Afterreviewingtherecord,weaffirmthetrialcourtsjudgmentpursuanttoRule20,Tenn.Ct.Crim.App.R. Theappellant,thenawaitressatarestaurantinCookeville,leftworkatapproximately1:30a.m.onthemorningofFebruary19,1995.ShethendrovetotheFiveOaksClubwhichislocatedinWhiteCountytosocializewithfriends.Theappellanttestifiedthat,between2a.m.and3:30a.m.,sheconsumedtwobeers.ShethenlefttoreturntoherhomeinBaxter.Apparently,missingherturn,theappellantfoundherselfinAlgood.DetectiveAllenoftheAlgoodPoliceDepartmentobservedtheappellantmakea realwideturn.Theofficerfollowedtheappellantforapproximatelyonehalfmile.Duringthattime,heobservedtheappellantcrossthedoubleyellowlineontheroadwayabouteightorninetimes.Oncesheswervedcompletelyontotheoppositesideoftheroadway.Uponreachingtheparkinglotofasupermarket,theofficerproceededtostoptheappellantsvehicle.Asheapproachedhercar,hewasabletodetectastrongodorofalcoholfromwithin.DetectiveAllennoticedthatsheslurredherspeechandhereyeswere glassy.Theappellantadmittedthatshehadconsumedtwobeers.Heaskedhertotakethreefieldsobrietytests;shefailedtwoandrefusedtoperformonestatingthatshehadabackinjurywhichpreventedherfromstandingononefoot.TheappellantwasarrestedandtransportedtothePutnamCountyJail.Whenthetwoarrivedatthejail,theofficerexplainedtheimpliedconsentlawtotheappellant.Shethensignedtheimpliedconsentformandtookabloodalcoholtest.TheIntoximeter3000failedtoperformproperlyduringthefirstthreeattempts,registeringa.00.Onthefourthattempt,at5:16a.m.,theappellantsbloodalcohollevelregisteredas.10percent. Followingherconviction,thetrialcourtimposedasentenceof11monthsand29dayswithalltimesuspendedexceptforsixtydaysinthecountyjail.Inaddition,theappellantwasfined$500pluscourtcosts. Whenreviewingatrialcourtsjudgment,theappellatecourtwillnotdisturbaverdictofguiltunlessthefactsoftherecordandinferenceswhichmaybedrawnfromitareinsufficientasamatteroflawforarationaltrieroffacttofindthedefendantguiltybeyondareasonabledoubt.Tenn.R.App.P.13(e);Statev.Tuggle,639S.W.2d913,914(Tenn.1982).Inotherwords,thiscourtwillnotreevaluateorreweightheevidencebroughtoutattrial.Itispresumedthatthejudgeorjuryhasresolvedallconflictsinthetestimonyanddrawnallreasonableinferencesfromtheevidenceinfavorofthestate.SeeStatev.Sheffield,676S.W.2d542,547(Tenn.1984);Statev.Cabbage,571S.W.2d832,835(Tenn.1978);Statev.Grace,493S.W.2d474,476(Tenn.1973).Sinceaverdictofguiltremovesthepresumptionofadefendantsinnocenceandreplacesitwithapresumptionofguilt,thedefendanthastheburdenofproofonthesufficiencyoftheevidenceattheappellatelevel.Grace,493S.W.2dat476.  Theelementsofdrivingundertheinfluenceare:(1)drivingorbeinginphysicalcontrolofamotorvehicle(2)uponapublicthoroughfarewhile(3)undertheinfluenceofanintoxicantordrug.Tenn.CodeAnn.5510401(1993June16,1997Repl.);Statev.Ray,563S.W.2d454,459(Tenn.Crim.App.1988).Theoffenseofdrunkdrivingmaybeestablishedbycircumstantialevidence.Statev.Gilbert,751S.W.2d454,459(Tenn.Crim.App.1988).Inthiscase,theappellantchallengesonlythefindingthatshewasundertheinfluenceofanintoxicantatthetimeofherarrest.Baseduponcarefulconsiderationoftheevidence,thejuryfoundthattheappellantwasundertheinfluenceofalcohol.Weagree.Theevidenceintherecordbeforeusamplysupportstheappellantsconvictionfordrivingundertheinfluence.
