OPINION .   ThisisanappealasofrightpursuanttoRule3oftheTennesseeRulesofAppellateProcedure.TheDefendantappealsfromanorderofthetrialcourtrevokinghisprobationandorderinghimtoservehisentiretwoyearsentenceintheDepartmentofCorrection.Becausewehavedeterminedthattheissuespresentedonappealarenowmoot,wedismisstheappeal. TheDefendantpleadedguiltytosellingmarijuanaonSeptember25,1990.ThetrialjudgesentencedhimtoservetwoyearsasaRangeIoffender.ThesentencewassuspendedandtheDefendantwasplacedonprobationforthefulltwoyearperiod.TheDefendantsfirstprobationviolationreportwasfiledwiththetrialcourtJuly22,1991.ItallegedthattheDefendanthadfailedtoreporttohisprobationofficer,failedtopaythefeesheowed,andhadnotprovidedproofthathehadpaidanyoftherestitutionheowed.Athisrevocationhearingthetrialjudgetoldhimtostartreportingregularlyandprovideproofofpayment.AsecondprobationviolationreportwaspreparedonSeptember2,1992.ItallegedthattheDefendanthadtestedpositivefordruguseandhadnotpayedanyofhisfeesuptothatpoint.AwarrantwasissuedSeptember9,1992,fortheDefendanttobeincourtJune21,1994.PursuanttoanorderfiledonFebruary15,1995,theDefendantsprobationwasrevokedandhewasorderedtoservehissentenceoftwoyears. ThiscasewassubmittedtothiscourtfordecisiononJune4,1996.TheissuesraisedinthisappealarewhetherthetrialcourterredinrevokingtheDefendantsprobationandorderinghimtoservehisentiretwoyearsentenceintheTennesseeDepartmentofCorrectioninsteadofanotherformofalternativecorrection,andwhetherthetrialcourterredinrefusingtoheartheDefendants MotionforReductionofSentence,whichwasfiledaftertherevocationoftheDefendantsprobation.ItcametotheattentionofthiscourtthattheDefendantwasreleasedondeterminateprobationJuly31,1995andisnolongerinthecustodyoftheTennesseeDepartmentofCorrection.Suggestingthattheissueraisedinthisappealwasmoot,thiscourtenteredanorderonJune6,1996advisingtheDefendantthatthisappealwouldbedismissedunlesstheDefendantfiledanaffidavitwithinfourteendaysshowingwhythiscourtshouldconsidertheappealonthemerits.AnaffidavitwasfiledbytheDefendantsattorneyinwhichhestatedthattheDefendanthadnotrespondedtotheattorneysattemptstocontacthim. Thedoctrineofjusticiabilitypromptscourtstostaytheirhandincasesthatdonotinvolveagenuineandexistingcontroversyrequiringthepresentadjudicationofpresentrights.McIntyrev.Traughber,884S.W.2d134,137(Tenn.Ct.App.1994).Theconceptofmootnessdealswiththecircumstancesthatrenderacasenolongerjusticiable.Id.Amootcaseisonethathaslostitscharacterasapresent,livecontroversy.Acasewillgenerallybeconsideredmootifitnolongerservesasameanstoproviderelieftotheprevailingparty.Id.Thetwomostrecognizedexceptionstothemootnessruleincludeissuesofgreatpublicinterestandimportancetotheadministrationofjusticeandissuescapableofrepetitionyetevadingreview.Id.Whethertotakeupcasesthatfitintooneoftherecognizedexceptionstothemootnessdoctrineisdiscretionarywiththeappellatecourts.Id. Inthecasesubjudice,itisobviousthatthiscourtcannotprovideanymeaningfulrelieftotheDefendantevenifwedeterminethatthetrialcourterredbyrevokingtheDefendantsprobation.AreversalofthetrialcourtsorderrevokingtheDefendantsprobationwouldserveonlytounnecessarilyconfuseandcomplicatetheDefendantsstatus.Wedeclinetoconsiderthisappealonthemerits.
