àThe€appellant,€Gregory€Lynn€McFadden,€was€convicted€by€a€jury€of€twoÏcounts€of€felonious€possession€of€cocaine€and€one€count€each€of€possession€ofÏmarijuana€and€drug€paraphernalia.€€In€this€appeal,€he€raises€two€œissues›€forÏreview:€€(1)€whether€the€evidence€is€sufficient€to€support€the€verdict,€and€(2)Ïwhether€the€trial€court€should€have€granted€a€mistrial€due€to€the€stateððs€allegedÏfailure€to€furnish€exculpatory€evidence€to€the€defense.€€We€affirm€theÏconvictions.ÌÌà àThe€testimony€at€trial€revealed€that€Captain€Coleman,€LieutenantÏCaldwell€and€Investigator€Holland€of€the€26th€Drug€Task€Force€were€workingÏthe€day€shift€in€the€Parkview€Courts€area€of€Jackson.€€This€area€of€town€wasÏpatrolled€frequently€due€to€numerous€complaints€of€"open„air"€drug€sales€andÍthe€number€of€violent€crimes€occurring€in€that€area.€€Coleman€and€the€otherÏofficers,€watching€from€an€unmarked€vehicle,€saw€a€man€standing€beside€aÏToyota€Tercel.€€The€subject€was€extending€his€hand€and€holding€what€appearedÏto€be€money.€€Someone€inside€the€Tercel€extended€his€hand€toward€the€œsubjectÏas€if€to€make€an€exchange.›ÌÌà àAs€the€officers€edged€closer,€the€subject€standing€beside€the€TercelÏspotted€them,€looked€back€œinto›€the€car€and€said€something€to€the€men€in€the€car.€ÏHe€immediately€straightened€up€and€tried€to€hide€the€money€in€his€hand.€€HeÏthen€walked€back€towards€his€own€vehicle.€€The€officers€accelerated€andÏstopped€the€œTercel.›€€ÌÌà àLt.€Caldwell€œpursued›€the€subject€who€had€walked€away.€€He€conducted€aÏpatdown€search€which€revealed€a€twenty€dollar€bill€but€no€drugs.€€The€subjectÏwas€interviewed€while€a€warrant€check€was€run€on€him.€€Caldwell€asked€him€ifÏhe€was€there€to€buy€or€sell€dope.€€At€a€jury„out€œhearing,›€Caldwell€said€that€theÏsubject€responded€that€he€did€not€know€what€Caldwell€was€talking€about.€ÏFinding€no€reason€to€hold€him,€Officer€Caldwell€allowed€him€to€leave.€€No€recordÏor€statement€was€taken€of€the€conversation€between€Caldwell€and€the€subject.€ÏCaldwell€testified€at€trial€that€he€did€not€remember€the€subjectððs€name.ÌÌà àCaptain€Coleman€approached€the€vehicle€and€asked€the€driver,€HermanÏJames,€to€step€out.€€Coleman€said€there€had€been€a€lot€of€movement€in€theÍvehicle€as€he€approached.€€The€other€occupants€were€John€James,€who€wasÏseated€in€the€front€passengerððs€side€and€the€appellant,€who€occupied€the€backÏseat.€€When€the€car€door€opened,€Coleman€immediately€saw€two€baggies€and€aÏcrack€pipe€situated€beside€the€passengerððs€seat.€€Coleman€also€saw€a€largerÏbag€containing€a€chunky€white€substance€and€a€bag€of€plant€material.€€BothÏbags€were€tied.€€None€of€the€subjects€had€drugs€on€them.€€ÌÌà àAfter€placing€the€three€individuals€under€arrest,€Coleman€looked€furtherÏin€the€back€floorboard€near€where€the€appellant€had€been€sitting.€€There€heÏfound€the€torn€corner€of€a€baggie€containing€two€smaller€chunks€of€crackÏcocaine.