ABradleyCountyCriminalCourtjuryfoundAppellantTremaileMaloneguiltyofrape.AsaRangeIstandardoffender,hereceivedasentenceofeightyearsintheTennesseeDepartmentofCorrection.Inthisdirectappeal,Appellantpresentsthefollowingissuesforreview:(1)whetherthetrialcourterredinrefusingtograntamistrialfollowingtheStatesuseofaperemptorychallengetoremoveanAfricanAmericanfromthejurypool;and(2)whetherthetrialcourterredinexcludingevidenceofthevictimspriorsexualconduct. Afterareviewoftherecord,weaffirmthejudgmentofthetrialcourt.   I.FACTUALBACKGROUND    Asaccreditedbythejurysverdict,theproofshowsthat,onSeptember12,1994,N.W., '   ׀asixteenyearoldfemale,wenttotheBachmanHomeforthepurposeofvisitingJosephTillman.Whilethere,shewasgangrapedbyAppellant,AnthonyComer,andJabarrSimpson. OnDecember14,1994,aBradleyCountyGrandJuryindictedAppellantfortwocountsofaggravatedrape,bothinviolationofTennesseeCodeAnnotatedSection3913502(a)(3)(A).OnApril12,1995,Appellantfiledamotiontointroduceevidenceofthevictimspriorsexualconduct.Themotionwasdenied. OnMay24and25,1995,AppellantwastriedbeforeajuryintheBradleyCountyCriminalCourt.Duringthejuryselectionphaseofthetrial,theStateexercisedaperemptorystriketoremoveanAfricanAmericanfromthejurypool.Inresponse,defensecounselmadeamotionforamistrial,arguingthattheStatesactionwasraciallymotivated.Themotionwasdenied. Attheconclusionofthetrial,thejuryfoundAppellantguiltyofonecountofrapeinviolationofTennesseeCodeAnnotatedSection3913503(a)(1).FollowingasentencinghearingonJuly3,1995,thetrialcourtimposedasentenceofeightyears.   II.PEREMPTORYCHALLENGES    AppellantfirstallegesthatthetrialcourterredinrefusingtograntamistrialfollowingtheStatesuseofaperemptorychallengetoremoveanAfricanAmericanfromthejurypool.AppellantarguesthattheStatesdecisiontostrikethisprospectivejurorwasmadeonthebasisofrace. TheexerciseofaperemptorychallengeforpurelyracialreasonsviolatestheEqualProtectionClauseoftheFourteenthAmendment.Batsonv.Kentucky,476U.S.79,89(1986);Statev.Jones,789S.W.2d545,548(Tenn.1990).However,thedismissalofoneormoreAfricanAmericanjurors,withoutmore,isnotunconstitutional.Statev.Bell,759S.W.2d651,653(Tenn.1988).Thedefendantmustpresentaprimafaciecaseofracialdiscriminationbyshowingthatthetotalityoftherelevantfactsgivesrisetoaninferenceofadiscriminatorypurpose.Batson,476U.S.at9394.Oncethedefendantsatisfactorilypresentsaprimafaciecaseofdiscriminatorypurpose,theburdenshiftstotheprosecutiontoprovidearational,raceneutralexplanationfortheexerciseoftheperemptorychallenge.Id.at94. Here,AppellantreliesentirelyupontheStatesperemptoryremovalofoneAfricanAmericanfromthejurypoolasevidenceofanunfairdiscriminatorypractice.Wedonotbelievethatthisincident,standingalone,issufficienttomakeoutaprimafaciecaseofdiscrimination,especiallyinlightofthefactthattheStatedeclinedtouseitsfinaltwoperemptorychallengestoremovetwootherAfricanAmericansfromthejurypool.SeeStatev.Brown,915S.W.2d3,8(Tenn.Crim.App.1995).Moreover,theStateofferedthefollowingrational,raceneutralexplanationfortheexerciseofitsperemptorychallenge.Theassistantdistrictattorneysaidofthechallengedjuror:   ` `  ` Heseemedbored,notattentive.Hisfacialexpressionsmadehimlooklikeheresentedbeinghere,thathedidntreallywanttobehere.   `    Thetotalityofthecircumstancesindicatethatthisperemptorychallengewasnotexercisedtofurtheradiscriminatorypurpose.SeeStatev.Bibbs,806S.W.2d786,78990(Tenn.Crim.App.1991).Thus,weconcludethatthetrialcourtproperlydeniedamistrial.   III.PRIORSEXUALCONDUCTOFTHEVICTIM    Appellantalsoallegesthatthetrialcourterredinexcludingevidenceofthevictimspriorsexualconduct.AppellantmaintainsthatthefollowingspecificinstancesofN.W.sallegedconductestablishapatternofsexualbehaviortendingtoprovethatsheconsentedtothesexualencounterinquestion:   ` `  `  (1)attheageoftwelve,N.W.hadconsensualsexwithatwentyyearoldandlaterclaimedthatitwasaggravatedrape; (2)duringthecourseofthepastthreeyears,N.W.hashadnumeroussexualencounterswithmenandadmitstobeingextremelysexuallyactive; (3)onMay16,1994,N.W.claimstohavebeenrapedbyafriend;and (4)N.W.hasanongoingsexualrelationshipwithvariousblackdrugdealers.   `     TheTennesseeRulesofEvidenceprovideasfollows: `   `  `  (c)Specificinstancesofconduct.Evidenceofspecificinstancesofavictim'ssexualbehaviorisinadmissibleunlessadmittedinaccordancewiththeproceduresinsubdivision(d)ofthisrule,andtheevidenceis: (1)RequiredbytheTennesseeorUnitedStatesConstitution,or (2)Offeredbythedefendantontheissueofcredibilityofthevictim,providedtheprosecutororvictimhaspresentedevidenceastothevictim'ssexualbehavior,andonlytotheextentneededtorebutthespecificevidencepresentedbytheprosecutororvictim,or (3)Ifthesexualbehaviorwaswiththeaccused,ontheissueofconsent,or (4)Ifthesexualbehaviorwaswithpersonsotherthantheaccused,  (i)torebutorexplainscientificormedicalevidence,or  (ii)toproveorexplainthesourceofsemen,injury,disease,orknowledgeofsexualmatters,or  (iii)toproveconsentiftheevidenceisofapatternofsexualbehaviorsodistinctiveandsocloselyresemblingtheaccused'sversionoftheallegedencounterwiththevictimthatittendstoprovethatthevictimconsentedtotheactchargedorbehavedinsuchamannerastoleadthedefendantreasonablytobelievethatthevictimconsented.   `    Tenn.R.Evid.412(c)(emphasisadded).Inordertointroducesuchevidence,thedefendantmustfileawrittenmotiontendayspriortotrial,accompaniedbyanofferofproofdescribingthespecificevidenceandthepurposeforintroducingit.Id.412(d)(1). Here,Appellantfiledatimelypretrialmotionbutfailedtomakeanofferofproofthateffectivelysubstantiatedhisallegations,asrequiredbyRule412(d)(1)(iii).Cf.Statev.Sheline,No.03C019505CR00141,1996WL325913,at*12(Tenn.Crim.App.June14,1996),perm.app.granted,(Tenn.Jan.6,1997)(thedefendantsubstantiatedhisallegationsbypresentingtestimonyfromindividualswhohadengagedinsexualrelationswiththevictim).Thetrialcourtconcludedthattheprofferedinstancesofsexualconductconstituted nothingmorethanjustvagueallegations...thatcannotbesupported.Weagree.InlightofAppellantsconcession,bothinhiswrittenmotionandduringpretrialdiscussions,thathecouldprovideneitherproofoftheseallegationsnorthenamesofthoseinvolved,wedonotbelievethathehassatisfactorilycompliedwithsubsection(d)ofRule412.Furthermore,therecorddoesnotclearlydemonstratethattheprobativevalueofsuchevidenceoutweighsitsprejudicialeffect.SeeTenn.R.Evid.412(d)(4);seealsoStatev.Stamps,No.02C019301CC00002,1994WL59451,at*8(Tenn.Crim.App.Mar.2,1994),perm.app.denied,(Tenn.July18,1994).Thus,weconcludethatthetrialcourtactedproperlyinexcludingtheseallegedinstancesofN.W.spriorsexualconduct.
