àThe€Defendant,€Larry€Massey,€appeals€as€of€right€pursuant€to€Rule€3,ÏTennessee€Rules€of€Appellate€Procedure.€€œHe€pleaded›€guilty€on€August€7,€1995Ïto€theft€of€property€over€œone€thousand€dollars€($1000)× ƒ, ××  ×€and›€was€granted€judicialÏdiversion€pursuant€to€Tennessee€Code€Annotated€section€40„35„313.€€€He€wasÏto€serve€four€years€on€probation€and€pay€restitution€of€œfifteen€hundred€dollarsÏ($1500)›€to€the€victim€and€œtwo€thousand€dollars€($2000)›€in€fines€and€court€costs.€ÏUpon€the€successful€completion€of€the€terms€of€his€probation,€the€charges€œwereÏto€be›€dismissed€and€his€record€expunged.€€After€a€hearing€on€January€16,€1996,Ïthe€trial€court€revoked€his€probation€and€ordered€four€years€of€supervisedÏprobation€with€120€days€to€be€served€in€the€county€jail,€œfifteen€hundred€dollarsÏ($1500)›€restitution€and€œtwo€thousand€dollars€($2000)›€œin€fines›€and€court€costs.€ÏThe€Defendant€presents€two€œissues€in€this€appeal:›€(1)€That€the€trial€court€erredÏin€revoking€his€probation;€and€(2)€that€the€trial€court€erred€in€ordering€him€to€serveÏ120€days€incarcerated.€€We€affirm€the€judgment€of€the€trial€court.ÌÌà àThe€Defendant€was€charged€with€theft€of€property€over€œone€thousandÏdollars€($1000)›€after€he€received€a€check€for€œfifteen€hundred€dollars€($1500)›€forÍwork€he€was€scheduled€to€do.€€He€testified€that€he€builds€custom€waterfalls€andÏhad€contracted€to€construct€one€for€the€victim.€€He€never€completed€the€work€andÏthis€criminal€action€was€filed.€€He€was€granted€judicial€diversion€and€hisÏprobation€was€later€revoked€because€of€several€violations€of€the€probationaryÏterms.€€He€contends€that€the€trial€court€erred€in€revoking€his€probation.à àà àà àÓíÓÌÌà àBoth€the€granting€and€denial€of€probation€rest€in€the€sound€discretion€ofÏthe€trial€judge.€€òòState€v.€Mitchellóó,€810€S.W.2d€733,€735€(Tenn.€Crim.€App.€1991).€ÏMoreover,€the€trial€judge€has€the€discretionary€authority€to€revoke€probation€if€aÏpreponderance€of€the€evidence€establishes€that€a€defendant€violated€theÏconditions€of€his€probation.€The€trial€judge€must,€however,€adduce€sufficientÏevidence€during€the€probation€revocation€hearing€to€allow€him€to€make€anÏintelligent€decision.€€òòIdóó.€€The€determination€made€by€the€trial€court,€if€made€withÏconscientious€judgment,€is€given€the€weight€of€a€jury€verdict€and€entitled€toÏaffirmance.€€òòStamps€v.€Stateóó,€614€S.W.2d€71,€73€(Tenn.€Crim.€App.€1980).Ì€€€Ìà àWhen€a€probation€revocation€is€challenged,€the€appellate€courts€have€aÏlimited€scope€of€review.€€For€an€appellate€court€to€be€warranted€in€finding€a€trialÏjudge€erred€in€determining€that€a€violation€has€occurred,€it€must€be€establishedÏthat€the€record€contains€no€substantial€evidence€to€support€the€conclusion€of€theÏtrial€judge.€òòState€v.€Harkinsóó,€811€S.W.2d€79,€82€(Tenn.€1991).€If€the€violation€isÏso€supported€by€the€record,€the€judgment€of€the€trial€court€revoking€probation€willÍnot€be€disturbed€on€appeal€unless€it€appears€that€the€trial€court€acted€arbitrarilyÏor€otherwise€abused€its€discretion.€€òòState€v.€Williamsonóó,€619€S.W.2d€145,€146Ï(Tenn.€Crim.€App.€1981).ÌÌà àThe€State€presented€evidence€that€the€Defendant€had€violated€severalÏprovisions€of€his€probation.€€James€Holder,€his€probation€officer,€testified€at€theÏhearing.€€Holder€stated€that€the€Defendant€was€required€to€meet€face„to„faceÏwith€him€and€had€done€so€except€for€the€month€of€November,€1995.€€TheÏDefendant€spoke€with€him€several€times€by€phone,€but€never€had€the€requiredÏmeeting.€€The€Defendant€did€meet€with€Holder€on€December€5,€1995.ÌÌà àHolder€also€learned€that€the€Defendant€had€been€arrested€on€a€badÏcheck€charge€and€did€not€inform€him€of€the€arrest.€€€Holder€testified€that€he€wasÏrequired€to€report€any€arrests€immediately.€€There€was€also€evidence€that€theÏDefendant€had€changed€his€address€and€not€told€his€probation€officer.