àÓÓAppellant€Jerry€L.€Mathews€was€convicted€of€a€single€count€ofÏaggravated€assault€arising€out€of€a€domestic€dispute€wherein€Mathews€shotÏand€wounded€his€son.€€Appellant€was€also€indicted€for€shooting€at€his€twoÏdaughters;€however,€he€was€acquitted€of€these€charges.€€For€the€singleÏaggravated€assault€conviction,€Appellant€was€sentenced€as€a€Range€IÏstandard€offender€to€three€(3)€years€in€the€Department€of€Correction.€€TheÏsentence€was€suspended€except€for€90€days€which€Appellant€was€ordered€toÏserve.ÌÌà àIn€this€appeal€Appellant€contendsÌÓÓà à1.à0 àthat€the€three€counts€of€the€indictment€charging€Appellant€withÏaggravated€assault€against€each€of€his€three€children€should€haveÏbeen€severed€and€tried€separately;€andÌà à2.à0 àthat€the€trial€court€erred€in€failing€to€grant€a€judgment€of€acquittalÏbased€on€a€claim€of€self„defense.ÌÓÓÌà àWe€find€both€of€these€claims€to€be€without€merit€and€affirm€the€conviction.ÌÌà àThe€record€reflects€that€on€May€9,€1994,€Appellant,€who€lived€with€hisÏwife€and€adult€children,€was€involved€in€an€argument€with€his€wife.€€WhenÏAppellantððs€son€Thomas€Mathews€intervened,€Appellant€called€his€son€outside.€ÏAs€the€two€men€exited€the€house,€Appellant€attempted€to€hit€Thomas€and€theÍpair€fell€off€the€porch.€€Thomas€landed€on€top€of€Appellant€and€began€hittingÏhim.€€Appellantððs€two€daughters€tried€to€break€up€the€fight€and€Thomas€did,€inÏfact,€stop€fighting.€€Although€Thomas€indicated€that€he€no€longer€wanted€to€fight,ÏAppellant€continued€to€goad€the€younger€man.€€Eventually,€Appellant€pulled€outÏa€gun€and€shot€his€son€in€the€back€as€Thomas€attempted€to€run€away.ÌÌà àAfter€the€shooting€Appellant€ran€to€the€end€of€the€driveway.€€When€hisÏtwo€daughters€asked€him€why€he€had€shot€their€brother,€Appellant€shot€at€eachÏone€of€them.€€He€then€ran€to€a€neighborððs€house€where€he€explained€he€hadÏgotten€into€a€fight€with€his€son€and€had€shot€the€younger€Mathews.€€TheÏneighbor€took€Appellant€to€his€sisterððs€residence€where€the€police€came€andÏobtained€the€weapon€used€in€the€shooting.€€Appellant€told€police€the€shootingÏhad€been€in€self„defense.ÌÌà@ àòòSeverance€of€OffensesóóÌà àJoinder€of€offenses€is€governed€by€Tenn.€R.€Crim.€P.€8(a)€and€(b)€whichÏprovide€as€follows:ÌÌÓÓà0 à€€(a)€€Mandatory€Joinder€of€Offenses.€„„€Two€or€more€offenses€shall€beÏjoined€in€the€same€indictment,€presentment,€or€information,€with€eachÏoffense€stated€in€a€separate€count,€or€consolidated€pursuant€to€Rule€13€ifÏthe€offenses€are€based€upon€the€same€conduct€or€arise€from€the€sameÏcriminal€episode€and€if€such€offenses€are€known€to€the€appropriateÍprosecuting€official€at€the€time€of€the€return€of€the€indictment(s),Ïpresentment(s),€or€information(s)€and€if€they€are€within€the€jurisdiction€of€aÏsingle€court.€€A€defendant€shall€not€be€subject€to€separate€trials€forÏmultiple€offenses€falling€within€this€subsection€unless€they€are€severedÏpursuant€to€Rule€14.Ìà0 àAppellant€maintains€that€the€three€counts€of€the€indictment€were€joinedÏpursuant€to€Rule€8(b),€i.e.€permissive€joinder.€€He€claims€that€the€evidence€of€theÏalleged€assault€on€the€daughters€would€not€be€admissible€in€a€trial€forÏaggravated€assault€of€the€son,€Thomas€Mathews.€€Thus,€Appellant€maintainsÍhe€was€entitled€to€a€severance€pursuant€to€Rule€14(b)(1).€€It€is€clear€howeverÏthat€the€three€aggravated€assault€charges€arose€out€of€the€same€criminalÏepisode€and€that€joinder€of€them€was€mandatory€under€Rule€8(a).€€ThereforeÏAppellant€was€entitled€to€a€severance€only€if€the€severance€was€necessary€toÏð ðpromote€a€fair€determination€of€the€defendantððs€guilt€or€innocence€of€eachÏoffense.ðð€€Tenn.€R.€App.€P.€14€(b)(2)(I).ÌÌà àThe€decision€of€whether€to€grant€a€severance€of€offenses€is€within€theÏsound€discretion€of€the€trial€judge€and€that€decision€will€not€be€reversed€unless€itÏappears€the€defendant€was€prejudiced€by€the€decision€to€try€the€chargesÏtogether.€€òòState€v.€Wisemanóó,€643€S.W.2d€354,€362€(Tenn.€Crim.€App.€1982);ÏòòState€v.€Porteróó,€No.€03„C01„9308„CR„00261,€1994€WL€115863,€at€*2€(Tenn.ÏCrim.€App.€Apr.€6,€1994),€òòpermóó.€òòto€appeal€deniedóó,€(Tenn.€1994).€€The€fact€thatÏAppellant€was€convicted€of€only€one€count€of€a€multi„count€indictment€isÏconvincing€evidence€that€he€suffered€no€prejudice€from€the€joinder€of€theÏoffenses.€€òòWisemanóó,€643€S.W.2d€at€363.€€There€is€therefore€no€abuse€ofÏdiscretion€found€in€this€record€with€regard€to€the€decision€to€deny€a€severance€ofÏoffenses.€€This€issue€is€without€merit.ÌÌà@ àòòSelf„DefenseóóÌÌà àAppellant€claims€that€the€trial€court€should€have€granted€him€a€judgment€ofÏacquittal€based€on€his€claim€of€self„defense.€€However,€a€judgment€of€acquittalÏis€proper€only€if€the€trial€judge€concludes,€after€reviewing€the€evidence€in€the€lightÏmost€favorable€to€the€State,€that€no€rational€trier€of€fact€could€have€found€theÏessential€elements€of€the€crime€beyond€a€reasonable€doubt.€€€òòState€v.€Culpóó,Ï891€S.W.2d€232,€235€(Tenn.€Crim.€App.€1994).ÌÌà àIn€the€instant€case,€Appellant€claimed€that€he€shot€his€son€in€self„defense.€€However,€the€Stateððs€evidence€was€to€the€effect€that€AppellantÏstarted€the€fight,€refused€to€break€it€off,€and€shot€his€son€in€the€back.€€UnderÏthese€circumstances,€the€question€of€self„defense€became€one€for€the€jury€toÏdetermine.€€òòSeeóó,€òòArterburn€v.€Stateóó,€391€S.W.2d€648,€653€(Tenn.€1965);€€òòState€v.ÏCliftonóó,€880€S.W.2d€737,€743€(Tenn.€Crim.€App.€1994).€€The€trial€judge€did€not€errÏin€allowing€this€conflicting€testimony€to€go€to€the€jury€which,€by€its€verdict,Ïaccredited€the€Stateððs€version€of€events.€€This€issue€is€also€without€merit.ÌÌà