€€A€crack€pipe€was€found€on€appellantððs€person€following€a€patdownÏsearch.€€Approximately€thirty€dollars€was€also€found€inside€the€vehicle,€includingÏa€twenty€dollar€bill€on€Herman€James€and€another€ten€dollars€on€the€dashÏboard.€€Both€field€and€laboratory€tests€confirmed€that€the€substances€were€crackÏcocaine€and€marijuana.€ÌÌà àJohn€James€testified€that€he€and€co„defendant€Herman€James€wereÏgoing€to€town€to€purchase€kerosene.€€James€said€that€at€some€point€along€theÏway€they€œhad€stopped›€and€picked€up€the€œappellant,›€who€was€walking€down€theÏstreet.€€He€said€appellant€wanted€a€ride€out€into€the€country€to€his€motherððsÏhome.€€They€had€stopped€in€Parkview€Courts€to€visit€their€nieceððs€œhouse,›€thoughÏnone€of€them€knew€the€apartment€number.€€None€of€the€Tercelððs€occupants€livedÏin€Parkview€Courts.€€James€said€that€they€had€just€pulled€into€Parkview€CourtsÍwhen€they€were€approached€by€a€guy€they€called€Peewee.€€Peewee€saidÏsomething€to€Herman€James,€the€driver,€and€walked€back€to€his€vehicle.€€At€thatÏtime€the€undercover€officers€pulled€in€behind€them.€€James€said€that€he€did€notÏknow€how€the€drugs€got€there€and€that€he€ð ðdidnððt€see€no€dope.ðð€€ÌÌà@ àIÌà àIn€appellantððs€first€issue,€he€claims€that€the€evidence€was€insufficient€toÏsupport€his€convictions.€€In€a€sufficiency€of€the€evidence€challenge,€the€relevantÏquestion€on€appellate€review€is€whether,€after€viewing€the€evidence€in€the€lightÏmost€favorable€to€the€prosecution,€any€rational€trier€of€fact€could€have€found€theÏessential€elements€of€the€crime€or€crimes€beyond€a€reasonable€doubt.€€òòJacksonÏv.€Virginiaóó,€443€U.S.€307€(1979);€òòState€v.€Duncanóó,€698€S.W.2d€63€(Tenn.€1985);ÏT.R.A.P.€13(e).€€ÌÌà àIn€Tennessee,€great€weight€is€given€to€the€result€reached€by€the€jury€in€aÏcriminal€trial.€€A€jury€verdict€accredits€the€testimony€of€the€state's€witnesses€andÏresolves€all€conflicts€in€favor€of€the€state.€€òòState€v.€Williamsóó,€657€S.W.2d€405Ï(Tenn.€1983).€€Moreover,€a€guilty€verdict€replaces€the€presumption€of€innocenceÏenjoyed€at€trial€with€the€presumption€of€guilt€on€appeal.€€òòState€v.€Graceóó,€493ÏS.W.2d€474€(Tenn.€1973).€€The€appellant€has€the€burden€of€overcoming€theÏpresumption€of€guilt.€€òòIdóó.€€On€appeal,€the€state€is€entitled€to€the€strongestÏlegitimate€view€of€the€evidence€and€all€reasonable€inferences€which€may€beÏdrawn€therefrom.€€òòState€v.€Cabbageóó,€571€S.W.2d€832€(Tenn.€1978).ÌÌà àThough€the€appellant€makes€a€general€sufficiency€claim,€his€only€specificÏattack€is€to€the€conviction€for€possession€of€cocaine€with€intent€to€sell.€€HeÏargues€that€the€proof€established,€at€most,€simple€possession€rather€than€anÏintent€to€sell.€€We€disagree.€€The€testimony€indicated€that€a€bag€of€cocaine€andÏmarijuana€were€found€between€the€seats€closest€to€the€passengerððs€side€of€theÏcar.