ThetrialcourtenteredanorderonApril17,1996,permittingtelevisioncamerasinthecourtroomwithrestrictions.Stillcamerasweretobebannedfromthecourtroomduringtimeswhenthejurywaspresent.OnMay1,1996,thecourt,inasupplementalorder,heldthatitwouldconsideraplanforusingstillcamerasinthejuryspresenceiftheplan provide[d]fortheuseofstillcameraswithoutbeingseenorheardbythejury. TheNashvilleBanner,TheTennessean,andTheLeafChroniclefiledaϜTenn.R.App.P.10applicationcontestingthelimitationsontheuseofstillcameras. 1   כWegrantedtheapplicationonMay3,1996.Subsequently,thedefendant,throughnewlyappointedcounselforthemediacoverageissues,filedaRule10applicationopposinganytypeofincourtcameracoverage.Wegrantedhisapplication. ByorderdatedMay15,1996,thetrialcourtapprovedaplansubmittedbytheprintandelectronicmediaregardingincourtcamerauseduringthepresenceofthejuryinthecourtroom.Theplaninvolvestheconstructionofascreeninthecourtroomthroughwhichphotographsmaybetakenoutofsightofthejuryandwitnesses. OnMay16,1996,thisCourt,inaspecialpanel,heardargumentfromthestate,defendant,andmediaonthetrialcourtsorder.Weaffirm. SupremeCourtRule30providesforincourtmediacoverageattrialproceedings.Coverageissubject,atalltimes,totheauthorityofthejudgeto (i)controltheconductoftheproceedingsbeforethecourt;(ii)maintaindecorumandpreventdistraction;(iii)guaranteethesafetyofanyparty,witness,orjuror;and(iv)ensurethefairadministrationofjustice.Rule30(A)(1)and(D)(2).Further,Rule30(D)(2)allowsthetrialcourtuponapropershowingtolimitincourtmediacoverageinordertoaccommodateanyoftheseimportantinterests.Rule X 30(H)(2)contemplatesthatinappropriatecases,courtfacilitiesmaybealteredattheexpenseofthemediainorderprotecttrialparticipants,witnessesandjurorsfromdistractionorharmwhileallowingincourtcoverage. Here,thetrialcourtheldanevidentiaryhearing;however,themediawasnotallowedtocountertheevidencepresentedbythedefendantandthestate. 2   כMuchofthedefendantsandstatesevidenceatthehearingwasspecifictothiscaseanddealtwithjurorandwitnessconcernsaboutsafetyandthepotentiallynegativeeffectsofincourtmediacoverageonthebehaviorofwitnessesandjurors.Takingjudicialnoticeofthelayoutofthecourtroom,thejudgeconcludedthattheconfigurationofthetrialcourtroommadeitdifficultifnotimpossibletolocatecamerasunobtrusively.Finally,itisapparentthetrialjudgewasconcernedaboutthefactthatthisisadeathpenaltycasesubjecttoheightenedconcernsoffairnessandexactingreview. 3   כ Inmakingitsdecision,thecourtconsideredtheguidancewegaveinStatev.FreddieMorrow,No.01C019601CC00022,1996WL170679(Tenn.Crim.App.ϜApr.12,1996).WefindthatthecourtwascognizantofMorrowsholdingthatRule30presumptivelyentitlesthemediatoincourtcameracoverage.Thereis,Ϝhowever,substantialevidenceinthisrecordthatconcernsaboutsafetyanddistractionswarrantmakingthepresenceofincourtcamerasasinconspicuousaspossible.ThisevidencecoupledwiththephysicallimitationsofthecourtroomleadϜustoconcludethatthetrialjudgedidnotabusehisdiscretioninthedecisionshehasmadeinthishighlyprovocativetrial.Thejudgehasendeavoredtoaccommodatetheinterestsofallthepartiesinvolved;andontherecordbeforeus,thisCourtcannotfindanyabuseofdiscretioninthismatter. Theevidencedoesnotpreponderateagainstthefindingsofthetrialjudge.Noerroroflaw,whichisapparentinthisrecord,requiresthisCourtsreversalofthetrialjudgesactions.
