appellant€tell€Mr.€Lane€that€she€was€going€to€kill€him.€ò àThe€district€attorney€general€also€based€his€decision€to€deny€the€requestÏfor€pretrial€diversion€on€Appellantððs€poor€potential€for€rehabilitation.€€First,€theÏdistrict€attorney€general€found€that€Appellantððs€version€of€the€events€was€aÏfabrication.€€The€district€attorney€general€based€that€determination€on€theÏAppellantððs€acting€in€a€way€that€was€inconsistent€with€a€belief€that€Ethan€was€inÏdanger.€€Indeed,€the€record€indicates€that€Appellant€did€not€tell€either€ChambersÏor€McKamey€that€Ethan€was€in€danger€and€that€she€refused€to€put€the€gun€awayÏwhen€the€police€officers€arrived€at€Mr.€Laneððs€home.€€The€district€attorney€generalÏalso€based€his€determination€that€Appellant€had€poor€potential€for€rehabilitationÏon€the€fact€that€Appellant€had€refused€the€help€of€law€enforcement€officers€andÏhad€decided€to€take€œmatñ5ñtñ5ñers›€into€her€own€hands.€€In€fact,€Appellant€testified€thatÏshe€purposefully€took€the€gun€with€her€to€Mr.€Laneððs€home€for€use€in€retrievingÏEthan.€€The€district€attorney€general€also€determined€that€Appellant€had€poorÏpotential€for€rehabilitation€because€she€had€failed€to€accept€responsibility€for€herÏactions.€€Indeed,€Appellant€testified€at€the€hearing,€ð ðI€understand€that,€criminally,ÏI€did€wrong;€but,€as€far€as€my€child€still€breathing,€I€did€right,€morally.ðð€€Further,Ð Ð9p02 Ðafter€observing€Appellantððs€demeanor€and€listening€to€her€testimony,€the€trialÏcourt€found€that€Appellant€had€shown€that€she€was€not€capable€of€handling€angerÏand€she€was€likely€to€become€volatile€again€in€similar€situations.€ÌÌà ` àThe€district€attorney€general€also€based€his€decision€to€deny€the€requestÏfor€pretrial€diversion€on€Appellantððs€attitude.€€Specifically,€the€district€attorneyÏgeneral€found€that€Appellant€had€continued€to€trivialize€the€harm€she€had€doneÏwhile€committing€the€offenses€in€this€case.€€Indeed,€Appellant€testified€that€otherÏthan€scaring€him,€she€did€not€harm€Mr.€Lane€during€the€incident€in€question.€ÏAppellant€also€placed€the€blame€on€the€victim€by€testifying€that€the€only€reasonÏthe€incident€happened€was€because€of€the€actions€of€Mr.€Lane.€€In€addition,€afterÏobserving€Appellantððs€demeanor€and€listening€to€her€testimony,€the€trial€courtÏstated€that€Appellant€was€ð ðvery€bitter,ðð€ð ðvery€vindictive,ðð€ð ðfilled€with€anger,ðð€andÏð ðfilled€with€resentment€and€hostility.ðð€ÌÌà ` àFinally,€the€district€attorney€general€determined€that€justice€would€not€beÏserved€by€granting€pretrial€diversion€in€this€case.€€First,€the€district€attorneyÏgeneral€determined€that€if€pretrial€diversion€was€granted€in€this€case,€it€wouldÏcreate€the€impression€that€crimes€involving€domestic€violence€are€not€treatedÏseriously.€€Second,€the€district€attorney€general€determined€that€justice€would€notÏbe€served€by€rewarding€a€defendant€who€was€given€information€about€how€to€useÏlawful€means€to€resolve€a€problem€and€then€rejected€those€lawful€means€andÏresorted€to€violence.ñ1ñ׃×ñ1ññ1ñ׃×ñ1ñÝ
