ThechargeagainstMitchellaroseoutoftheaggravatedrobberyofStevesJewelryandRepairStoreinMt.Juliet.Jewelry,cashandaweaponwererecoveredfromappellantsautomobile.Atsomepoint,theprosecutionphotographedthejewelryandreturnedittotheownerwhosoldittovariouspurchasers. )   כ OnSeptember22,1995,onedayafterthetrialcourtdeniedthedefendantsmotionstosuppress,todismisstheindictment,andtocontinuethetrial,thedefendantentereda bestinterestspleatothechargeofaggravatedrobbery.OnOctober,24,1995,thedefendantfiledaprose MotiontoWithdrawGuiltyPlea,seekingtowithdrawhispleatopreventmanifestinjusticepursuanttoRule32(f)oftheTennesseeRulesofCriminalProcedure. +   ׀Thetrialjudgeappointednewcounseland,onDecember6,1996,thecourtheldahearingonthemotion.Neithersidepresentedanyevidenceatthehearing.Thetranscriptrevealsthattheentirehearingwasacolloquybetweenthetrialcourt,defensecounsel,andtheappellantwhomthecourtappointedtoactashisowncocounsel.Thetrialjudgedeniedthemotiontowithdrawwithoutmakinganyspecificfindingsatthecloseofthehearing.OnApril10,1996,hesignedthefollowingorder:8  TheCourthavingreviewedtheentirerecordinthiscause,includingthetranscriptofthehearingofSeptember22,1995,statementsofCounselandoftheDefendant,isoftheopinionthattheMotiontoWithdrawtheGuiltyPleaiswithoutmeritandshouldbedismissed.Itisfromthisorderthattheappellanthasappealed.
