ThisCourthaspreviouslyheldthatthe1989SentencingReformActwhichrepealedthehabitualcriminalstatutehasnoeffectondefendantsorderedtoservelifesentencespriortoNovember1,1989,notingthat theactwhichrepealedthehabitualcriminalstatutecontainsthefollowinglanguage:[t]hisactshallnotaffectrightsanddutiesthatmatured,penaltiesthatwereincurred,orproceedingsthatwerebegunbeforeitseffectivedate.Statev.Russell,866S.W.2d578,581(Tenn.Crim.App.1991).SeealsoStateexrel.StewartV.McWherter,857S.W.2d875,877(Tenn.Crim.App.1992)( thechangesinsentencingwroughtbythe1989SentencingActorbyanyotheractafterthepetitionerssentenceswereimposedwouldnotaffectthosesentencesbecausetheywerepenaltiesalreadyincurred.)Accordingly,thepetitionersconvictionisnotvoid,norhashissentenceexpired.Heisthereforenoteligibleforhabeascorpusrelief.Passarellav.State,891S.W.2d619,626(Tenn.Crim.App.1994).
