Havingreviewedthestatesmotioninlightofthepetitionersbriefandtherecordasawhole,weconcludethatthemotioniswelltakenandshouldbegranted.Indenyingthepetition,thetrialcourtrecognizedthatthisstateshabitualcriminalacthasbeendeclaredtobeconstitutionalinseveralcases.Seee.g.Stateexrel.Vesv.Bomar,376S.W.2d446(Tenn.1964);Glasscockv.State,570S.W.2d354(Tenn.Crim.App.1978).  Thetrialcourtalsofoundthatthepetitionerhadfailedtoshow uponthefaceofthejudgmentortherecordthattheproceedingsuponwhichthejudgment[was]renderedthat[the]convictingcourtwaswithoutjurisdictionorauthoritytosentence[thepetitioner]orthat[thepetitioners]sentenceofimprisonmentorotherrestrainthasexpired.SeeStatev.Archer,851S.W.2d157(Tenn.1993).Weagree.Theconvictingcourtinthiscasehadjurisdictionoverboththesubjectmatterandperson,andnothingintherecordbeforeusdemonstratesthattheconvictingcourtsactionswereunauthorized.Asnotedabove,thecourtsofthisstatehaveupheldtheconstitutionalityofthestatuteatissue.Neitherhasthepetitionershownthathissentencehasexpired.Thecourtbelowthereforecorrectlydeniedthepetitionertherequestedhabeascorpusrelief.  Thepetitioneralsoarguesforthefirsttimeonappealthatthereasonabledoubtinstructionprovidedduringhistrialwasconstitutionallyinfirm.Since,however,thepetitionerfailedtoraisetheissuebelow,thisCourtisprecludedfromconsideringitonappeal.SeeT.R.A.P.36(a).Nonetheless,thecourtsofthisstatehaveconsistentlyheldthattheinstructiononreasonabledoubtatissuehereisconstitutionallyvalid.Seee.g.Statev.Nichols,877S.W.2d722,734(Tenn.1994).
