àThe€Stateððs€evidence€is€this€case€on€the€commission€of€the€crimes€comesÏfrom€the€testimony€of€the€victim€and€the€statement€made€to€the€police€by€theÏdefendant€which€implicates€him€in€the€crimes.Ìà àThe€defendant€did€not€claim€that€the€acts€of€violence€alleged€in€theÏindictments€to€have€been€committed€against€the€victim€did€not€occur;€neither€did€heÏrefute€the€victimððs€detailing€of€the€acts€committed€against€her.€€The€defendantÏdenied€he€was€present€at€the€crime€scene€and€based€his€defense€entirely€on€one€ofÏalibi€and€a€claim€that€his€statement€to€the€police€was€not€true€but€coerced€in€thatÏthey€were€made€despite€his€wish€for€an€attorney.Ìà àThe€victim€testified€that€on€October€31,€1993€she€was€at€her€home€in€BradleyÏCounty.€€At€10:30€a.m.,€two€men€and€a€woman€entered€the€home.€€The€defendantÏand€the€woman€physically€assaulted€the€victim,€burned€her€in€several€places€with€aÏcigar,€tied€her€hands€when€she€resisted,€committed€upon€her€one€act€of€analÏintercourse,€one€act€of€oral€sex,€forced€her€to€perform€oral€sex€upon€the€male€andÏfemale,€stole€over€eight€thousand€dollars€from€the€house,€and€shot€her€in€the€leg.€ÏThe€victim€identified€the€defendant€as€the€man€who€assaulted€her,€and€whoÏassisted€the€woman€in€the€commission€of€all€the€acts€against€her.Ìà àThe€unrefuted€evidence€shows€beyond€a€reasonable€doubt€that€the€offensesÏalleged€in€the€indictment€were€committed€except€the€offense€œof€especiallyÏaggravated›€kidnaping.€€The€only€issue€on€the€sufficiency€of€evidence€is€whether€theÏdefendantððs€evidence€of€alibi€raises€a€sufficient€defense€as€to€cause€theÏidentification€of€him€as€the€perpetrator€of€the€offense€to€be€insufficient€to€show€hisÍguilt€beyond€a€reasonable€doubt.Ìà àThe€defendant€called€eighteen€witnesses€to€testify€that€he€was€in€RheaÏCounty€and€in€the€City€of€Dayton€during€the€time€the€offenses€were€beingÏcommitted.€€Most€of€the€witnesses€did€a€remarkable€job€of€pinpointing€theÏÑ  Ñœdefendantððs›€whereabouts€at€certain€times€in€their€testimony.€€We€need€not€go€intoÏall€of€them€in€this€opinion.€€However,€as€we€read€the€record,€there€are€three€areasÏconcerning€the€defense€that€contradict€and€erode€the€alibi€evidence.€œWitnessesÏfrom€the€Advance€Auto€Parts€Store€testified€the€defendant€was€at€the€store€at€10:00Ïa.m.€and€made€a€purchase€at€10:16€a.m.€on€October€31,€1993.€€They€submitted€aÏcash€register€receipt€to€show€the€time€of€a€purchase€by€the€defendant.€€TheÏemployee€testified€the€clock€at€the€store€had€been€set€back€automatically€by€theÏhome€office€in€Roanoke,€Virginia.€€The€State€called€the€person€in€charge€ofÏcomputer€settings€from€the€Roanoke€office,€who€testified€the€clocks€at€the€storeÏwhich€control€the€cash€register€receipt€times€are€not€set€automatically€fromÏRoanoke€but€are€set€at€each€store.›€The€defendant€was€seen€at€a€gas€station€not€farÏfrom€the€Advance€Auto€Store€at€9:15€a.m.€on€the€morning€of€the€crime.€€This€was€theÏday€clocks€were€to€be€turned€back€one€hour€because€of€the€end€of€daylight€savingsÏtime.€€The€clerk€at€the€gas€station€testified€their€clocks€would€change€time€on€theirÏown€„€a€receipt€for€the€purchase€of€gas€was€timed€at€9:15€a.m.€on€the€station€cashÏregister.€Ìà àOne€of€the€defendantððs€alibi€witnesses€testified€he€saw€the€defendant€at€aÏlocal€store€in€Rhea€County€at€11:00€a.m.€on€the€date€of€October€31,€1993.€€TheÍState€called€the€person€who€was€working€at€the€store€as€a€witness.€€He€testifiedÏneither€the€defendant€or€the€witness€were€at€the€store€on€the€date€of€the€crime.