FACTS    Theappellant,AntonioMorgan,JamichaelClifford,andTanaThompson(theappellant'sgirlfriend)weretogetherinacaronthenightofthemurder.TheappellantandMorganapparentlydecidedtorobsomeone.Theyexitedthecarandwalkedtothemiddleof17thStreetinChattanooga. ThevictimswalkedbytheappellantandMorgan.Theappellantaskedthevictims"[w]hat'sup?"Asthevictimscontinuedpasttheappellant,theappellantpulledoutagunandshotintotheair.Thevictimsstopped.Theappellantpointedthegunatthevictims.TheappellanttheninstructedMorgantopatthevictimsdown.Oneofthevictims,Mr.Williams,pleadedwiththeappellantnottorobhim.Morgan,however,tookMr.Williams'beeper,necklace,weddingring,andmoney.Theappellantthenstated"I'mgoingtocounttothreeandI'mgoingtoshoot."Mr.Williamswasthenshotandkilled.   SUPPRESSION    Theappellantarguesthatthetrialjudgeerredinadmittinghisstatement.Hecontendsthathisstatementwascoerced.Hemaintainsthatthedetective's"referencesto[his]girlfriendfrightened[him]...." 0    Thetrialcourtlistenedtoargumentsofcounselandreviewedthestatement.Thetrialcourtthenfoundthat:(1)theappellant'sstatementwas"freelyandvoluntarilymadeofhisownaccord";(2)theappellantwasnever"emotionallythreatened";and(3)whatthedetectiveadvisedtheappellantof"was[notin]anywaythreateningatall."Thetrialcourtchosetoacceptthedetective'sveracityoverthatoftheappellants.Therecorddoesnotpreponderateagainstthetrialcourt'sfinding.Thisissueiswithoutmerit.   EXPERTASSISTANCE    Theappellantallegesthatthetrialcourterredinnotappointingexpertsinhisnoncapitalcase.Theappellantrequestedaballisticsexperttotestifyastothemurderweapon'saccuracy.Theappellantclaimsthisexpertwouldhavesupportedhistheorythathedidnotintentionallyshootthevictim.Theappellantalsorequestedanexperttoexaminethetapeofhisconfession.Hearguesthatanaudioengineerwouldhavetestifiedthatthetaperevealedevidenceofcoachingandrerecording.Wedisagree. Innoncapitalcases,atrialcourtmaynotauthorizedefenseexpertsabsentashowingofparticularizedneed.Tenn.CodeAnn.4014201(b);Statev.Barnett,909S.W.2d423,431(Tenn.1995).Particularizedneedisdemonstratedbyashowing:(1)thatadefendantwillbedeprivedofafairtrialwithoutexpertassistance,or(2)thereisareasonablelikelihoodthattheassistancewillmateriallyassistinpreparationofthecase.Id."[M]erehopeorsuspicionthatfavorableevidenceisavailable"isnotsufficienttoestablishneedundermaterialassistance.Statev.Edwards,868S.W.2d682,697(Tenn.Crim.App.1993). Whetherexpertassistanceisrequiredinnoncapitalcasesisamatterlefttothetrialcourt'ssounddiscretion.Wefindnoabuseofdiscretion.Theappellant'scontentionpresentedamere"hopeorsuspicionthatfavorableevidence[was]available."Theevidencedoesnotpreponderateagainstthetrialcourt'sruling.Thisissueisdevoidofmerit.   PROSECUTORIALMISCONDUCT    TheappellanturgesthisCourttogranthimanewtrialbaseduponallegedprosecutorialmisconduct.Hearguesthatthestateimproperlyquestionedtheappellantabouthispriorjuvenilerecord.Thestateattemptedtoask:8 Q.Onpage17,youstate,"Itain'tlikewejustwentlookingforthatcertainpersontokill,butthatperson,see,whatitis,hewasmorelikeme,knowwhatI'msaying?He'smorebeeninjailalotfromwhatIhear.Hewasjustmorelikeme."Theappellant'scounselobjectedandthequestionwasnotcompleted.Hemaintainsthatthisquestionbiasedthejury.Wedisagree. Thestatemerelyrestatedanexcerptfromtheappellant'spreviouslyadmittedstatement.Thestateaskedneitherspecificquestionsconcerningthestatementexcerptnortheappellant'sjuvenilerecord.Moreover,inlightoftheoverwhelmingevidence,wefindthequestiondidnotprejudicethejury'sverdict.Thisissueiswithoutmerit.   CONSECUTIVESENTENCES    Theappellantlastassignserrorinthetrialcourt'sdecisiontorunhissentencesconsecutively.Hemaintainsthattherecorddoesnotsupportthetrialcourt'sfindingthathewasbothapersistentandadangerousoffender.Wedisagree. Theappellantwas19whenhecommittedtheseoffenses.Hisjuvenilerecordisdisconcerting.Hehadbeenadjudicatedonchargesofburglary,grandlarcenyofanautomobile,theftofpropertyover$500.00,escapefromcustodyoftheDepartmentofYouthDevelopment,andassaultinvolvingahandgunwhileonescapestatus.Intheinstantcase,theappellantcommittedmurder,aggravatedrobbery,andattemptedaggravatedrobbery.Theappellantshowedlittleregardforhumanlifeandexhibitednohesitationaboutcommittingacrimeinvolvinghighrisktohumanlife. 1   ׀Thetrialcourt'sfindingsareamplysupportedbytherecord.Thisissueiswithoutmerit.