€€InÏaddition,€he€had€paid€nothing€toward€his€required€restitution€or€for€the€œfines›€andÏœcourt€costs.›€€Finally,€there€was€evidence€that€the€Defendant€was€in€arrears€inÏthe€amount€œof€eighteen€thousand€seven€hundred€ninety„five€dollars›€œ($18,795)›€forÏchild€support.€€He€had€recently€paid€œtwenty„one€hundred€dollars€($2100)›€in€childÏsupport.€€He€had€been€held€in€criminal€contempt€for€failure€to€pay€and€posted€aÏcash€bond€œof€two€thousand€dollars›€œ($2000)›€with€money€he€borrowed€from€hisÏsister€to€avoid€going€to€jail.ÌÌà àThe€Defendant€testified€and€offered€reasons€for€his€failure€to€abide€by€theÏprobationary€terms.€€He€explained€that€he€became€severely€ill€with€CrohnððsÏdisease€in€November,€1995€and€was€hospitalized€for€nine€days.€€He€stated€thatÏthis€prevented€him€from€meeting€with€the€probation€officer.€€He€stated€that€hisÏillness€had€prevented€him€from€working€and€thus,€he€could€not€pay€any€of€theÏmoney€due€the€court.€€œHe›€also€œsaid€that›€he€did€not€report€his€arrest€because€heÏwas€waiting€to€inform€his€probation€officer€in€person.€€The€Defendant€allegedÏthat€he€made€payments€of€restitution€and€court€costs,€but€neither€he€nor€the€courtÏhad€a€record€of€any€payments.€€He€testified€that€he€sold€his€home€and€moved€inÏwith€his€sister€to€make€it€more€feasible€to€make€payments.€€œHowever,€noÏpayments€had›€been€received€œafter›€he€moved.ÌÌà àThe€trial€court€determined€that€the€evidence€supported€a€finding€that€theÏDefendant€had€violated€the€terms€of€his€probation.€The€trial€judge€acknowledgedÏthat€the€Defendant€had€been€disabled€by€his€illness€and€this€made€it€difficult€toÏmake€payments.€€However,€she€noted€that€there€was€no€evidence€of€anyÏpayments€to€the€court€although€the€Defendant€had€some€income€and€was€ableÏto€secure€funds€for€other€purposes.€€It€was€apparent€that€the€Defendant€failedÏto€make€his€meeting€in€November,€failed€to€report€a€new€arrest,€and€failed€toÏreport€his€new€address.€€We€cannot€conclude€that€the€trial€judge€abused€herÏdiscretion€in€revoking€the€Defendantððs€probation.ÌÌà àThe€Defendant€also€asserts€that€the€trial€court€erred€in€ordering€him€toÏserve€120€days€in€jail,€and€argues€that€straight€probation€is€the€proper€sentenceÏin€this€case.€€€When€an€accused€challenges€the€length,€range,€or€the€manner€ofÏservice€of€a€sentence,€this€court€has€a€duty€to€conduct€a€òòdeóó€òònovoóó€review€of€theÏsentence€with€a€presumption€that€the€determinations€made€by€the€trial€court€areÏcorrect.€€Tenn.€Code€Ann.€ðð€40„35„401(d).€€This€presumption€is€"conditionedÏupon€the€affirmative€showing€in€the€record€that€the€trial€court€considered€theÏsentencing€principles€and€all€relevant€facts€and€circumstances."€€òòState€v.€Ashbyóó,Ï823€S.W.2d€166,€169€(Tenn.€1991).ÌÌà àIn€conducting€a€de€novo€review€of€a€sentence,€this€court€must€consider:Ï(a)€the€evidence,€if€any,€received€at€the€trial€and€the€sentencing€hearing;€(b)€theÏpresentence€report;€(c)€the€principles€of€sentencing€and€arguments€as€toÏsentencing€alternatives;€(d)€the€nature€and€characteristics€of€the€criminal€conductÏinvolved;€(e)€any€statutory€mitigating€or€enhancement€factors;€(f)€any€statementÏthat€the€defendant€made€on€his€own€behalf;€and€(g)€the€potential€or€lack€ofÏpotential€for€rehabilitation€or€treatment.€€Tenn.€Code€Ann.€Ô€%XÔððððÔ€%ŠÔ€40„35„102,€„103,Ïand€„210;€òòseeóó€òòState€v.€Smithóó,€735€S.W.2d€859,€863€(Tenn.€Crim.€App.€1987).ÌÌà àIf€our€review€reflects€that€the€trial€court€followed€the€statutory€sentencingÏprocedure,€imposed€a€lawful€sentence€after€having€given€due€consideration€andÍproper€weight€to€the€factors€and€principals€set€out€under€the€sentencing€law,Ïand€that€the€trial€court's€findings€of€fact€are€adequately€supported€by€the€record,Ïthen€we€may€not€modify€the€sentence€even€if€we€would€have€preferred€aÏdifferent€result.