Atthesentencinghearing,thedefendantadmittedsigningandcashingtenstolenchecksranginginamountsfrom$200.00tomorethan$300.Thedefendantadmittedthathispriorrecordincludedafelonyconvictionforpossessionwiththeintenttosellordelivermarijuanaandfivemisdemeanorconvictions.Hesaidthathewasonprobationfromthefelonyconvictionwhenhecommittedthepresentoffensesandalsoadmittedthathehadviolatedprobationoneothertimebyfailingtoperformcommunityservicework.Hesaidthatheservedeighteenmonthswhenhisprobationforthefelonywasrevokedandthatservingtimechangedhisattitudetowardsthelaw.However,headmittedusingmarijuanaafterhisreleaseandsaidthathelastusedthedrugaboutamonthbeforethesentencinghearinginthiscase.  Appellatereviewofsentencingisdenovoontherecordwithapresumptionthatthetrialcourt'sdeterminationsarecorrect.T.C.A.4035401(d)and402(d).AstheSentencingCommissionCommentstothesesectionsnote,theburdenisnowontheappealingpartytoshowthatthesentencingisimproper.Thismeansthatifthetrialcourtfollowsthestatutorysentencingprocedure,makesfindingsoffactthatareadequatelysupportedintherecord,andgivesdueconsiderationandproperapplicationofthefactorsandprinciplesthatarerelevanttosentencingunderthe1989SentencingAct,wemaynotdisturbthesentenceevenifadifferentresultwerepreferred.Statev.Fletcher,805S.W.2d785,789(Tenn.Crim.App.1991).However,"thepresumptionofcorrectnesswhichaccompaniesthetrialcourt'sactionisconditionedupontheaffirmativeshowingintherecordthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances."Statev.Ashby,823S.W.2d166,169(Tenn.1991). Inconductingadenovoreview,wemustconsider(1)theevidence,ifany,receivedatthetrialandsentencinghearing,(2)thepresentencereport,(3)theprinciplesofsentencingandargumentsastosentencingalternatives,(4)thenatureandcharacteristicsofthecriminalconduct,(5)anymitigatingorstatutoryenhancementfactors,(6)anystatementthatthedefendantmadeonhisownbehalfand(7)thepotentialforrehabilitationortreatment.T.C.A.4035102,103and210;seeAshby,823S.W.2dat168;Statev.Moss,727S.W.2d229(Tenn.1986). Adefendantwhoiseligibleforprobationhastheburdenofestablishingsuitabilityforprobation.AstheSentencingCommissionCommentstoT.C.A.4035303(b)state,although"probationmustbeautomaticallyconsideredasasentencingoptionforeligibledefendants,thedefendantisnotautomaticallyentitledtoprobationasamatteroflaw."SeeStatev.Fletcher,805S.W.2dat787.However,asthedefendantdoesnotmeetthedescriptionofonewhoshouldbegivenfirstpriorityregardingasentenceinvolvingincarcerationunderT.C.A.4030102(5),andhasbeenconvictedofClassEfeloniesasastandardoffender,heispresumedtobeafavorablecandidateforalternativesentencingoptionsintheabsenceofevidencetothecontrary.T.C.A.4035102(6).     Thepresumptionofsuitabilitymayberebuttedifanyofthefollowingactorsoutweighthedefendant'srehabilitativecapabilities:(1)confinementisnecessarytoprotectsocietybyrestrainingadefendantwhohasalonghistoryofcriminalconduct,(2)confinementisnecessarytoavoiddepreciatingtheseriousnessoftheoffenseorconfinementisparticularlysuitedtoprovideaneffectivedeterrencetootherslikelytocommitsimilaroffenses,or(3)measureslessrestrictivethanconfinementhavebeenfrequentlyorrecentlyappliedunsuccessfullytothedefendant.SeeT.C.A.4030103(1);Statev.Ashby,823S.W.2d166,169(Tenn.1991);Statev.Fletcher,805S.W.2dat787788.Thetrialcourtrelieduponthefirstandthirdsentencingconsiderationsindenyingfullprobation,notingthedefendant'scriminalhistoryandhispreviousprobationviolations.Inreachingitsdecision,thetrialcourtconsideredthedefendant'sallegedchangeinattitudeandhisobtainingemployment,butitalsofactoredinhisrecentuseofmarijuana.Itsconclusionthatthecircumstanceswarrantedthedefendantbeingconfinedforsixtyadditionaldayswithworkreleasecapacitywasentirelyreasonable.
