OnJuly12,1995,thepetitioner,aninmateattheLakeCountyRegionalCorrectionalFacilityservingaRangeII,sevenyearsentence,filedthispetitionallegingthathewasnotproperlyinthecustodyoftheTennesseeDepartmentofCorrection.WhileconcedingthathehadbeenunderaCommunityCorrectionssentenceandhadapriorfederaloffense,heinsiststhathewasneveractuallyorderedtoservehisterminthestateprison.Thepetitionerclaimedthatthewardenhadmisusedhisauthoritybyhiscontinuedincarcerationofthedefendant.  Thetrialcourtfoundasfollows:8 8  TheamendedjudgmentsrevealthattheϜcommunitycorrectionssentence[ofsevenyears]wasindeedrevokedtobeservedconcurrentlywiththefederalsentence.ThehandwrittennotationsontheϜjudgmentsshowthatthecommunitycorrectionsviolationwassustainedwiththe"sentenceintoeffect"torunconcurrentlywiththefederalsentence.Creditsof1,026dayswereawarded.Accordingly,petitionerisproperlywithinthecustodyandcontroloftheTennesseeDepartmentofCorrectionservinghisoriginalsentences.  Inordertoobtainreliefthroughawritofhabeascorpus,thepetitionmustestablishthatthejudgmentofconvictionisvoidorthesentencehasexpired.Usseryv.Avery,432S.W.2d656(Tenn.1968).Unlikethepostconvictionpetition,thepurposeofhabeascorpusistocontestvoid,andnotmerelyvoidable,judgments.SeeStateexrel.Newsomv.Henderson,424S.W.2d186,189(Tenn.1968).Ifbroughttochallengeanillegalconfinement,thehabeascorpusactionmaybebroughtatanytimewhilethepetitionerisincarcerated.Archerv.State,851S.W.2d157,164(Tenn.1993).  Asweunderstandthispetition,thepetitionerdoesnotcomplainbecauseheisincarcerated.HiscontentionisthatthejudgmentprovidedforaworkhousesentenceratherthanonewiththeDepartmentofCorrection.Thatisso.Asthetrialcourtfound,however,theamendedjudgmentsclearlyestablishaviolationofthetermsofCommunityCorrections.Thetrialcourtorderedthesentence"intoeffect"andgavecreditfortimeserved.Thesentencewasorderedtobeservedconcurrentlywiththefederalsentence.  Itistruethatthesentencescouldandperhapsshouldhavebeenmoreclearlysetoutinthejudgments.Ittakesareviewoftheentiredocumenttodeterminetheintentofthesentencingjudge.Yetthepetitionerhasnotestablishedthatthethreejudgmentsofconvictionatissuearevoid.Further,the1991sentences,whichprovidedforatermofsevenyears,hadnotexpiredatthetimethetrialcourtruledonthispetition.  Finally,hadthepetitionerclaimedthathissentencehadbeenmiscalculated,apetitionforhabeascorpusreliefwouldnothavebeentheforumtoconsiderdisputedsentencecredits.Rowellv.Dutton,688S.W.2d474(Tenn.Crim.App.1985).Generallyspeaking,onceapetitionerisincustodyoftheDepartmentofCorrection,timecreditsandparoledates,beinginternaldepartmentalmatters,areinappropriateconsiderationsinthistypeofaproceeding.SeeCarrollv.Raney,868S.W.2d721,723(Tenn.Crim.App.1993).ThevalidityofanysentencereductioncreditsmustbeaddressedthroughtheavenuesoftheUniformAdministrativeProceduresAct.Tenn.CodeAnn.45101to324;Statev.DavidN.Kuntz,No.01C019101CR00019(Tenn.Crim.App.,atNashville,June14,1991).
