AllpostconvictionreliefpetitionsfiledafterMay10,1995,aregovernedbythePostConvictionProcedureActof1995.Tenn.CodeAnn.4030201,CompilersNotes(Supp.1996).PostConvictionreliefmustbesought withinone(1)yearofthedateofthefinalactionofthehigheststateappellatecourttowhichanappealistakenor,ifnoappealistaken,withinoneyearofwhichthejudgmentbecamefinal....Tenn.CodeAnn.4030202(a)(Supp.1996). Here,theAppellantfiledhispetitionunderthe1995Actandtheoneyearstatuteoflimitationapplies.TheAppellantsjudgmentbecamefinalonoraboutMarch21,1995,butsincethenewPostConvictionActbecameeffectiveonMay10,1995,thelimitationsperioddidnotexpireuntilMay10,1996.TheAppellantspetitionwasfiledinAugust,1996,andis,therefore,barredbythestatuteoflimitations.