Ìà àThe€defendant€relies€upon€the€case€of€òòState€v.€Williams,€óó657€S.W.2d€405Ï(Tenn.€1983)€and€òòState€v.€Cabbage,€óó571€S.W.2d€832€(Tenn.€1978)€to€assert€theÏevidence€is€insufficient€in€the€face€of€his€alibi€proof€to€convict.€€òòWilliamsóó€andÏòòCabbageóó€are€of€no€help€to€the€defendant.€€Those€cases€clearly€hold€that€the€matterÏof€whether€an€alibi€has€been€made€out€is€for€the€jury€to€determine€from€all€theÏevidence€in€the€case.€€The€jurors€are€the€arbiters€of€the€credibility€of€the€witnesses,Ïand€their€verdict€approved€by€the€trial€judge€accredits€the€Stateððs€theory€of€the€case.Ìà àOn€appeal,€we€must€affirm€the€verdict€and€the€judgment€if€there€is€sufficientÏevidence€upon€which€a€rational€trier€of€fact€can€find€guilt€beyond€a€reasonableÏdoubt.€€We€find€œthe€evidence€is€sufficient›€for€that€purpose€in€this€case€on€all€theÏoffenses€charged€except€the€offense€of€œespecially€aggravated›€kidnaping.Ìà àWe€have€an€unusual€stance€taken€by€the€State€on€the€offense€of€œespeciallyÏaggravated›€kidnaping.€€The€original€brief€filed€by€the€State,€which€is€quite€lengthyÏand€œwell›€done,€was€filed€by€one€Assistant€Attorney€General.€€In€the€brief,€the€StateÏconceded€there€was€no€evidence€of€kidnaping€within€the€holding€of€òòState€v.ÏAnthony,€óó817€S.W.2d€299€(Tenn.€1991).€€This€brief€was€filed€Feb.€1,€1996.€€OnÏMarch€28,€1996,€the€œState,›€by€another€Assistant€Attorney€œGeneral,€filed›€aÏsupplemental€brief€saying€the€interpretation€of€òòAnthonyóó€by€the€Assistant€who€filedÏthe€first€brief€was€erroneous€and€the€concession€should€not€have€been€made.Ìà àWe€have€looked€carefully€at€the€facts€in€this€case€and€the€holding€in€òòAnthony.€ÏóóWe€conclude€the€Stateððs€concession€in€the€first€brief€was€based€upon€a€correctÏanalysis€of€the€facts€in€œthis›€case€vis„a„vis€the€holding€in€òòAnthony.Ìà àóóIn€this€case,€the€victim€testified€her€hands€were€bound€when€she€began€toÏresist€the€physical€assaults€upon€her.€€She€was€not€moved,€hidden€or€otherwiseÏrestrained,€other€than€as€an€incident€of€the€other€crimes€being€committed.€€We€findÏthe€evidence€is€insufficient€to€support€the€verdict€of€œespecially€aggravated›Ïkidnaping€and€we€reverse€the€judgment€of€the€court€on€that€offense€and€dismissÏthat€charge.Ìà àThe€record€before€us€does€not€reflect€any€ruling€of€the€trial€judge€upon€aÏmotion€for€a€change€of€venue€made€by€the€defendant€nor€does€it€show€anyÏproceeding€upon€the€motion.€€In€the€absence€of€this,€we€cannot€pass€upon€thisÏissue€and€consider€the€same€to€be€waived€and€presume€the€ruling€the€trial€courtÏmade,€if€any,€was€correct.€€See€òòState€v.€Ogle,€óó823€S.W.2d€554€(Tenn.€Crim.€App.Ï1991).Ìà àThe€defendant€contends€the€trial€judge€should€have€suppressed€the€in„courtÏidentification€of€him€because€the€victimððs€identification€of€him€at€trial€was€basedÏupon€an€unconstitutionally€tainted€line„up.Ìà àThe€method,€manner€and€content€of€the€line„up€was€testified€to€in€aÏsuppression€hearing.€€The€allegation€of€taint€made€by€the€defendant€was€disputedÏby€the€officer€who€conducted€the€line„up.€€The€trial€judge€found€the€line„up€to€beÏproper.€€The€decision€of€the€trial€judge€on€the€admission€of€the€evidence€is€for€the€œÌtrial›€judge€and€the€decision€comes€to€us€with€the€œweight›€of€a€jury€verdict.€€UnlessÏthe€record€shows€the€decision€of€the€trial€judge€is€arbitrary,€the€ruling€will€not€beÏoverturned€on€appeal.€€òòState€v.€Davis,€óó872€S.W.2d€950€(Tenn.€Crim.€App.€1993).€ÏWe€affirm€the€judgment€of€the€trial€court.