Weaffirmthejudgmentofthetrialcourt.  OnMay10,1993,thepetitionerenteredpleasofguilttothreecountsofaggravatedburglary,twocountsoftheftofpropertyover$500.00,andonecountofvandalism.ThetrialcourtimposedRangeIII,concurrentsentencesoffifteenyearsoneachoftheaggravatedburglaryconvictions.Theothersentencesweretobeservedconcurrently.Fourmonthslater,thepetitionerfiledhisfirstpetitionforpostconvictionreliefallegingthestatehadviolateditspleaagreement.Atranscriptofthatproceedingisincludedinthisrecord.Thepetitionerwasrepresentedbycounselwhoarguedgenerallythathiscounselhadbeenineffectiveatthetimeofhisguiltyplea,andthathispleaswereneitherknowinglynorunderstandinglymade.Hiscounselmadetheargumentthatthesentenceshouldhavebeenfiveratherthanfifteenyears.Thetrialcourtfoundthatthepetitionerhadfailedtoestablishanyabridgmentofaconstitutionalright,stateorfederal.Ondirectappeal,thiscourtdeniedrelief.RogerDaleMcKinneyv.State,No.02C019412CC00273(Tenn.Crim.App.,atJackson,April5,1995).  OnDecember27,1994,thepetitionerfiledthissecondpetitionforpostconvictionrelief.Thepetitionercontendedthathehadnotknowinglyandvoluntarilyenteredhispleaofguiltandthathistrialcounselhadbeenineffective.  Agroundisdeemedtohavebeenpreviouslydetermined"ifacourtofcompetentjurisdictionhasruledonthemeritsafterafullandfairhearing."Tenn.CodeAnn.4030112(a);see󛀜Johnsonv.State,797S.W.2d578(Tenn.1990).Moreover,asecondpetitionwhichfailstoallegefactsinsupportofhisclaimthatthegroundhadnotbeenwaivedinthefirstproceedingmaybesubjecttodismissalwithoutanevidentiaryhearing.Tenn.CodeAnn.4030112(b);Statev.Smith,814S.W.2d45(Tenn.1991).  Ourreviewoftherecordindicatesthattheissuesraisedunderthesecondpetition,althoughmorespecificallysetout,arepreciselythoseraisedinthefirstpetition.Thepetitioneressentiallyclaimedthathispleaswerenotknowinglyorvoluntarilyenteredbecausehiscounselhadbeenineffective.SeeHillv.Lockhart,474U.S.52(1985).Thesameclaimshavebeenmadehere.Moreover,eveniftheseclaimswereconstruedtobedifferent,thepetitionerhasnotallegedfactsinsupportofhiscontentionthattheissuesinthiscasehadnotbeenwaivedinthepriorpetition.SeeHousev.State,911S.W.2d705(Tenn.1995),cert.denied,______U.S.______,116S.Ct.1685(1996).Thestatewouldalsohavebeenentitledtoasummarydismissalonthatgroundaswell.
