Furthermore,  thepetitioner  alleged  that  the F$# instantpetition  ishissecondpetitionforwritofhabeascorpus.However,thepetitionerhasfailedtofileandattach  acopyofhisfirstpetition,norhasheattachedcopiesof  theresultsofanyevidentiaryhearings,theresultsofanyactionofthetrialcourtastothemeritsofthefirst  petition,or  anydirectappeals  thatwere  taken. ` TheDavidsonCountygrandjury  indicted  the  petitioner  underthenameofWilliamLee  Drumbargerfor  fivecountsofaggravatedrapeoffivedifferentboys,  ages7through    10,  and  onecountofaggravated  sexualbatteryofasixthboy,11yearsofage.Theindictments  alleged  atimespanfromOctober,1981throughJanuary,1982.Ajuryfoundthepetitionerguiltyofallchargesandfixedhispunishmentat  lifefor  each  of  theaggravatedrapesandthirtyfiveyearsfortheaggravatedsexualbattery.Thetrialcourtorderedthesentencestobeservedconcurrently.Ondirectappeal,thisCourtaffirmedthe 9&5; convictions.Statev.WilliamLeeDrumbarger,No . 83141111(Tenn.Crim.App.,  Nashville,March22,1985),per.app.denied(Tenn.1985). p  ` Thepetitionercontendstheindictmentsarevoidinthattheterm sexualpenetrationasusedintheindictmentsdidnotclearlystate inordinaryandconciselanguageexactlywhatsexualpenetration  entails,  sothata personofcommonunderstandingwillknowwhatisintended.Althoughthestatutedefines fellatioassexualpenetration,thepetitionercontendsthathedidnotcommitaggravatedrape,sincethepetitionerperformedfellatioonthevictims,thustherewasnopenetration.   ` ThetrialcourtdismissedthepetitiononthebasisthatthepetitionerfailedtocomplywithTenn.CodeAnn. XXX X# XXX Xi#Ԁ2921107,whichmandatesthatthepetitionerattachacopyofthe 0 judgmentofconvictionstohispetition.Initsbrief,thestateagreeswiththepetitionerthat,althoughtheformattachedtothepetitionforhabeascorpusisadifferentformthanthatiscurrentlyusedbythecourts,thejudgmentformattachedbythepetitioneristhecorrectformforajudgmentin1983andisstillvalidtoday.Therefore,thestatecontendsthatthepetitionerisbeinglegallydetained.However,regardlessofthecorrectnessoftheform,thestatearguesthatthepetitionerhasnotshownthatthejudgmentitselfisvoid,whichisaprerequisitetoobtaininghabeascorpusrelief.     ` It  isawellestablishedprincipleoflawthattheremedyofhabeascorpusislimitedinnatureanditsscope.Archerv.State,851S.W.2d157,16162(Tenn.1993).In -@), Tennessee,habeascorpusreliefisavailableonlyif itappearsuponthefaceofthejudgmentortherecordoftheproceedingsuponwhichthejudgmentisrenderedthataconvictingcourtwaswithoutjurisdictionorauthoritytosentenceadefendant,orthatadefendantssentenceofimprisonmentorotherrestrainthasexpired.