€€òòState€v.€Fletcheróó,€805€S.W.2d€785,€789€(Tenn.€Crim.€App.€1991).ÌÌà àA€defendant€who€ð ðis€an€especially€mitigated€or€standard€offenderÏconvicted€of€a€Class€C,€D,€or€E€felony€is€presumed€to€be€a€favorable€candidateÏfor€alternative€sentencing€options€in€the€absence€of€evidence€to€the€contrary.ðð€ÏTenn.€Code€Ann.€ðð€40„35„102(6).€€Our€sentencing€law€also€provides€thatÏð ðconvicted€felons€committing€the€most€severe€offenses,€possessing€criminalÏhistories€evincing€a€clear€disregard€for€the€laws€and€morals€of€society,€andÏevincing€failure€of€past€efforts€at€rehabilitation,€shall€be€given€first€priorityÏregarding€sentences€involving€incarceration.ðð€Tenn.€Code€Ann.€ðð€40„35„102(5).€ÏThus,€a€defendant€sentenced€to€eight€years€or€less€who€is€not€an€offender€forÏwhom€incarceration€is€a€priority€is€presumed€eligible€for€alternative€sentencingÏunless€sufficient€evidence€rebuts€the€presumption.€€However,€the€act€does€notÏprovide€that€all€offenders€who€meet€the€criteria€are€entitled€to€such€relief;€rather,€itÏrequires€that€sentencing€issues€be€determined€by€the€facts€and€circumstancesÏpresented€in€each€case.€€òòSeeóó€òòState€v.€Tayloróó,€744€S.W.2d€919,€922€(Tenn.ÏCrim.€App.€1987).€€ÌÌà àAdditionally,€the€principles€of€sentencing€reflect€that€the€sentence€shouldÏbe€no€greater€than€that€deserved€for€the€offense€committed€and€should€be€theÏleast€severe€measure€necessary€to€achieve€the€purposes€for€which€theÏsentence€is€imposed.€€Tenn.€Code€Ann.€ðð€40„35„103(3)€„€(4).€€The€court€shouldÏalso€consider€the€potential€for€rehabilitation€or€treatment€of€the€defendant€inÏdetermining€the€sentence€alternative.€€Tenn.€Code€Ann.€ðð€40„35„103(5).€€ÌÌà àThe€Defendant€was€convicted€of€theft€of€property,€a€Class€D€felony,€andÏwas€therefore€eligible€for€alternative€sentencing.€The€trial€court€sentenced€him€toÏfour€years€of€supervised€probation€with€120€days€to€be€served€in€the€county€œjail,Ïfifteen€hundred€dollars›€œ($1500)›€restitution€and€œtwo€thousand€dollars€($2000)›€forÏfines€and€court€costs.€€The€trial€court€found€one€mitigating€factor,€that€theÏDefendant€neither€caused€not€threatened€bodily€injury€in€the€commission€of€theÏoffense.€€Tenn.€Code€Ann.€ðð€40„35„113(1).€€The€court€also€applied€oneÏenhancement€factor,€that€the€Defendant€abused€a€position€of€private€trust.€ÏTenn.€Code€Ann.€ðð€40„35„114(15).€€He€was€sentenced€to€the€minimum€œtwo„yearÏsentence›€as€a€Range€I€œoffender,›€œall›€suspended€except€120€days.€€€€TheÏDefendant€does€not€contest€the€determination€of€the€sentence,€but€argues€thatÏhe€should€have€received€straight€probation.ÌÌà àHowever,€a€trial€court€may€consider€the€facts€and€circumstances€of€theÏcase€when€determining€alternative€sentences.€€The€trial€court€ordered€splitÍconfinement€for€the€Defendant€in€conformance€with€the€sentencing€principles.€ÏòòSeeóó€Tenn.€Code€Ann.€ðððð€40„35„104(c)(4);€40„35„306(a).€€The€trial€courtÏconsidered€that€the€Defendant€had€been€granted€judicial€diversion€and€failed€toÏcomply€with€the€terms€of€probation.€€The€Defendant€also€demonstrated€a€lack€ofÏcompliance€with€child€support€payments€as€well€as€œhaving€a›€new€arrest€forÏpassing€a€bad€check.€€She€noted€that€the€Defendant€had€a€history€ofÏcomplying€only€when€necessary€to€keep€him€out€of€jail.€€Thus,€the€trial€courtÏconcluded€that€in€order€to€avoid€depreciating€the€seriousness€of€the€offense,€œwithÏthe›€Defendantððs€past€failure€at€compliance€and€lack€of€rehabilitation,€a€term€ofÏconfinement€was€necessary.€€òòSeeóó€Tenn.€Code€Ann.€ðð€40„35„103(1)(B),(C),€(5).ÌÌà àThe€trial€court€gave€due€consideration€to€the€required€sentencing€principles.€ÏThe€sentence€imposed€by€the€trial€court€retains€a€presumption€of€œcorrectness.€ÏWe€do€not€find€anything€in€the€record€sufficient€to€warrant€reversal€of€the€trialÏcourtððs€judgment.€€This€issue€has€no€merit.ÌÌà