Ìà àThe€defendant€contends€the€police€officer€continued€to€question€him€whenÏhe€stated€he€wanted€a€lawyer€and€that€he€only€confessed€because€he€was€subjectÏto€harsh€conditions€in€the€jail€until€he€confessed.Ìà àThe€only€testimony€in€the€case€was€given€by€the€officer€who€took€theÏconfession.€€On€the€matter€of€an€attorney€the€officer€testified:ÌÒ  ÒÒ „ ÒÒ  ÒÒ ½ ÒÓÓÓ  ÓA:€(Officer€œBenefield›):€I€had€heard€that€on€the€way€to€his€beingÏlocked€up,€he€made€a€suggestion€to€Detective€œBurtt›,€ð ðI€guess€IððmÏgoing€to€have€to€have€a€lawyer.ðð€€To€my€understanding€he€had€neverÏsaid€he€wanted€one,€and€so€when€I€called€him€out€[for€an€interview],€IÏwanted€to€be€sure,€ð ðDo€you€want€a€lawyer.ðð€€ð ðNo.ðð€€and€as€we€got€toÏtalking€he€said,€ð ðI€guess,ðð€he€said,€ð ðI€wouldnððt€even€know€the€phoneÏnumber€of€one€to€call.ðð€€I€said,€ð ðNow€wait€a€minute,€ð ð€I€said,€ð ðAre€youÏsaying€if€you€knew€of€a€phone€number€you€would€call€one€or€are€youÏsaying€you€want€a€lawyer?ðð€And€he€said,€ð ðNo,€no,ðð€he€said,€ð ðI€donððtÏwant€one.€€Iððm€just€saying€I€donððt€know€one€to€call.ðð€€I€said,€ð ðIf€youÏwant€a€lawyer,€I€can€get€you€attorney€names.€€We€can€get€the€judgeÏto€appoint€you€one,€there€are€several€things€we€can€doðð€.€.€.€[œT]he›Ïbottom€line€was,€ð ðNo,€I€want€to€talk.€€I€want€to€tell€my€story,€I€want€toÏtalk.ððÌÌQ:€(Arnold€Fitzgerald):€Alright,€when€the€discussion€came€up€aboutÏan€attorney€on€November€2,€why€would€you€not€have€let€him€go€andÏcall€an€attorney?€€Do€you€recall€that?€€Why€didnððt€you€after€thatÏdiscussion€came€up?ÌÌA:€Because€I€was€very€clear,€and€I€was€very€determined,€and€I€askedÏhim,€because€he€made€it€kind€of€like€a€passing€statement,€ð ðI€donððtÏeven€know€the€[phone]€number€of€one€if€I€wanted€to,ðð€or€somethingÏlike€that.€€I€said,€ð ðNow€wait€a€minute,€are€you€saying€if€you€knew€aÏnumber,€are€you€saying€you€want€an€attorney€if€you€knew€one€toÏcall.ðð€€I€said,€ð ðWe€can€get€you€an€attorney€if€you€want€to€talk€to€one.ðð€ÍHe€said,€ð ðNo,€no,€no.€€I€want€to€talk.€€I€want€to€talk€now.ðð€€He€said,€ð ðIððmÏnot€saying€I€want€an€attorney.ððÌÌÒ  ÒÒ ½ ÒÒ  ÒÒ Ï ÒÓÓÒ S ÒÒ Ï Ò€à àThere€was€no€evidence€by€the€defendant€offered€on€either€the€request€forÏan€attorney€or€the€condition€of€the€jail.Ìà àWhether€to€admit€the€statement€was€within€the€discretion€of€the€trial€judge.€ÏUnless€the€evidence€shows€a€clear€abuse€of€that€œdiscretion,›€the€action€thereonÏwill€be€affirmed.€€òòState€v.€œGoforth›,€óó678€S.W.2d€477€(Tenn.€Crim.€App.€1984).€€WeÏfind€no€abuse€of€discretion€in€this€case.Ìà àThe€defendant€contended€in€his€motion€for€a€new€trial€that€the€StateÏwithheld€evidence€of€past€check€fraud€crimes€being€committed€by€the€victim€andÏfurther€alleged€the€victim€had€previously€burned€herself.€€The€defendant€insistsÏthis€was€exculpatory€evidence€and€the€withholding€of€the€evidence€entitled€him€toÏa€new€trial€under€the€holding€in€òòBrady€v.€Maryland,€óó373€U.S.€83€(1963)€and€itsÏprogeny.Ìà àWe€reject€this€argument€primarily€because€there€is€a€failure€in€this€record€toÏshow€the€matters€alleged€are€based€in€fact.€€The€allegations€are€contained€in€theÏmotion€for€a€new€trial€and€no€offer€of€proof€was€made€to€show€the€allegationsÏwere€true.€€This€alone€would€foreclose€a€review€of€this€matter.€€Further,€even€ifÏtrue,€the€allegations€would€go€only€to€the€credibility€of€the€witness€and€in€the€faceÏof€this€record€we€cannot€see€that€this€evidence€would€have€caused€the€jury€toÏreach€a€different€conclusion,€a€prerequisite€to€relief€under€a€claimed€òòBradyÏóóviolation.€€See€òòState€v.€œEdgin›,€óó902€S.W.2d€387€(Tenn.€1995).ÌòòÓ
