ThepetitionforwritofhabeascorpusfiledinthetrialcourtallegesthattheDefendantwassentencedintheCriminalCourtofHamiltonCounty,TennesseeonMay11,1990,asaRangeIstandardoffendertoconcurrentsentencesofeighteenyears,tenyears,andfouryearsfortheoffensesofaggravatedrape,rape,andincest.TheDefendant'spetitionwasfiledintheCircuitCourtforWayneCounty,TennesseeonJanuary14,1995.ThepetitionallegesthattheDefendantisbeingillegallyandunconstitutionallyrestrainedfromhislibertybecausetheparoleboardunconstitutionallydeniedhimparole.ThepetitionfurtherallegesthattheDefendant'sguiltypleaswerenotvoluntary,knowing,orintelligentandwereenteredinviolationofhisconstitutionalrights.ThepetitionfurtherallegesineffectiveassistanceofcounselatthetimetheDefendantenteredhispleasofguilty.ThepetitionrequestedtheDefendant'simmediatereleaseandmonetarydamagesfortheDefendant's"continuedunlawfulrestraint." TheStatefiledaresponsetothepetitionallegingthatthegroundsraisedinthepetitionwouldnotrendertheDefendanteligibleforhabeascorpusreliefandthatthestatuteoflimitationshadrunifthepetitionweretreatedasoneforpostconvictionrelief.Thetrialcourtdismissedthepetitionforitsfailuretostateavalidclaimforhabeascorpusreliefandforlackofsubjectmatterjurisdictiontotreatthepetitionasoneforpostconvictionrelief.ItisfromtheorderofthetrialcourtdismissingthepetitionthattheDefendantappeals. Thepetitionwasstyled"petitionforwritofhabeascorpus."ItnamedasDefendantstheStateofTennessee,thewardenoftheinstitutioninwhichtheDefendantwasincarcerated,theChairmanoftheTennesseeBoardofParoles,theCommissionerofCorrection,andtheDirectoroftheSexOffenderProgramfortheTennesseeDepartmentofCorrection. Thewritofhabeascorpus,codifiedatTennesseeCodeAnnotatedsections2921101to130istobeissuedonlyinthecaseofavoidjudgmentortofreeaprisonerheldafterthetermofimprisonmenthasexpired.Tenn.CodeAnn.2921101;Pottsv.State,833S.W.2d60,62(Tenn.1992).Itisclearfromthisrecordthatthepetitionerisnotentitledtohabeascorpusrelief.  Atrialcourtisnotboundbythetitleofapleading,buthasthediscretiontotreatthepleadingaccordingtothereliefsought.Nortonv.Everhart,895S.W.2d317,319(Tenn.1995).Whilethispetitioncouldbeviewedasapetitionforpostconvictionrelief,suchapetitionmustbefiledinthecourtwheretheconvictionoccurred.Tenn.CodeAnn.4030103(repealed1995). ,   ׀Thepetitionhereinwasnotfiledinthecountyorjudicialdistrictinwhichtheconvictionoccurred.ThetrialcourtthusdidnothavejurisdictiontoentertainapetitionforpostconvictionrelieffromthisDefendant.ThetrialcourtalsodidnothaveauthoritytotransferthiscasetothecourtinwhichtheDefendantwasconvicted.Norton,895S.W.2dat320.Furthermore,itappearsthatapetitionforpostconvictionreliefwasbarredbythethreeyearstatuteoflimitationsapplicabletothisaction.Tenn.CodeAnn.4030102(repealed1995). .   ׀ Thepetitioncouldalsohavebeenviewedasapetitionforacommonlawwritofcertiorari.Tenn.CodeAnn.278102.ParoleBoarddecisionsarereviewableonlybyapetitionforwritofcertiorariwhichmustbefiledwithinsixtydays.Thandiwev.Traughber,No.01A019407CH00313,DavidsonCounty(Tenn.Ct.App.,Nashville,filedNov.2,1994),perm.toappealdenied,(Tenn.,filedFeb.21,1995).ThepetitionhereinallegesthattheDefendantwasdeniedparoleinMarchof1993.ThepetitionhereinwasfiledJanuary14,1995.Thesixtydaystatuteoflimitationsforfilingapetitionforawritofcertiorarihadexpiredlongbeforethefilingoftheinstantpetition.Thisisclearlyascertainablefromthefaceofthepetitionitself.Furthermore,theDefendantfiledhispetitioninthewrongcourt.Writsinvolvingstateagenciesorofficersmustbefiledinthecountywhichistheofficialsitusoftheagency'sheadoffice.TennesseeRealEstateComm'nv.Potts,221Tenn.585,591,428S.W.2d794,797(1968).OnlythecourtsofDavidsonCountyhavethenecessarysubjectmatterjurisdictiontoreviewthedecisionsofastateagency.Brighamv.Lack,755S.W.2d469,471(Tenn.Crim.App.),perm.toappealdenied,id.(Tenn.1988)seealsoMorrisv.Snodgrass,871S.W.2d484,485(Tenn.Ct.App.1993).Again,thetrialcourthadnoauthoritytotransferthiscasetoDavidsonCounty.Norton,895S.W.2dat320. Additionally,evenifthepetitionhadbeenaddressedonthemerits,theactionoftheparoleboardinreleasingprisonersisnotreviewableifdoneaccordingtolaw.Tenn.CodeAnn.4028115(c);Brighamv.Lack,755S.W.2d469,471(Tenn.Crim.App.),perm.toappealdenied,id.(Tenn.1988).ThescopeofreviewunderthecommonlawwritisverynarrowandcoversonlyaninquiryintowhethertheParoleBoardhasexceededitsjurisdictionorisactingillegally,fraudulently,orarbitrarily.Powellv.ParoleEligibilityBoard,879S.W.2d871,873(Tenn.Ct.App.),perm.toappealdenied,id.(Tenn.1994).Notthecorrectnessofthedecision,butonlythemannerinwhichitwasreachedisreviewable.Id.Merelyattackingtheboard'sactionbyallegingconclusorytermssuchas"arbitrary"and"capricious"willnotwarranttheissuanceofthewrit.Id.󀀀Thus,iftheboardhasreachedthedecisioninalawfulmanner,thedecisionissimplynotreviewable.Id.;seeBrigham,755S.W.2dat471.
