Thejuvenileandhismotherwererequiredtoattendaprehearingconference.Atthatconferenceitwaslearnedthatthejuvenilehadpreviouslyreceivedpsychologicalcounseling.Theprehearingconferenceresultedinadeterminationthatthechargescouldnotbeinformallyadjusted.ThePublicDefendersOfficewasappointedtorepresentthejuvenileandthemattersetforhearing. Atthehearing,thejuvenilejudgeacceptedaguiltypleafromthejuvenileandheldadispositionhearing.Atsaidhearing,HerHonororderedthejuveniletoenterandcompletepsychologicalcounseling/treatment. ThejuvenileappealedthisrulingtotheCircuitCourt.Noproofwasintroducedatthehearingofthisappeal.Instead,legalargumentwasheardconcerningtheauthorityoftheJuvenileCourttoorderpsychologicalcounselingforatrafficoffender.ThetrialjudgeruledthatthejuvenilejudgedidnothavethisauthorityandvacatedtheJuvenileCourtsorderrequiringpsychologicalcounseling. TheStateappealsthisruling. IftheJuvenileCourtfindsajuveniletobeatrafficviolator,thecourthastheauthoritytodealwiththejuvenile,interalia,inthesamemannerasadelinquentchild.T.C.A.371146(b). T.C.A.371131empowersthecourttoplaceadelinquentchildonprobation underconditionsandlimitationsthecourtprescribes.... Requiringpsychologicalcounselingasaconditionofprobationiscertainlywithinthepowerofthecourt,inpropercases.SeeStatevKevinYant(unreported)Tenn.Crim.App.atNashville.#01C019206CR00187opinionfiled7/8/93;StatevDonaldMitchellBoshearsandRonaldDwayneMorrisIII(unreported)Tenn.Crim.App.atNashville#01C019412CR00402opinionfiled11/15/95. Itisclear,then,thatthetrialcourtwasinerrorwhenitruledthattheJuvenileCourtdidnothavetheauthoritytorequireajuveniletoundergopsychologicalcounselingincidenttoatrafficconviction.Whethercounselingwasappropriateinthiscasewasnotruleduponbythetrialjudgesincethecourtruledonthisissuepriortoaformalhearing.AdenovohearingwouldberequiredforHisHonortodeterminewhetherornotcounselingwasappropriateinthiscase. Appelleesubmitsthat,sincethejuvenileshistoryofpsychologicalcounselingwasdivulgedattheprehearingconference,theevidenceofsameshouldnothavebeenpresentedtothejuvenilecourtatthehearingsinceinformationgatheredattheprehearingconferencecannotbeusedagainstthejuvenileatthehearing.Rule14(c)(2)(v),Tenn.R.Juv.P.Ifthisistrue,theremedyforsameisadenovohearingbeforetheCircuitCourt.ϜTheevidenceisinadmissible.SeeRule14(c)(2)(v),Tenn.R.Juv.P.
