àÌà àOn€March€23,€1988,€upon€the€motion€of€defense€counsel,€the€trial€courtÏordered€an€evaluation€of€the€appellantððs€competency€to€stand€trial€and€hisÏmental€condition€at€the€time€of€the€alleged€offenses.€€On€April€18,€1988,€theÏJohnson€Mental€Health€Center€advised€defense€counsel€and€the€State€that€theÏappellant€was€competent€to€stand€trial€and€that€a€defense€of€insanity€œcould€notÏbe€supported.›€€On€the€same€day,€the€appellant€pled€guilty€to€the€chargedÏoffenses.€€On€April€2,€1991,€the€appellant€filed€a€petition€for€post„convictionÏrelief.ÌÌà àOn€May€23,€1994,€the€post„conviction€court€conducted€an€evidentiaryÏhearing€for€the€purpose€of€addressing€the€appellantððs€œclaims.›€€At€the€hearing,Ïthe€appellant€testified€that,€at€the€time€of€his€guilty€pleas,€he€was€receivingÏtreatment€at€Fortwood€Mental€Health€Center,€including€medication.€€He€furtherÏtestified€that€the€ð ðmedication€...€affected€[his]€thought€processðð€during€the€guiltyÏplea€proceeding.€€Moreover,€according€to€the€appellant,€he€attempted€to€commitÏsuicide€during€his€pre„trial€detention€in€the€Hamilton€County€Jail.× à[A]€court€charged€with€determining€whether€...€pleas€wereÏððvoluntaryðð€and€ððintelligentðð€must€look€to€various€circumstantialÏfactors,€such€as€the€relative€intelligence€of€the€defendant,€theÏdegree€of€his€familiarity€with€criminal€proceedings,€whether€he€wasÏrepresented€by€competent€counsel€and€had€the€opportunity€toÏconfer€with€counsel€about€the€options€available€to€him;€the€extentÏof€advise€from€counsel€and€the€court€concerning€the€chargesÏagainst€him;€and€the€reasons€for€his€decision€to€plead€guilty,Ïincluding€a€desire€to€avoid€a€greater€penalty€that€might€result€fromÏa€jury€trial.ÌÓÓÌòòState€v.€Blankenshipóó,€858€S.W.2d€897,€904€(Tenn.€1993).ÌÌà àAgain,€the€transcript€of€the€guilty€plea€hearing€affirmatively€establishesÏthe€validity€of€the€appellantððs€pleas€or,€at€least,€strongly€suggests€that€theÏappellantððs€pleas€were€knowing€and€voluntary.€€At€the€guilty€plea€hearing,€theÏappellantððs€answers€to€the€courtððs€questions€were€coherent€and€responsive.€ÍMoreover,€as€noted€earlier,€the€appellant€informed€the€trial€court€at€the€hearingÏthat€he€was€not€under€the€influence€of€any€medication€or€drugs€that€wouldÏinterfere€with€his€ability€to€enter€a€knowing€and€voluntary€plea.€€Again,€theÏtranscript€of€the€hearing€reflects€that€the€appellant€discussed€the€pleaÏarrangement€with€his€lawyers€on€numerous€occasions.€€He€had€also€discussedÏhis€decision€with€his€mother,€who€accompanied€the€appellant€at€the€hearing.€ÏMoreover,€the€appellantððs€medical€records€consistently€characterize€theÏappellant€as€ð ðalert€and€oriented€in€all€spheres.ðð€€Indeed,€the€records€reflect€that,Ïfollowing€the€guilty€plea€hearing,€the€appellant€discussed€the€disposition€of€hisÏcase€with€medical€personnel,€expressing€relief€that€he€had€escaped€the€deathÏpenalty.€€In€summary,€the€bare€assertions€of€the€appellant€at€the€post„convictionÏhearing€that€he€did€not€knowingly€and€voluntarily€plead€guilty€are€not€sufficientÏto€carry€his€burden€of€proof.€€òòBrown€v.€Stateóó,€No.€03C01„9107„CR„00233€(Tenn.ÏCrim.€App.€at€Knoxville),€òòperm.€to€appeal€deniedóó,€(Tenn.€1992)(citing€òòMcBeeóó,Ï655€S.W.2d€at€195).ÌÌà àAgain,€there€is€virtually€no€evidence€in€the€record€that€the€appellantððsÏmental€state€or€his€medication€interfered€with€his€ability€to€knowingly€andÏvoluntarily€plead€guilty.€€Again,€trial€counsel€at€the€post„conviction€hearingÏindicated€that,€at€the€time€of€the€guilty€plea€hearing,€he€had€œpursued›€informationÏconcerning€the€appellantððs€psychological€history€and€œobtained›€a€mentalÏevaluation€of€the€appellant.€€He€had€reviewed€the€results€of€the€evaluation,Ïperformed€by€the€Johnson€Mental€Health€Center.€€He€had€fully€advised€theÏappellant€of€his€options,€which€included€pleading€guilty€to€the€charged€offenses,Ïand,€indeed,€had€enlisted€the€aid€of€members€of€the€appellantððs€family€inÍensuring€the€appellantððs€understanding.€€We€cannot€conclude,€based€upon€theÏrecord€before€this€court,€that€counselððs€representation€was€deficient.̛̜Ìà
