AsaRangeIIoffender,Appellantwassentencedtotenyearsforattemptedrape,eightyearsforattemptedincest,fouryearsforsexualbattery,thirtydaysforpublicintoxication,andelevenmonths,twentyninedaysforevadingarrest.Thetrialcourtorderedthesentencestobeservedconcurrently.AppellantappealedhisconvictionandsentenceonApril18,1995.Inadditiontohisdirectappeal,AppellantfiledapetitionforawritoferrorcoramnobisonDecember22,1995,basedontherecantedtestimonyofthevictim. #   ׀Thetrialcourtdeniedthepetition,findingthatasamatteroflaw,recantedtestimonycouldnotsupportthegrantofapetitionforawritoferrorcoramnobis.Ironically,thetrialcourtalsoheldthatifthevictimsrecantedtestimonyhadbeenpresentedattrial,itwouldhaveresultedinadifferentjudgment.ThisCourtconsolidatedthedirectappealandthedenialofthepetitionforawritoferrorcoramnobis. Afterareviewoftherecord,weremandthiscauseforfurtherproceedings. Attrial,AudreyMixon,AppellantsfourteenyearolddaughtertestifiedthatonApril16,1994,shewasdrivingherfatherbackhomefromafriendshousewhenherfatheraskedherifshehadeverseenhimnaked.Later,heaskedhertopulloffthemainroad,turndownadirtroadandstop.Aftertheystopped,Appellantturnedontheradio,puthishandonherinnerthighandstartedslidingitupherlegwhilemakinganobscenestatementindicatingthathewantedtoengageinsexwithhisdaughter.Atthispoint,Ms.Mixonjumpedoutofthetruckandstartedrunningdowntheroad.Asshewasjumpingoutofthetruck,Appellantgrabbedherclothingandsaidhewasonlyjoking. Atthehearingonthewritoferrorcoramnobis,Ms.Mixonrecantedthetestimonythatherfatherhadtriedtorapeher.Sheacknowledgedheraffidavitwhichstatedthatshewasupsetandtriedtorunawayfromherfatherbecausetheyhadbeenfightingaboutherboyfriendwhoherfatherdidnotwanthertodate.Shealsostatedthatshewastryingtohelphermother getridofherfatherbecausehermotherwasdivorcingherfatherandhermotherwantedhistrailer. TennesseeCodeAnnotatedSection4026105(1990)providesthat:      ` `  `    ` Uponashowingbythedefendantthathewaswithoutfaultinfailingtopresentcertainevidenceatthepropertime,awritoferrorcoramnobiswilllieforsubsequentlyornewlydiscoveredevidencerelatingtomatterswhichwerelitigatedatthetrialifthejudgedeterminesthatsuchevidencemayhaveresultedinadifferentjudgment,haditbeenpresentedatthetrial.           Beforeadefendantisentitledtoanewtrialbasedonnewlydiscoveredevidencethedefendantmustshowthat:1)heactedwithreasonablediligencetodiscovertheevidencepriortotrial;2)thenewlydiscoveredevidenceismaterialtotheissueofthedefendantsguilt;and3)theevidencewouldhavelikelychangedthejurysverdict.Statev.Goswick,656S.W.2d355,35859(Tenn.1983).Thedecisionwhethertograntordenyapetitionforawritoferrorcoramnobisrestswithinthesounddiscretionofthetrialcourt.Statev.Hart,911S.W.2d371,375(Tenn.Crim.App.1995). Recantedtestimonymaysupportthegrantofawritoferrorcoramnobis,thereforethetrialcourtsfindingtothecontrarywaserroneous.Seeid.;Statev.Herndon,No.03C019303CR00098,1994WL176969,at*2(Tenn.Crim.App.May11,1994);Statev.Ashby,No.2,1985WL4227,at*4(Tenn.Crim.App.Nov.27,1985);.Thetestforgrantinganewtrialincasesinvolvingrecantedtestimonyisasfollows:1)thetrialjudgeisreasonablywellsatisfiedthatthetestimonygivenbyamaterialwitnesswasfalseandthatthenewtestimonyistrue;2)thedefendantwasreasonablydiligentindiscoveringthenewevidenceorsurprisedbyfalsetestimony,orunabletoknowofthefalsityuntilafterthetrial;and3)thejurymighthavereachedadifferentconclusionhadthetruthbeentold.Ashby,1985WL4227,at*5(Tatum,J.,dissenting).Itisclearthatbeforeatrialjudgerulesonapetitionforawritoferrorcoramnobis,heorshemustdeterminethecredibilityofthewitnesseswhotestifyinsupportoftheaccusedswrit.Hart,911S.W.2dat375.InHart,thisCourtremandedthecaseforadeterminationofwhetherawitnessaffidavitwastrueorfalse.Id.Becausethetrialcourterroneouslyfoundthatrecantedtestimonywasnotaproperbasisforwritoferrorcoramnobisrelief,becauseitfailedtomakethenecessaryfindingsdiscussedabove,andbecauseweareunabletoassessthedemeanorandcredibilityoftheaffiant,wereverseandremandthismatterforfurtherproceedingsandfindingsbythetrialjudgeconsistentwiththisopinion.     ____________________________________     JERRYL.SMITH,JUDGECONCUR:___________________________________JOEB.JONES,PRESIDINGJUDGE___________________________________JOSEPHM.TIPTON,JUDGE
