Thedefendantwasstoppedatabout11:00p.m.onNovember23,1987,byOfficerDebbieBarronaftershenoticedthatoneofthecarsheadlightswasoutandthatthecarwas veering.OfficerBarrontestifiedthatshehadsmelledalcoholwhenshewenttothedefendantscar,andthathehadfailedseveralfieldsobrietyteststhatsheadministered.Afterbeingtakentojail,thedefendanttookanϜIntoximetertest,whichregistereda.15bloodalcohollevel.Ms.Barronalsotestifiedthatthedefendanthadbeenverybelligerent,andthathehadurinatedonhimselfatthejail.    Thedefendanttestifiedonhisownbehalf,asdidhisexwifeandhisexwifessister,andalldeniedthathehadbeenintoxicated.Thedefendantdeniedthathehadhadanyalcoholicbeveragesthatdayorevening,andthattheonlysubstancehehadingestedthatdaythatcontainedalcoholwasadoseofNyQuil.Thejuryrejectedthedefendantsversionofthefacts.  ThedefendantsfirstissuearisesoutofOfficerBarronsresponsetoaquestionaskedoncrossexamination.Theofficerwastestifyingaboutthedefendantslicensehavingbeenrevoked,andthedefendantslawyerasked, And,yourrecollectionthatyouthinkhewaseithersuspended,orrevoked,ordrivingwithoutalicense?towhichOfficerBarronreplied, Hewasrevokedasof...IIIvegotthedate.Iknowthedatewhenhewasrevokedifyouwantthat.Thedefendantslawyersaid, Sure,andOfficerBarrontestified, 3/28of84,onaonapriorcharge.  Onhearingthereferencetothepriorcharge,thedefendantslawyerimmediatelymovedforamistrial,whichthejudgedenied.Thetrialcourtstated, Imnotgoingtograntamistrial.IIIdontthinkatthistimeImgoingtocautionthe͜Jury.Imightintheinstructionstonot[sic]toconsideranyevidenceaboutanypriorcharge.IImightdothat.ThetrialcourtfurtherstatedthatheconsideredOfficerBarronsresponsetobe alogicalpartofananswer.Thetrialcourt,however,didnotincludeanylimitinginstructioninhischargetothejury.    Thegrantingordenialofamistrialiswithinthesounddiscretionofthetrialcourt.Statev.Jones,802S.W.2d221,222(Tenn.Crim.App.1990).Absentafindingofabuseofthatdiscretion,thisCourtwillnotdisturbthetrialcourtsruling.Id.Thedefendantinthiscasehasshownnosuchabuseofdiscretion.Moreover,althoughthetrialcourtdidnotgivealimitinginstructionasmighthavebeenpreferable,anyerrorwasharmless.Therewasnotestimonyorotherevidenceaboutwhatconstitutedthepriorcharge.ThetrialcourteventuallydismissedtheDORLcount.TheevidenceofthedefendantsguiltofDUIwasoverwhelmingandthedefendantsufferednoprejudicefromthisoffhandremarkbytheofficer.  Inhissecondissue,thedefendantcomplainsthathisDUIconvictionshouldnothavebeenconsideredasecondoffensebecausethedateofhispriorconvictionprecededhisconvictioninthismatterbymorethantenyears.Specifically,thedefendantwasconvicted(onaguiltyplea)ofDWI,firstoffense,onMarch28,1984.HewasnotconvictedinthismatteruntilJuly19,1994,afterfinallyhavingbeenservedwithacapiasin1993.  T.C.A.5510403(a)(3)states, Forpurposesofthissection,apersonwhoseconvictionsforviolatingtheprovisionsof5510401occurmorethanten(10)yearsapartshallnotbeconsideredamultipleoffenderandthepenaltiesimposeduponmultipleoffenders...donotapplytosuchperson.Sincethedatesofthedefendantsconvictionsaremorethantenyearsapart,thisstatutewouldseemtoprecludeusinghisfirstoffenseinordertorenderthe1994convictiona secondoffense.  However,thereisproofintherecordthatthealmostsevenyeardelayinthedefendantstrialforthisDUIchargewasdueatleastinparttothedefendantsownactionsinleavingthejurisdictionandfailingtoappearforatleastonetrialdateofwhichhewasaware. +   כThedefendantadmittedthathehadbeeninTexasonDecember1,1988,thedateonwhichhistrialwasset.Ratherthanappearhimself,hiswife showedupforcourt.Thedefendanttriedtoexplainhisabsence(s)as justcommonmistakesin[the]typeofjob[I]hold.Thedefendantwasatruckdriver.  Thetrialcourtdeniedthedefendantsmotiontodismissthethirdcountoftheindictment,inwhichwasallegedtheprioroffense,stating, IfiftheentirefaultwasoftheStateIdgrantyourmotion,but,partofthepartofthefaultisduetotheDefense,therefore,yourmotionisrespectfullydenied.Weagreewiththetrialcourtsdecision.Wedonotthinkthatthelegislatureintendedthat5510403(a)(3)beappliedinsuchawaythatmultipleoffendersarerewardedforabsentingthemselvesfromthejurisdictionsoastocauseatenyeardelaybetweenconvictions.Sucharesultiscontrarytothelegislaturesexpressedintentofenhancingthepunishmentofthosedriverswhorepeatedlydrinkanddrive.  ThedefendantsrelianceonStatev.Sizemore,No.03C019209CR00326,BlountCounty(filedJuly15,1994,atKnoxville),ismisplaced.Inthatcase,theissuewasthepropermethodofcalculatingthetenyearperiod.Here,theStateconcedesthatmorethantenyearshaspassedbetweenconvictions.However,theStatearguesthatweshouldapplytheprinciplesinherentinthetollingstatute,T.C.A.402103.Thatsectionprovides, Noperiod,duringwhichthepartychargedconcealsthefactofthecrime,orduringwhichthepartychargedwasnotusuallyandpubliclyresidentwithinthestate,isincludedintheperiodoflimitation.    WeagreewiththeStatethatitisappropriatetoapplythistollingstatutebyanalogy.Inthiscase,thedefendantdeliberatelyabsentedhimselffromthejurisdictiononatleastonecourtdate,claimingworkasanexcuse.Yetthedefendantmakesnoclaimthathepetitionedthecourtforacontinuancesuchthathecouldproperlyarrangehisschedule.Noristhereanyproofthathewasthreatenedwiththelossofhisjobifheappearedincourtasordered.Rather,itiseasiertodrawtheinferencethat,asatruckdriverwhomayhavefacedthelossofhislivelihoodifheappearedandwasconvicted,thedefendanthadgoodreasontofindhimselfoutsidethejurisdictiononhiscourtdate(s).Wecannotcondonethiscourseofbehavior.
