DistrictAttorneyGeneral      RONALDL.DAVIS       AssistantDistrictAttorneyGeneral      WilliamsonCountyCourthouseSte.G6      P.O.Box937      Franklin,TN37065OPINIONFILED________________________AFFIRMEDTHOMAST.WOODALL,JUDGE    OPINION     ThePetitionerappealsasofrightpursuanttoRule3oftheTennesseeRulesofAppellateProcedurefromthetrialcourtsdismissalofhis ApplicationforWritofHabeasCorpusRelief.ThePetitionerarguesfourissuesinthisappeal:(1)ThetrialcourterredindismissinghisApplicationforWritofHabeasCorpusReliefwithouthavinganevidentiaryhearing;(2)whetherPetitionerssentenceasimposedbythetrialcourthasexpiredasprovidedbylaw;(3)whethertheTDOCcanapplyaninmatesearnedandawardedsentencecreditstoreducetheearliestreleaseeligibilitydate;(4)whetherthereisstatutoryauthoritythatwouldallowtheTDOCtoawardtheamountofsentencereductioncreditsclaimedbythePetitioner.Weaffirmthejudgmentofthetrialcourt. ThebasisofthePetitionersargumentisthathehasbeencreditedwithonlyhalfofhissentencereductioncreditsandthathiscreditshavebeenappliedtohissentenceincorrectly.Therefore,thePetitionercontendsthathissentencehasexpired. ThetrialcourtsorderdismissingthePetitionersWritofHabeasCorpusreadsasfollows:    `    ThepetitionerhasfiledanApplicationforWritofHabeasCorpusReliefalleginghissentencehasexpired.Thepetitionerreceivedtwoconcurrent15yearsentencesfromtheCriminalCourtforDavidsonCountyforaggravatedsexualbatteryanduseofaminorforobscenepurposes.HissentenceeffectivedateisAugust13,1987.Accordingtotherecordssubmittedbythepetitioner,duringthealmost9yearshehasbeenincarceratedhehasearnedover41/3yearsinsentencingcreditsandhissentenceisscheduledtoexpireApril4,1998.Whilethepetitionerassertshehasonlybeencreditedwithonehalfofthecreditshehasearned,hehascitedthecourttonostatuteandthecourtisawareofnostatutethatwouldentitlethepetitionertosentencingcreditsofthemagnitudeheisclaiming.Theapplicationforreliefshowsonitsfacethatpetitionerssentencehasnotexpiredandshouldbedismissed.        Weagreewiththetrialcourt.InArcherv.State,851S.W.2d157(Tenn.1993),thecourtheld:    `    HabeascorpusreliefisavailableinTennesseeonlywhen itappearsuponthefaceofthejudgmentortherecordoftheproceedingsuponwhichthejudgmentisrenderedthataconvictingcourtwaswithoutjurisdictionorauthoritytosentenceadefendant,orthatadefendantssentenceofimprisonmentorotherrestrainthasexpired.       Archer,851S.W.2dat164.ThereisnoindicationineitherthejudgmentortherecordonappealtoshowthatthePetitionerssentencehasexpiredashecontends.Infact,anAffidavitfromCandaceWhitman,theSentenceTechnicianofSentenceInformationServicesstatesthatthePetitionerssentencehasnotexpired.ThereisnoauthoritysubmittedbythePetitionerthatshowsthatheisentitledtothenumberofcreditstowhichheclaimsheisentitled. ThePetitionerhasarguedonlythathissentencehasexpired.Wehaveconcludedthatthisisnotso.Hehasnotarguedthathissentenceisvoidandthereisnoevidenceinthisrecordthatitisvoid. WefindnoerrorinthetrialcourtsdeterminationthattheapplicationforreliefshowsonitsfacethattheAppellantssentencehasnotexpired.