€€However,€in€the€backseat€floorboard,€on€the€side€occupied€by€theÏappellant,€Captain€Coleman€found€œthe›€corner€of€a€baggie€containing€two€smallÏrocks€of€crack€cocaine.€€Further,€the€officers€observed€an€apparent€attemptedÏexchange€of€something€with€a€man€œcalled›€Peewee.€€Although€the€officersððÏarrival€likely€interrupted€œthe€exchange,›€it€was€reasonable€for€the€jury€to€infer€thatÏPeewee€was€attempting€to€make€a€purchase.€€Further,€because€the€smallÏbaggie€portion€was€found€in€the€backseat€floorboard,€it€was€reasonable€for€theÏjury€to€conclude€that€appellant€was€going€to€make€a€sale€to€Peewee.€€This€issueÏis€without€merit.€€ÌÌà@ àIIÌà àAppellantððs€final€issue€is€that€the€trial€court€should€have€granted€a€mistrialÏdue€to€the€stateððs€alleged€failure€to€produce€exculpatory€evidence.€€This€issueÏwas€not€raised€in€the€motion€for€a€new€trial.€€The€appellant€argues€that€this€CourtÏshould€review€it€as€plain€error€pursuant€to€Tenn.€R.€Crim.€P.€52(b).€€The€allegedÏerror,€however,€does€not€give€rise€to€plain€error€review€because€a€clear€andÏunequivocal€rule€of€law€has€not€been€breached.€€òòSeeóó€òòState€v.€Adkissonóó,€899ÍS.W.2d€626€(Tenn.€Crim.€App.€1994).€€Furthermore,€the€proof€does€not€supportÏthe€appellant's€claim€that€the€evidence€in€question€was€exculpatory.€€ÌÌà àThe€œappellant€complains€that€the€name€of€the€subject€and€his€commentsÏto€Lieutenant€Caldwell€were€exculpatory€evidence.€€He€insists€that€because€thisÏinformation€was€not€turned€over€to€him,€the€trial€judge€should€have€granted€aÏmistrial.›€€The€motion€for€a€mistrial€followed€Caldwellððs€testimony€during€a€jury„out€hearing.€€Caldwell€indicated€that€he€had€asked€the€subject,€Peewee,€if€heÏwas€attempting€to€buy€or€sell€drugs.€€Peewee€responded€that€he€did€not€knowÏwhat€Caldwell€was€talking€about.€€The€trial€judge€overruled€the€motion€for€aÏmistrial.€ÌÌà àThe€appellant€argues€that€the€motion€should€have€been€granted€becauseÏthis€information€was€exculpatory.€€We€disagree.€€œIt›€is€œwell€established›€that€theÏprosecutor€œhas€the€duty€to€furnish€exculpatory€evidence€to€the€defendant.€€òòBradyÏv.€Marylandóó,€373€U.S.€83€(1963).€€However,€ð ð[t]he€duty€does€not€extend€toÏinformation€that€the€defense€already€possesses€or€is€able€to€obtain....ðð€€òòWoodenÏv.€Stateóó,€898€S.W.2d€752,€755€(Tenn.€Crim.€App.€1994).€›€€€Lieutenant€CaldwellÏcould€not€recall€the€subjectððs€œname.€€He›€had€œmade›€œno›€record€of€œthe€discussionÏbetween€the€subject€and€himself€because€the€records€check€was€clean.€ÏObviously,€nothing€in€the€conversation€was€deemed€useful€by€Caldwell.›€€At€theÏjoint€trial€of€the€three€codefendants,€codefendant€John€James€testified€that€theÏmanððs€name€was€ð ðPeewee.ðð€€Because€the€identity€was€known€to€the€appellant,Íthe€state€did€not€suppress€this€information.€€œHad€the€appellant€felt€that€PeeweeÏwould€have€been€an€important€witness,€he,€better€than€the€state,€knew€where€toÏcontact€Peewee.€€This€claim€has€no€merit.ÌÌà
