TheindictmentcontainedintherecordbeforetheCourtreflectsthatthepetitionerwasoriginallychargedwithonecountoffelonymurderintheperpetrationofarobberyandonecountofrobbery.Therecordalsocontainsajudgmentsheetwhichindicatesthatthepetitionerwasconvictedoffirstdegreemurderandsentencedtolifeimprisonment.Beforeaverdictwasrenderedinthecase,however,thetrialcourtgrantedthestate'smotionforanolleprosequionthefelonymurdercountoftheindictment.Asthetrialcourtnotedatthehearingonthepetitioner'spetitionforpostconvictionreliefin1987,thecasewasthensubmittedtothejuryonthechargeofpremeditatedfirstdegreemurderandthelesserincludedgradesofhomicide.  Althoughtheindictmentchargingthepetitionerwithpremeditatedfirstdegreemurderisnotincludedintherecord,therecordclearlyreflectsthatthepetitionerwasconvictedoffirstdegreemurder.Thepetitionerevenacknowledgesthisfactinhispetitionforawritofhabeascorpus:"Petitionerandcodefendant...wereindictedbyaCockeCountyGrandJuryATNewport,TennesseeofFirstDegreeMurder/RobberyonCaseNumber4219....PetitionerwasfoundguiltyofFirstDegreeMurderbyjurytrialonFebruary1,1985inCaseNumber4219."  Thepetitionerbaseshispresentchallengetothejudgmentonanorderenteredbythetrialcourtamendinganallegedclericalerrorintheminutes.However,asthetrialcourtnotedinthehearingonthepetitionforpostconvictionrelief,theminutescorrectlystatethatthefelonymurderchargewasdismissedpursuanttothestate'smotiontonolleprosequi,andthatthecasewasproperlysubmittedtothejuryonthechargeofpremeditatedfirstdegreemurder.Thecourtfoundtherewasnoreasontoamendtheminutesandsuggestedthattheorderamendingtheminuteswasmistakenlyentered.  Thepetitionerinthepresentcasehasnotshownuponthefaceofthejudgmentortherecordoftheproceedingsuponwhichthejudgmentwasrenderedthattheconvictingcourtwaswithoutjurisdictionorauthoritytosentencethepetitionerorthatthepetitionerssentenceofimprisonmentorotherrestrainthasexpired.SeeStatev.Archer,851S.W.2d157,164(Tenn.1993).Theconvictingcourtinthiscasehadjurisdictionoverboththesubjectmatterandperson,andthejudgmentsheetclearlyreflectsthatthepetitionerwassentencedtolifeimprisonment.Thesentencehasnotexpiredandthecourtbelow,therefore,correctlydeniedthepetitionertherequestedhabeascorpusrelief.  Accordingly,havingreviewedtheentirerecordinlightofthepetitionersclaims,wecannotfindanyerrorcommittedbythetrialcourtindismissingthepetition.ItisthereforeORDEREDthatthestatesmotionisgranted.PursuanttoRule20oftheRulesoftheCourtofCriminalAppeals,weaffirmthetrialcourtsdismissalofthepetitionerspetitionforwritofhabeascorpus.  ItisFURTHERORDERED,uponreviewingtheentirerecordbeforethisCourt,andfinding,consistentwiththetrialjudge'srulingduringthehearingonthepetitionforpostconvictionreliefinthismatter,thattheminutesforCaseNumbers4211,4218and4219intheCircuitCourtforCockeCounty,Tennessee,atNewport,Friday,February1,1985,correctlyreflectthatCaseNumbers4211and4218weredismissedpursuanttothestate'smotionfornolleprosequi,andthatCaseNumber4219wasproperlysubmittedtothejuryuponwhichaconvictionforfirstdegreemurderwasreturnedasreflectedinthejudgmentforCaseNumber4219.ItisFURTHERORDEREDthattheorderenteredonNovember21,1985,inCaseNumbers4211,4218and4219,intheCircuitCourtforCockeCountyhasnoeffectuponthejudgmententeredagainstthepetitioner.TheClerkofthisCourtshallforwardacopyofthisordertotheClerkoftheCircuitCourtforCockeCountytobeincludedintherecordoftheabovereferencedcases.
